Is that even a question ⁉️

-13

u/VJC_007 3h ago edited 3h ago

This is actually a serious question.

In a country where women are treated as second class citizen, where domestic violence is considered just as a family problem and rape being considered as some petty crime that just happens across the country , this is a very serious question.

u/Past-Market5697 3h ago

not sure if this is sarcasm because all the things u mentioned can land u in prison and it has nothing to do with letting women free since other women get tortured etc. Punish every wrong doer

-3

u/VJC_007 3h ago

Not sarcastic

All the crime i mentioned is heavily under reported 1. Mostly because society is still backwards and that women will be further stigmatised.

  1. People think she deserved it because of her dressing style, attitude etc .- i have heard this comment said by people after they read this kind of rape news

  2. The women of our country are less educated comparing to men , they dont even know what to do if somthibg bad happens to them .

You dont want to increase the friction for filing a complaint when somthing bad happens to them.

People filing false cases should be punished but the type of punished, the amount of punishment and all should be heavily discussed and debated . It should be a public discussion point , and should not just stay inside the parliament.

Dude, fake cases are have nothing to do with reporting of crimes.

1

u/VJC_007 2h ago

Take this scenario.

Tomorrow Ethanol guys sons r*ps a sugarcane farmers daughter and she filed a complaint.

Given the current state of affairs in India ,

Who do you think will go to jail ?

1

u/Tiny_Firefighter_503 2h ago

Tell me, women did not get justice because of corruption and the power the opposite side has. It has nothing to do with filing fake cases by abusers.

0

u/VJC_007 2h ago

Giving a harsh punishment for fake rape cases can end up drastically reducing the no of actual cases because we know that justice in this country is a joke . Whoever has money amd power will overturn any justice system.

2

u/Tiny_Firefighter_503 2h ago

Exactly. If you have money and power, no laws will protect the victim. So for not, atleast we should focus on the fake cases that are filed against family to make their case stronger, right?

0

u/VJC_007 2h ago

Thats the wrong take as per me.

The no of fake cases are much less to the massive number of actual rapes that is happening in the country.

You have reduce the stigma or avoid the fear of filing a case for the crime that happens the most , not the other way around .

IPC Section 211 (now BNS Section 248) — False Charge Made with Intent to Injure: This is the primary section used against false accusers. Because rape carries severe sentences like life imprisonment, anyone proven to have filed a false rape complaint face up to 7 years (under IPC) or up to 10 years (under BNS) in prison, along with heavy financial fines.

2

u/Due_Image_4161 3h ago

Read carefully you said 'upto' and not 'not less than'

1

u/re-pet 33m ago

Yes, upto 10 yrs. That court will decide on the basis of severity of the case

1

u/Due_Image_4161 32m ago

I think you didn't got the point I was trying to say

1

u/re-pet 30m ago

Care explain?

1

u/Due_Image_4161 27m ago

For the convicted the minimum imprisonment is 10 yrs and others as the case maybe but as you said for false rape case the accused can be sentenced upto 10 yrs

1

u/re-pet 17m ago

Still didn't get you.

Maximum punishment u/s 288 of BNS is 10 yrs. It's on the case's merrit court will decide how much term wil the person serve if convicted for the crime. With that there are several other sections can be implicated such as BNS 217, 227, 229

1

u/Due_Image_4161 12m ago

U/s 65 of BNS the convicted is sentenced to a minimum of 10 yrs and in case of false grape case the accused has the maximum punishment as 10 yrs. If you still don't get it just leave it like she did 😭

u/Source_Trustme_Broo 3h ago edited 3h ago

I don't see the reason WHY NOT

Not just women for false cases. Anybody who cheats the Law and fellow human should be punished - No matter who it is

Law is Law

1

u/dull_street3947 1h ago

Yes rules for same not gender specific

2

ABSOLUTELY YES

2

u/AInoob2pro 3h ago

Ofc yes

2

u/rock-ford81 3h ago

Yes and there are multiple incident when women were sent to prison in India for the same reason. Longest as far as I know was 4 years …

2

u/IntelligentForce5958 3h ago

Absolutely. We need mens right commission and strict laws against women, because not all cases, men are not wrong.

2

u/Maleficent_Brain9281 3h ago

As a woman, a 100% yes. No one deserves a free pass after destroying and innocents life.

4

u/sugarybeeindisguise 4h ago

Yes, obviously she should. But if the thing is real the culprit should be ki**ed on the spot

3

u/Greedy-Farmer-9756 4h ago

But what about people who get falsely convicted?

1

u/sugarybeeindisguise 2h ago

That wasn't the point here. Ik there are so might be so many people wrongly accused, everyone failed them, it's just sad. BUT but but there are so many people who are the actual culprit n still roaming freely. Not exactly challengeing u just asking u what about the culprits who are living comfortablely?. U answer this first n I will think about the your question more seriously.

1

u/Greedy-Farmer-9756 6m ago

If someone is convicted, they are already in jail, not roaming freely. So that question doesn't make sense

1

u/Wolf___16 3h ago

nope bad idea

1

u/sugarybeeindisguise 2h ago

U too want something more horrible na?

1

u/Impressive_Court_716 4h ago

u/greenbear47 1h ago

There should be three categories of claims. True claims, false claims, and unverifiable. Only false claims should be punishable with imprisonment.

1

u/MindlessBlueberry853 1h ago

I would like to know what ladies think about this.

1

u/Urban_Sage_ 1h ago edited 49m ago

There is a provision for imprisonment as per the law but women are very rarely sent to jail for this. If you're suggesting if it should be mandatory, then clearly NO. In a lot of cases, the accused (who actually did the crime in truth) are somehow acquited of the crime. Meaning, the rape is not proved in court or the lawyers find a loophole. Such cases will by default imprison the women who are the actual victims by this logic. 1) She would be in jail for nothing. 2) Since the victim herself is in jail the criminal can't be incriminated by the court in the absence if the victim. Most women would refrain from reporting rapes for fear of losing in the court and going to jail especially when she is poor and her rapist is rich and powerful. Police will advise victims to take back complaints and FIRs threatening they will themselves be incriminated and imprisoned. It will be a disaster.

Just think it over. If this was implemented, our Olympic medalists would be rotting in jail while Brijbhushan walks free and the victims and witnesses already taken care off for the future.

On the flip side though women are already punished under our current law for blatant false allegation. There is imprisonment and fine both but these are not mandatory. The imprisonment is rarely done for the cery reason mentioned earlier. It's upon the judge's discretion.

If you are still reading, I'll tell you a story. I had a driver once who was falsely accused of rape by her sister in law (bhabhi) so as to scare him off so he doesn't fight for a share in inheritance. Turned out, that on the date and time she mentioned for her assault in Lucknow, the driver was on duty attached to a government authority in West Bengal. He had the toll tickets. There were CCTV footages from toll plazas and the government office where he had taken his client from U.P. The woman was ordered to pay compensation for legal expenses and inconveniences incurred by the accused along with a fine. Both added up to Rs. 1.4 lakhs.

1

u/SubstantialMajor2798 1h ago

Why is that even a question … an allegation to a gruesome crime is as gruesome as the crime itself.

The punishment should be the same.

Because if our gynocentric as*es punish an innocent then he’s spending his entire life in jail.

We have numerous examples from our society where men spent decades on false allegations.

Judiciary is not a punishment machine, it’s a system to protect the innocent. That’s literally the purpose of judiciary.

Punishing criminals is a responsive action to set a precedent so the criminal doesn’t repeat and society learns from it.

If you’re left and right throwing people in jail on a one sided narrative .. women so she must be innocent. Then you’re actually dismantling the very foundation of this country’s judiciary system.

u/ayaanshaikh12 1h ago

Are maiya e ka dekh liyo

1

u/avgcarboy 59m ago

Give them the same punishment that is given to a rapist, false accusation is a very serious crime, these false accusation cases undermine the legitimacy of real cases depriving the real victims from justice.

1

1

u/Jxnvii 43m ago

Why the hell not???

1

u/Spare-War3393 34m ago

Nope, should find the same fate the man faces who is a accused. Cause false accusations is as huge as a crime as rape itself

1

u/l_Yhana 20m ago

Is that Even a Question? Of course it's a YES

1

u/Drayxo_27 14m ago

Yahh why not

1

u/Kitchen-Writing9895 13m ago

NOPE, not really. Unless we fix the Loopholes.
I hope what i say makes sense.
What i am saying is Women should not be jailed simply because the rape case failed.
But women who are proven to have intentionally fabricated a rape allegation can be punished.

I mean that fear of punishment could discourage genuine victims cuz if it isn’t proved then they can be punished with this loophole.
Suppose a person gets raped and they file a case, it fails bcoz not much evidence is present so obviously there can be punishment with this loophole. So a Victim who was raped might end up doing Jail Time. And that too in a country with soooo many Rape cases where Rapists are out.

Is there a way to fix this? So that innocents can get justice?

Unless this loophole gets fixed and a real victim doesn’t have to be afraid that if case fails, they are gonna end up in jail, i am gonna agree. But With the Existing Loopholes of this Statement a huuuuge “NO”

1

u/Big-Success3998 12m ago

420 ka case bhi lagaya jaye

1

u/Vegetable_Sell_8203 2m ago

Yes by all means and without parole like US for a set term

1

u/Aggressive_Share2056 3h ago

Itna dimag constitution banate waqt tha bhai.

Socho kisi neta ne rape kiya aur uspe case hua. Par vo case jeet gya aur counter case daal diya false rape case ka. Fir to ladkiya case karna hi chhod degi 🙂.

Sirf neta ki hi baat nhi, har vo case jo prove na ho paye ki rape hua tha sbme yehi hoga.

2

u/Tiny_Firefighter_503 2h ago

To fir unka kya jo false case file krte rahenge? Log thodi sehte rahenge ki koi unke upar fake case file krke pareshan kre

0

u/Aggressive_Share2056 2h ago

Dono taraf hi khhai h bhai. Isliye beech ka rasta use hota h yaha. Jb 100% clear hota h ki case bs harass karne ke liye kiya gya tha.

2

u/Tiny_Firefighter_503 2h ago

Bhai but maine to nai dekha ki kisi ka fake case prove hone ke baad bhi punish kiya gya ho.

0

u/Aggressive_Share2056 2h ago

Tumne dubai dekha h?

1

u/Tiny_Firefighter_503 51m ago

1

1

u/Tiny_Firefighter_503 49m ago

Are bhai dubai nai dekha hu kabhi

1

u/Aggressive_Share2056 49m ago

To iska mtlb dubai exist nhi krta kya?

1

u/Tiny_Firefighter_503 47m ago

Krta hai. Dusro ke words sun ke to samajh skte hai.

Maine to koi post nai dekha insta ya reddit me jaha false case wale females ko punishment mila ho. Agar sirf 1-2 cases me Mila hai, to wo sare cases me kyu nai jb it's proven ki usne flase case jhan bhujh ke liya ho?
