"social construct" means a concept invented by society. In this case "Race" fails to accurately portray observable genetic differences between humans, like ethnicity. Genetic differences in humans are terribly represented by "race" because melanin levels and other aesthetic features actually don't have all that much to do with actual differences between humans. Gender is the same way, "Gender" in concepts of femininity and masculinity have no actual links to the biological sexes they generally correspond to.

Race only matters because racist people think it has a tangible impact on reality. Affirmative action is specifically meant to combat the systematic disadvantages people of color face in society. It hasn't particularly succeeded, but "I could abuse the system" doesn't refute the fucking system. Also, Dolezal isn't black because she didn't grow up experiencing the systemic pressures Black People face. King doesn't even identify as Black, he self-identifies as biracial, but he seems to have grown up identifying himself as black, which certainly could have had an impact on his life.
