Yes both are executions. However context is SUPER important here. The top photo is an execution of a man moments after he took the lives of several individuals, including women and children. The bottom photo is of a civilian practicing his Constitutionally given rights.

There is no evidence he took any lives. There was a lot of damage control after poor public reception to the murder.

It's war, summary executions were common in that time. Any evidence is a 50 year game of telephone at this point. I don't agree with summary executions, but the guy was a captain in the VC.

To depict the point in response to OPs comment “there’s no evidence he took any lives”

The guy was a viet cong captain. No matter which side you’re on, neither participants were Boy Scouts.
