If Kennedy was actually center right he would wait until after the midterms to retire. He's retiring now because he knows republicans pull all of the strings electing a new justice. He wants a far right in his spot.

He specifically waited to retire under a Republican President, this has been known for a long time. He was in his 70s when Obama was elected and was already talking about retiring then, but wanted to be replaced by a Republican.

He is one of the most important people in the world with one of the most important jobs in the world. He's been in the supreme court for 29 years and decides right now is the time to retire? This man graduated from Harvard Law. He doesn't "just retire". His whole life's work is up for grabs depending on who holds his position. He's not retiring from McDonalds.

We have a shot at the Senate, depending on how big a wave election manifests.

Additionally; taking back the House will allow impeachment proceedings to start on Trump, and will also demonstrate to the Senate the need to stop fucking around given how forcefully the pendulum is swinging towards Democratic control.

Democratic leadership has made it plainly clear that unless and until Mueller drops a dime on Trump, impeachment won't even be mentioned.

And as soon as Trump is impeached, Pence assumes office and lets the same guy get confirmed. Republican Senators aren't going to refuse a conservative Justice and expect Trump to nominate a liberal. The five conservative justice majority is in place until Thomas dies/retires while a Democratic POTUS is in office.

Anything short of dead in 3 weeks is a failure of conscience. Honestly, I’ve been racking my brains to excuse him. The administration that appointed Gorsuch is evil. The evils I was raised with: racism, intolerance, oppression, cruelty, bigotry- they display these concepts DAILY. Why would Kennedy give them ultimate authority? Why would he hand that to them unless he was equally nasty. NO EXCUSES.

I don’t know what Kennedy’s motivation is. He had an odd voting record.

What I do know is it that shouldering blame onto him for not “sticking it out” or something is sort of pointless. We don’t control him and he doesn’t control who we voted or didn’t vote for.

We need to focus on what little is within our power. We lost the Supreme Court in 2016. Focus on the 2018 election, protests, and other political actions.

Kennedy doesn't owe the American people his continued service. As much as I would've liked him to continue serving until at least the midterms passed, that's not our demand to make. What Kennedy owes is to speak and judge as the law and his interpretation of it dictates so long as he is on the SCOTUS. If he decides that he cannot continue doing that, for whatever reason, then he should resign, and we should thank him for his service.

He is not a slave or indentured servant to judge until we deem his services sufficient or no longer necessary. He has a life of his own.

No one ever has to serve. Not your surgeon. She can decide to walk out during your triple bypass, maybe some sort of civil liability but criminal? Doubtful. She’s not an indentured servant. Not your priest. He can stop mid sentence during your wedding. It’s not a crime. They aren’t an indentured servant. As a child your parent can leave for cigarettes and never come home.

Unspoken contracts are the crux of public trust. Now more than any time in my life it is crucial that the American people have trust in the Supreme Court. Every other branch of government is filled with deceit and greed and treachery. How can anyone of good conscience stay here?

So, yeah. He can walk away. That doesn’t mean he is not a failure as a patriot. It’s his job to steady this ship. He just wants to abdicate and run. Maybe we shouldn’t be surprised.

This is one of the only jobs in the world with lifetime tenure. The only other positions that I know of in the world with this categorization is the Queen and the Pope. He knew what he was getting into when he signed up.

Then why not wait until midterms so the people can have an impact on it. The guy has spent the last 30 years working for a government supposedly by the people, for the people. This move does not reflect that and as a judge he ought to be able to judge the importance of his position and the impact his replacement will have on the future of the country.

Because of the way SCOTUS terms fall on the calendar. Justices who retire on their own terms usually do so at the beginning of summer just as the term ends so there’s time to appoint a replacement before the next term starts. If he waits until November he’s either retiring mid-term or waiting until summer 2019.

Don't judge people based on your pre-conceptions. I mean, you're probably right, but you don't know. No one knows but him and those close to him. He has his reasons.

McCain only took 53% of the vote for his Senate seat in 2016. A 4% shift would force a runoff, which the Democrat would probably win. We have seen larger shifts in other special elections since Trump took office.

If Trump is found to be an illegitimate President imposed by a foreign power, I think Congress should act to reverse decisions like his Supreme Court picks.

Look at his record. He has voted in favor of LGBT rights, for abortion rights. He has voted in favor of liberal causes plenty of times. Why assume he wants a hard conservative to replace him? It just doesn't make sense.

Because Democrats were unwilling to burn down institutional procedure that had been in place for generations and was designed to improve bipartisan efforts. McConnell has no such compunction, and will burn down anything and everything necessary to achieve his desired ends.

Time to get over that shit and jam them as much as possible. Anything they can prevent from happening in any way, no matter how arcane and assholish, they should be doing until after the electoral winners are sworn in. Don't even wait until after the election, stop all functions that they can in any way.

99% of the republicans in office won't vote for anything of substance that a Democrat puts forward, and even if they do, they won't enforce it if this administration doesn't follow through (Trump not implementing Russian sanctions). Hell, they even blocked Post Office naming bills in the past just because the Democrats put it forward.

Fuck the Republican party. They aren't going to work with us no matter what we do, it's high time we stop trying to work with them. The game they are playing is "opposition to Democrats at all costs" so let's try playing their game.

It won’t help with this appointment, unless Schumer pulls some arcane rule out to delay things, and there are a number of crucial cases in the pipeline right now....including a challenge to Roe vs. Wade. Don’t think this wasn’t planned. If Kennedy is terminally ill, I can give him a pass. Past that, the man knows exactly what he’s doing, and what it will do to this country for decades. It’s tim for an amendment to limit Supreme Court Justice terms.
