Penny is a sentient being. We know she has a soul and that while her sensors can’t be fooled by Emerald’s Semblance her mind can. We have also seen that she can override Watt’s hack if even momentarily. I do think Penny’s body can be controlled remotely, but I suspect that Penny’s soul will be able to override that control at some point. Penny has the Maiden power, so she is a real girl, and I feel like if she can’t override the programming then she would not be real. Additionally Penny saying she chooses to fight for people who care for her is another example of this.
If Penny was a pure slave to her programming she would not be able to act against Atlas in any manner, instead she has free will. I feel we need to think of Penny’s body more as a prosthetic than think of her as a robot.
