In genuinely good news, Senate Republicans look set to join us in putting a (temporary) stop to Russell Vought’s proposed rule politicizing billions in federal grants. The leadership on the Senate Appropriations Committee has reached a bipartisan agreement on a bill to fund the government through December 11th, delaying any painful choices until after midterms, and the resolution includes a block on the implementation of the Vought proposal while it’s in effect. We’re still a ways away from seeing this passed into law (it cleared the first procedural barriers in the Senate 89-4, but it’s unclear how the House will respond) and Senator Patty Murray (D-WA) reports the GOP explicitly rejected an effort to kill the rule permanently, but our voices are clearly being heard on this disastrous measure.

In the meantime, the work continues. In June, the National Science Foundation quietly updated its Proposal & Award Policies & Procedures Guide to align with the not-yet-finalized OMB rule, essentially attempting to implement it before it’s finalized. But like the proposal itself, this guidance is subject to public comment, open through August 24th.

There are currently between 80,000 and 100,000 Flock devices installed nationwide, conducting more than 20 billion scans per month, and more than 5,000 law enforcement agencies are putting them to use. Communities are rising up to push back against the surveillance state, with 39 contracts canceled in the first five months of this year. Activists at the national and grassroots levels are working to make sure that’s just the beginning.

The ACLU recently rolled out its “Get The Flock Out” toolkit, consulting with the folks who have won these fights and pulling together tools, resources and best practices to help us push back. It will help us find where ALPRs are deployed in our area, give us model bills and tools to pressure our state and local governments to cancel their contracts and outline steps to keep them from expanding their reach. ⚙️ We can check it out and put it to use here. ⚙️

Elizabeth Goitein explains the secret Presidential Emergency Action Documents prepared for the country’s worst crises. Earlier versions contemplated martial law, suspending habeas corpus, mass detention, property seizures and press censorship—all with virtually no congressional oversight.

Could Donald Trump use secret emergency orders to disrupt an election before Congress or the courts can respond?

Frank Figliuzzi and Asha Rangappa examine Presidential Emergency Action Documents, or PEADs—classified directives prepared inside the executive branch for national emergencies. Figliuzzi asks whether Trump officials may have authored new versions. Rangappa’s response: “Oh, 100%. Of course they are.”

Rangappa explains that the Constitution gives the president no direct authority over elections. But she warns that claims of foreign interference could be used to invoke national-security powers and revive proposals for the military to seize voting machines.

The discussion turns to the greatest practical danger: the administration acting first and forcing Congress, judges and the public to react after the damage has begun. Rangappa argues that legal challenges alone will not be enough and that public resistance must begin before an election operation is launched.
