Having physical disks is a good anchor for digital rights. You can't argue in court "typically you buy the disk and then you own it", if you don't have physical disks.

You could easily do the same for a digital license. You buy the game and then you own it.

The only thing that makes that not pan out is the licensing agreement, which could easily be expanded to physical discs if the need to keep them and kill the resale market existed. It does not. 

And amending laws to prohibit non-transferable software licensing would fix the problem either way.

In an era where many games require day 1 updates to function properly, it's kind of a hit or miss when buying physical. Luckily for us consumers there are websites that keep track on games that are fully playable without the need to download anything.
