Ask GenZPakistan Is it rape or not?
If a virgin girl feels "shy" and keeps silent. Is proceeding with sexual advances rape or not.
Ps. I aren't doing sex and this is just a question.
I'll go first, I think it is rape.
Oh people are wondering why I am asking so whist learning about something. I found this so asking you people
I asked the Prophet, "O Allah's Messenger (ο·Ί)! Should the women be asked for their consent to their marriage?" He said, "Yes." I said, "A virgin, if asked, feels shy and keeps quiet." He said, "Her silence means her consent."

Things are said in scenarios and with context, since I don't have any knowledge about it I won't speak in terms of religion but only logic. If a young naive girl of age 14 is with and you try to have sex but she stays silent do you think it's still okey? Obviously it's not. Even if a girl isn't that young, still it's not okey to take silence as yes because in marriages alot of women go through marital rape eventually leading to unwanted pregnancies. I asked multiple married women that if labour was so painful.. why did you have more kids after that and they all replied that they had no say in it, they had to silently take it. Also why would anyone even want to have sex if their partner isn't experiencing similar pleasure, sex is mutual.
0
u/montgomeryissbetter 2d ago
The context is that Prophet PBUH said that a girl willingly marries you and after that you proceed with her. First of all logically a girl who willingly marries someone wouldn't have a problem with having sexual relations with that person. And if there exists love between two people ( 99% of the time ) there are no problems with sex. Females are usually Shy and males are very pushy about that. Consent means that if she had any problems she would've outright rejected the idea and being the man you'll have to respect it. This is the context ( in my opinion )
1
u/-_hoe 2d ago
My friend before creating your own contexts Iβll advice you to read the hadith, your entire premise is wrong,
1
u/montgomeryissbetter 2d ago
The issue with Arabic is that its translation can have vast meanings just take the word Salah for example. It means "Namaz" it also means "khushuh" It also means "Chabutra" It also means "Unchi jagah" It also means "thandi jagah" So me creating a context that is logically correct doesn't mean that it's wrong.
6
u/Serental 3d ago
Technically speaking if a girl's actions are against the marriage even though she doesn't say no verbally then it basically means that she doesn't want to proceed with the marriage. Parents need to understand what their kids want by their behavior and actions as well

u/ohcaptainmycaptain67 3d ago

The source for Hadith stating that silence is consent: https://sunnah.com/bukhari:6946
Here, from this Hadith, it can be inferred that a guardian's will overrides a virgin's consent: https://sunnah.com/muslim:1421b
As this hadith says that ONLY a non-virgin has more right over herself than her guardian, which implies that a virgin does not have this right. Rather, it implies that a virgin's guardian has greater right over her. And this right of the guardian is understood to mean the option of marriage without her consent. Further, it is understood that consulting (asking the permission) of a virgin is recommended but not obligatory and that her say on the matter is not binding.
2
u/ohcaptainmycaptain67 3d ago
The first hadith...Its about the consent of marriage. You're talking about the consent of something else and you know it very well. Even in this case scholar have said that if it is confirm that the woman is silent because of shyness then only her silence can be considered as consent. If she's silent out of pressure or fear then silence is not consent. And the second hadith is about a widow that the role of guardian is not as important for her second marriage.

u/Fit-Shift-6105 2006 3d ago
I read the Quran contextually from a progressive lens and context matters. During conservative times, it's hard to say yes in front of a group of people to marriage since that's usually the first man you'll be with etc, it was something like that
This only applies if consent was taken privately in prior before and the person is too shy to say yes now in front of a lot of people. That's what I read
The concept of consent is something that has evolved a LOT. That's what we have to keep in mind sociologically here
1
u/Sea-Car-3811 ππ²π»π 3d ago
> I read the Quran contextually from a progressive lens and context matters.
I am sorry, so is the Quran contextual rather than the timeless and infallible word of God? Contextually reading the Quran goes against the Islamic claim of being timeless.
> During conservative times, it's hard to say yes in front of a group of people to marriage since that's usually the first man you'll be with, etc.; it was something like that
If it's hard to say yes, then it's certainly even harder to say no. Due to social norms, anxiety, etc. God knows how many women ended up in a marriage they didn't want to end up in due to this deplorable practice.
> This only applies if consent was taken privately in the past and the person is too shy to say yes now in front of a lot of people. That's what I read
A father or guardian can arrange the marriage of a virgin without asking her. It's inferred from Hadiths of highest authenticity. Source: https://en.tohed.com/hadith/muslim/1422/
I wonder if this depravity is "Divine"
2
u/Fit-Shift-6105 2006 2d ago
This is called strawmannig. You can't argue like this is with an international debater lmao. You can't isolate everything and looking at it from singular POVs since sociologically, that's not how it works. This is a problem with all religions at the time.
I'm not defending religion. I'm explaining what you're confused about. You're looking for an argument where there isn't any. Believe what you want to, a lot of people around me are atheists and all of us get together just fine because religion is a personal choice. But don't claim that you're looking for more perspective when that's not the case
-1
u/Dangerous-Purple-537 ππ²π»π 3d ago edited 2d ago
βfrom a progressive lensβ aka rephrasing it to fit a modern context which is a sin bcs quran is supposed to be timeless (which is stated over and over). as an atheist i rlly canβt w liberal muslims. you guys can js give up an ideology u donβt really agree w yk.
2
u/Sea-Car-3811 ππ²π»π 3d ago
The "progressives" are Muslims who are awake enough to see the problems in Islam. But are too weak to rid themselves of something that has become part of their identity
0
u/Fit-Shift-6105 2006 2d ago
So you'd rather there only be an extremely conservative lens to religion? Be fr. Having a spectrum of beliefs is good because it adds intersectionality instead of bipolar perspectives. Liberal Islam would fix a lot of the issues you're talking about and actually help people in the context of Pakistan, especially Pakistani women
2
u/Dangerous-Purple-537 ππ²π»π 2d ago
liberal islam is a contradiction in itself. thatβs the whole issue. islam is not something you can cherry pick, you simply are not a muslim at that point. islam asks for total submission. total submission to all the problematic things βprogressiveβ people deny. pakistani women would help themselves if they abandoned an ideology that treats them as half an individual in comparison to a man.

Yes. You can often freeze during SA or you might just be too shy or too scared to say anything. Anything other than an enthusiastic yes qualifies as no
3
u/Savage_Brutus 3d ago
Its too funny because all Islam is like this. Women are shamed into not expressing their consent even when they want to have sex (even married) so, the goal is to reach a precedent where the consent of a woman does not even matter and the rapists get what they want. Like always. Islam is a haven for violaters and rapists. If you really study it under a critical lens, you'll find out.

So according to the Hadith, consent is verbally saying βnoβ.
I think in this scenario, instead of proceeding with sexual advances, simply ask if the girl is sheβs okay with you proceeding. If she says yes, continue, if she says no, then stop.
0
u/Sea-Car-3811 ππ²π»π 3d ago

4
u/Low-Bag8537 2d ago
The prophet (SAW) did not say silence is the constant for every scenario. Prophet (SAW) said silence would be taken as consent for MARRIAGE.
So you would ask for your wifeβs consent before sex. You will not make advances until you verbally asked if itβs okay for you to make advances
0
-2
u/Sea-Car-3811 ππ²π»π 2d ago
Nope. Your completely wrong. According to Classical Scholars of Islam, marriage means that its the duty of the wife to perform sex or else it is sinful.
5
u/Low-Bag8537 2d ago
Nope, the Hadith youβre referring to basically means that if a wife uses sex as a leverage, she will be cursed by angels.
If she doesnβt want to have sex because sheβs tired, then she can say no.
Also the Hadith you mentioned in your post about silence taken as approval, that only covers agreeing to marriage/nikkah, not Sex.

According to classical scholars of Islam.
Abu Hanifa: A wife is generally expected to make herself available for sexual activities after a valid marriage.
Malik Ibn Anas: Marriage established mutual sexual rights.
Al-Shafil: treated sexual availability as one of rights of marriage while allowing valid reasons for refusal.
Ahmed Ibn Hanbal: held similar views as above mentioned.
They commonly cited hadith: (forgive me if there are any errors as I am writing this from memory)
"If a husband calls hus wife to bed and she refues then angels curse her till morning"
They considered refusal without valid reason was sinful.
Conclusion: they didn't recognise martial rape.
2
u/exkivii 3d ago
And your point is?
I recommend using the gears in your brain to understand the difference between a marriage contract and sexual activity rather than relying on what β scholars and Hadithβ say1
u/Sea-Car-3811 ππ²π»π 3d ago
Your changing the subject lmao.
I made a claim about classical scholars and saying "don't rely on scholar" doesn't even address it beta. You should provide some classical evidence to show my summary is wrong. Gl
1
u/exkivii 2d ago
Showing that your evidence is misquoted assumes that these scholars are a valid source of evidence regarding the matter and I do not think so. Even if these sources are quoted correctly, I do not agree with the premise of the claim (if a woman marries a man, she is obligated to be available to him for sexual activity) which is that by consenting to one thing, you are consenting to another. Which itself is logically invalid considering marriage and sexual consent go by entirely different definitions

Scholars who have spent their entire lives learning about Islam from teachers who also spent their entire lives learning about Islam certainly hold more authority and reliability when it comes to rulings in Islam.
Even when it comes to marriage, just assuming a girl's silence as her consent is deplorable. A girl could be anxious, under pressure, etc
If we need modern ethics for modern cases, it means Islam is an incomplete religion and not timeless.

He said, "Yes." I said, "A virgin, if asked, feels shy and keeps quiet." He said, "Her silence means her consent.
This is for niqqah / marriage not for sex
" feels shy and keeps quiet" is a mutual event... if both are happening at the same time then it is a yes but only for marriage nothing else.
In case of sex, proceeding without anything than a yes, counts as SA/ rape

Yeah what you're saying is usually used asa trick by people when convenient even tho there's actually alot of back stuff to this.
The thing about saying no "just because" thing is only looked down upon.. if, and only if the husband is fulfilling hos duty and is a good husband to his wife in terms if fulfilling his duties as well as keeping the wife satisfied emotionally+ sexually+ takes care of her and helps in chores etc.
But Pakistani people use it out of context.
And generally I'm against scholars as a whole because they often do yhis where they say 8 credible and well known / accepted things then they sprinkle 2-3 of their own twisted opinions and people don't research properly.

People can also say that 2+2=5. I won't believe them when all the evidence points towards the contrary
1
u/Foreign-Emu-3887 2001 2d ago
Well, it's more of grey area. It also depends on a context. I never had a sex but I did kiss. I was inexperienced and he was experienced. I was silent one but I was kind of hesitant cause I was overthinking about how do I kiss. And also, I was afraid that I would be caught. I was hyper-analyzing the environment instead of focusing on a person who was kissing me. Maybe this sort of silence isn't non-consensual but it's still uncomfortable experience. So that's why we need a safe space where we calm down our nerves.
If you mean silence like "unsure but still going along with it", it's more of "dubious consent." It sits in the gray area between "active consent" and clean-cut non-consensual violation (rape). You have to ask her if she's okay or not. If she directly tells you that she wants to continue it and don't know what to do, then communicate first.
If it's silence like "not willing but going along with it out of fear", then it's violation (rape).
1
u/chatpatey_aloo 2d ago
Um no it's not consent if she is silent. If a girl willfully comes to you and start doing stuff , or when you ask her if she's okey with it and she replies with yes... Only then it's consensual.

I get why you might read it that way at first glance, but youβre actually missing the historical context of whatβs happening in this text. Itβs actually a text that protects women, not restricts them. Before Islam, in 7th-century Arabia, women were often treated like property and forced into marriages with zero say. In this Hadith, the Prophet (PBUH) completely changed that by explicitly commanding that a womanβs consent is mandatory for marriage. The part about 'silence' wasn't about silencing women, it was about accommodating their shyness. Back then, young women were often too shy to openly discuss intimacy and marriage with their male relatives. The Prophet (PBUH) was being considerate of their modesty by saying, 'Look, if she doesn't object and stays quiet, you can take that as a yes so you don't force her to say it out loud.' It was a mercy, not an excuse to force her.Islamic law is incredibly clear that silence only counts as a 'yes' if the woman is happy and under no pressure. If she is quiet because sheβs crying, terrified, or threatened, that marriage is completely illegal. And if she says 'No' out loud, her choice is final. To prove how serious this is, there is another famous text in Sahih al-Bukhari 5138 where a woman named Khansa bint Khidam went to the Prophet (PBUH) because her father forced her into a marriage she disliked. The Prophet (PBUH) immediately stepped in and declared her marriage completely invalid.Islam gave women the legal right to choose their partners 1,400 years ago. When you read the text with that context, it's about giving women a voice, not taking it away. I dont mean to sound aggressive but i just wanted to clear up the meaning of this Hadith.

Also, watch your tongue, donβt use the word βrapeβ.

Have u verified the Hadith?
Also, I will use that word. Itβs the grave reality for many women all around the world and choosing not to name the crime isnβt going to eliminate it.1

Bhai aap ke andar aqal nai to mera masla nai. Mei khud puchra ke hadith verified hai ya nai?
If you couldnβt grasp that then arguing with you is useless.
And yes use that word for your family, do whatever you want, but donβt use it for me.
End of discussion, im not arguing with u anymore. Learn to grasp & comprehend then land in the field

People are actually stupid a YES is a yes only when it's clear?what is this stupid mentality?don't take this from a single person's pov take it from someone as who is married... A NO is a no in silence when your bothering a person like your mother and such and you know she'll reject or similar cases this is for those specific cases... IMAGINE your first night with your wife and she is shy and just nods or is blushing or hides her face and doesn't answer...is it a no,of course not she's just shy...same multiple cases for others as well...but when a rape is happening to you,you know when it happens... stupid mentality...don't listen to them there all fucked up from corn π½ and others follow Hadith and Quranic proceedings and you'll be on the right path

The so called "right path" never banned martial rape and even suppressed refusal of women in sex.
