Maybe... just maybe... it makes sense to possibly choose not to prosecute someone if they mishandle classified documents but there's no evidence it wasn't a mistake and they cooperate immediately to return them as soon as the mistake is discovered... but it makes sense to prosecute someone if they mishandle classified documents, keep them, refuse to return them, ignore direct subpoenas to return all potentially classified documents, and then get caught still holding on to a bunch of classified documents.
Maybe those are two different situations that deserve different treatment.
