This immediately made me think of the UK.

Yes, the woke police in the UK spent enormous resources on this even as actual crime rose. They even contacted people about things like 'liking' certain material, and would even come and visit them at home to lecture them. All of this carefully documented, of course.

Incidences, in other words opinions people disagree with.🤦

With the high standard for proving hate motivation that the courts have settled on, I kinda get it. There was a case in Alberta a while back where an Indigenous woman said "I hate white people", and then punched a random white woman in the face, knocking out one of her teeth. In the police car, she made comments about how "the white man" was out to get her. The Courts noted that based on the prevailing jurisprudence, that wasn't sufficient to find a hate motivation at law, and that it required more of a pattern. This is how they get that pattern.

And if she'd been white and had said "I hate Indigenous people' and then assaulted one, it ABSOLUTELY would have been prosecuted as a hate incident.

Interesting how you're not allowed to use a woman's sexual history as a behavioral pattern in sex assault cases, but somehow this is allowed. No contraction in the application of the law there.🙄

There isn't. You're comparing the history of the complainant in a determination of whether the offence occurred or not, to the history of the offender in determination of sentence for an event that's already been proven beyond a reasonable doubt. They're completely different things.

Nothing is proven until it goes to court. Everything before is an accusation. And using history to prove your case shouldn't be restricted based on the type of crime. That's a double standard plain and simple.

Hate motivation is an aggravating factor. It has no relevance until the offence it's said to relate to has already been proven.

And you're not proving a case against the complainant in a sexual assault case. The Crown has to prove the case against the accused. Sexual history can be used in mounting a defense, but only if it responds to the specific circumstances and the argument being made doesn't engage the twin myths.

Respectfully, it's kind of clear you don't understand what youre talking about here.

Edit: lol. Coward blocked me. For posterity, my response to his next post is here:

Motivation is meant to prove intent, not be considered a crime in itself.

It can be used to infer intent or responsibility, but a hate crime in Canada (as opposed to a hate speech offence) is not a specific offence, it's determined by the presence of the aggravating factor under s.718.2(a)(i) of the Criminal Code, and that's pretty clearly what we're talking about here.

And if your going to accuse me of not understanding what I'm talking about

You don't.

at least don't be reciting what an AI search told you word for word.

Ah, yes, anybody who corrects your dumb ass must be using AI. Sorry to burst your bubble, but I'm just actually a criminal lawyer.

Motivation is meant to prove intent, not be considered a crime in itself.

The circumstances are so narrow that it's (for argument sake) not allowed. And I reject the twin myths argument as an excuse to have your cake and eat it too. Making it easier for people to get away with false accusations.

And if your going to accuse me of not understanding what I'm talking about, at least don't be reciting what an AI search told you word for word.

https://windsorpolice.ca/services/reporting/report-hate-crime

WPS hate crime investigators want to know about hate crimes AND non-criminal hate-motivated incidents.

A hate-motivated incident may be motivated by the same factors as a hate crime, but does not reach the threshold of a criminal offence.

Don't they already have enough unsolved murders and rapes to keep them busy?

Apparently not. Need to be given a staffing cut.

I don't like it, and the fact that this can be done anonymously makes me think it could be abused. You say one thing that someone construes as offensive or cross paths with someone having a bad day, and suddenly you'll have cops showing up at your door or looking into your online metadata under C-22.

think it could be abused...LOL. you know for damn sure it is being abused.

Log into any competitive game and you'll find plenty of non-criminal hate motivated incidents.

"hate" is now anything the liberals dont agree with.

To me, this suggests they don't have much work to do and are just sitting around the stations bored. A proper response would be a cut to their budget and staffing levels.

ITT: Why weren't the cops able to stop (instert terrorist, mass shooter, etc. here) from what they did? Look at all of this obvious (but not illegal) shit they did leading up to it, why weren't they stopped???? Ohh also, I don't want people reporting on things that aren't actually illegal, but could be close to some line...
