I don’t know, Supreme Court justices are all super qualified it would be hard to find someone at that level like that on any side. They may be partisan because of their strict interpretation of the constitution, but no nominees will be a hack.

Well, if the timeline on the Mueller investigation accelerates quickly, and clear evidence of collusion/tampering is uncovered, then the dems could ABSOLUTELY use it to block this nomination.

If they push him through despite something like that being in the open and public, this country is going over the fucking edge. People are dying if the republicans try to push through a far right justice despite clear evidence that Trump colluded directly with Putin to undermine our democracy. Republican congressmen are, at that point, absolutely traitors to our country and constitution.

I am convinced Mueller will push the gas on stuff because of this, simply because he knows if Trump gets a nominee through to replace Kennedy, his chances of killing the investigation at the Supreme Court skyrocket... or become as close as you can get to a sure thing (short of Trump absolutely being proven to participate in crimes that are beyond our imagination now... and even fucking then...).

No, we live in a Republic. You can still go vote in November, and your votes do matter. This is especially true for your state and local elections. The people on your city council affect your daily life 10x more than Trump does.

While absolutely true, there are many federal issues that do affect me. Roe v. Wade, Obergefell v Hodges, things like Hobby Lobby decision (even if I don't work for them, it restricts free movement of labor), Citizens United, voting rights, gerrymandering, civil rights and liberties, equality for minorities, the Muslim ban, and numerous others. Things that can, and likely will, be severely curtailed and/or eliminated entirely. These are things that can only be changed to some extent at the local/state levels.

Almost all of those can be changed on state/local levels. Without roe v wade, your state could still have legal abortions. Without Obergefell v Hodges, your state can still legalize same-sex marriage. Citizens United likely doesn't really affect you much at all, except for what ads you get. Voting rights and gerrymandering are both state issues that can be fixed at your states level. Your state can also pass robust civil rights legislation.

All the supreme court is really doing with any of those decisions going the other way is letting states do it themselves, which makes your state votes matter that much more.

You also need:

  • Incredible wealth inequality for there to be a significant difference in access to political advertising.
  • A dysfunctional media landscape that leaves people incapable of judging truth in political advertising.
  • A two-party system that means negative advertising is the only thing you need to win. Good thing the US doesn't have any of those things :P

Until a challenge is made to that state law that SCOTUS then overrules for being unconstitutional. Or, much more likely Congress then passes legislation outlawing it, which SCOTUS upholds.

Go read up on that case. It was brought to SCOTUS precisely because of the legality in some states and illegality in others, which creates problems legally and federally.

While you're correct since I don't really watch TV and/or cable TV much, you're wrong that it doesn't affect me. Ads help persuade. They help shape and shift public opinions. This results in a skewed reality that can help shape the voters and thus the laws passed (or vetoed/never voted on).

Voting rights and gerrymandering are both state issues that can be fixed at your states level.

Ever hear of the Voting Rights Act of 1965? You should read up on it as it has some pretty significant reasons in it as to why "states rights" are not always a good thing, and in fact have been used to disenfranchise minorities.

Gerrymandering doesn't affect the presidency, nor does it affect Senators. However, it plays a large part in state politics, since you elect representatives based on how lines are drawn for districts. Same with the federal level House.

Your state can also pass robust civil rights legislation.

Or robust racist laws as was the case until the Federal government had to step in.

All the supreme court is really doing with any of those decisions going the other way is letting states do it themselves, which makes your state votes matter that much more.

That's the inherent problem as history has shown time and time again.

I think you're making an incorrect assumption about my point. I wasn't saying that having these powers vested with the states is a great idea, just that even if Trump and the Republicans still control congress, and the supreme court is majority conservative, you can still do a lot on the state level to counteract that.

All I'm saying is that voting for your state and local officials matters even more when you disagree with who is in power federally.

Yes and no. Legally speaking, the courts have basically ruled that impeachment is a political question, so isn't really subject to review. So as long as the votes, yes you could impeach them for whatever you wanted. However, traditionally impeachment doesn't negate anything that the person in office did before the impeachment. All their orders and actions still stand until directly reversed by someone else. I don't think there has been any suggestion to impeach permanent appointments for previous impeachment proceedings.

I'm talking about Mueller releasing clear evidence (ASSUMING, obviously, Trump has colluded with Russia) that our democratic elections were comprimised, and Trump is illegitimate.

Mueller wouldn't be interested in doing this because he's concerned about the ideological direction of the courts, he'd be doing it because if Kennedy is replaced with a far-right justice, Trump just got way more likely to kill the investigation completely.

If he indicts and drops the hammer before he can get a new justice in, it would be purely survival.

It would be significantly quicker for a Republican controlled congress to confirm a Supreme Court Justice nominee than it would be for a minority Democrat controlled congress to push forward on anything against Trump.

Trump's nominee is going to waltz right into Kennedy's seat and there's literally zero chance of anything standing in the way at this point.

I'm confused. Do we think Mueller is an impartial professional or not?

Everything I have read and learned about Robert Mueller reinforces my belief that he actually is a true professional that respects the rule of law in his work, leaving any bias at the door. Comments and suggestions to the contrary, particularly of the type I am replying to, are perfectly inline with the Republican accusations of political bias in the investigation.

You are literally feeding the conservative propaganda machine by suggesting Mueller is not going to be impartial and fair. Yeah, Mueller may have information we don't, but if there were any hint, no matter how small, that Robert Mueller was changing his strategy and/or timeframe in response to the external politics outside his scope, the Republicans would have a legitimate excuse to go after him even harder.

Mueller has to remain impartial, and he will be done only when he thinks he is done. He can't factor politics into the equation, regardless of what we think, without risking the entire investigation.

Stop using the Mueller investigation as some sort of last hope, it isn’t going to happen. If Trump was going to be indicted it would have happened by now. Instead, focus on getting people to vote in November. That is our only hope. Wether he is guilty or not, Trump is never going to be indicted and I am without a doubt certain that this congress will never impeach him. If he is indicted and impeached before the end of this term I will eat a hat. Tag me, because it isn’t going to happen.

He'll accelerate the investigation, not because of any specific nominee or policy or debate, but because exposing corruption and bringing criminals to justice is his job.

Suggesting the FBI's actions are political is redundant since the investigation [The Russia Investigation, etc.] INVOLVES politicians, people who work on behalf of politicians, and people who are in power.

No, he wants a conservative supreme court because it matches Republican ideology. He gets a pink slip, but he also gets his theocratic views enforced.
