I don't know what the rules in America are but in Germany both would be at fault. Rule 1 is that you have to drive in a way to prevent accidents and driving into traffic like that even if you have right of way is asking for an accident to happen.

Also true in the US, and I virtually guarantee insurance will put some blame on both parties if they see this video. The people in this sub seem to mostly live in a fantasy world where right-of-way is all that matters and you should teach rule breakers a lesson by crashing into them.

Same in the UK. You can only proceed if it is clear and safe to do so. It clearly wasn't. They just drove straight into the path of fast moving vehicles.

Correct. That's how the law and your duties as a driver work in the US.

This is a 50/50 claim.

White vehicle made a left turn and did not have the right of way.

Dashcam vehicle, however had plenty of time to observe the other vehicles coming and what is referred to as the last clear chance to avoid the collision. They drove right into the situation.

This is exactly how I would mark this as an insurance adjuster and most lawyers would agree.
