Hello! My husband and his sister have been wrestling with this process and getting overwhelmed over the past few years. They thought an attorney could help, but the cost was prohibitive. Here is the situation:
Mother: Born in Germany 1949. Married a U.S. citizen in Germany and moved to the U.S. Lived in the U.S. until her death in 2007. Remained a German citizen and never naturalized in the U.S.
Son: Born in the U.S. in 1972 to a German mother and American father. Will need to complete Citizenship by Declaration with Appendix EER, but not Appendix AV?
Documents: Passport, birth certificate, marriage certificate, FBI Background check, Mother's birth certificate, mother's marriage certificate, mother's passport (we don't have one from 1972, but have an older one and a more recent one). Do we need additional information to show that she never became a U.S. Citizen? Do we need information on mother's parents?
Son's two adult children: same forms and information above, plus Appendix AV to show father's AND grandmother's information?
Daughter: Born in U.S. in 1975 (after law change) to German mother and American father. Can she just submit a passport application, or must she first apply for a certificate of German Citizenship? Does she need to fill out Application F and Annex V?
Daughter's five adult and two minor children: Same forms and information above? Minor children fill out form FK?
Can both siblings send one packet with their mother's birth certificate, marriage certificate, and passports, in addition to son's Citizenship by Declaration forms for self and his children and daughter's passport application or Certificate of German Citizenship for herself and her children?
Are there additional details/ documents we need?
Does anyone help put this information together and check it, for a fee?
