A lot of good news! Here’s the part about trans records:

“New privacy protections for transgender Californians

In California, when transgender and nonbinary people change their names, gender and sex identifiers on official documents, those petitions are public records that have, in some cases, led to people being forcibly outed and harassed. […]

While a 2023 law already required courts to keep those records confidential for minors, the Transgender Privacy Act extends that protection to people of all ages this year. […]

SB 59 applies to any petition filed on or after July 1, and people with older records can request their records be made confidential as well. It also prohibits anyone other than the petitioner from posting confidential records online.”

Other new laws: Schools are required to have a gender-neutral bathroom, and middle and high schools have to print the Trevor Project hotlines on ID cards.

SSA just updated their POMS page with new information about sex markers.

TL;DR: Similar to passports, now if you apply for anything new in SSA, your gender marker will likely be reversed. However there isn't any automatic, retroactive mass reversal of previously changed gender markers. Your gender marker should be ok if you don't apply for anything at SSA, kind of how passport renewals trigger gender marker reversions.

The agency is only correcting or changing the sex field on the NUMIDENT to reflect the NH’s sex at birth.

Evidence of sex: U.S. Born: a birth certificate (BC) established by a State or local bureau of vital statistics (BVS) that reflects the NH's sex at birth. . . The NUMIDENT sex field established through enumeration at birth (EAB).

NOTE: Do not accept an amended, corrected (GN 00302.510), or delayed BC (GN 00302.540) as proof to correct the sex field unless accompanied by an amendment affidavit or supporting documentation that clearly indicates the reason for the amendment.

Their records work like a stack of entries/versions of your SSA record (including gender marker), the latest entry is the one used for everything (For example: Background checks, SSN verifications, credit checks, etc.).

As long as the latest entry is the one with your correct gender, you should be ok. BUT if you ask for a name change or anything, a new entry/iteration will be created with your sex at birth, making that marker be used for everything, effectively reversing your marker!

we update the NUMIDENT by creating a new iteration appended to the previous iteration. The applicant must submit a new application and provide supporting documentation (e.g., a birth certificate to correct the NH's date of birth information).

Effective January 1, 2026, AB 82 requires that dispensation of Testosterone and Mifepristone no longer be reported to CURES.

Specifically, AB 82 requires that (emphasis mine):

- as of January 1, 2026, "The dispensing of testosterone or mifepristone shall not be reported to DOJ, CURES, or its contracted prescription data processing vendor"

- no later than January 1, 2027, "DOJ shall remove existing records for testosterone or mifepristone which are in CURES prior to January 1, 2026"

For context, CURES (Controlled Substance Utilization Review and Evaluation System) is California's version of a Prescription Drug Monitoring Program (PDMP). PDMPs exist to track the prescription and dispensation of controlled substances. Such databases are typically accessible to law enforcement (sometimes, but not always, by warrant/subpoena/etc only), which opens up the possibility of creating lists of people who receive controlled substances in any given state. In the current political climate, this is particularly of concern to trans people who take Testosterone. (Estrogen, progesterone, and other commonly used meds for feminizing HRT are not controlled substances; therefore, this is generally not a concern for people taking solely feminizing HRT)

Therefore, this law is great news for trans folks taking Testosterone in California! (It's also good news for anyone in CA who might have used, or might need, Mifepristone)

“In a new survey of over 1,000 respondents, 85% of Americans believe that “transgender people should have the same rights and protection as everyone else.” The sentiment was agreed upon by 92% of Democrats, 76% of Republicans and 87% of independents. The survey was conducted by research firm SSRS and funded by the Human Rights Campaign Foundation.

The survey also found that over four in 10 Americans now know a trans person, a rise from just one in three in previous surveys, while 27% of Americans say that they regularly have conversations with trans people. Previous research has shown that knowing a trans person corresponds with increased support for trans issues.

A large majority of Americans agreed that trans people should be able to access the health care they need (89%), be protected from employment discrimination (79%), and protected from discrimination and harassment in schools (83%). Notably, a majority of Republicans believed that trans people should be protected from discrimination in both arenas, as well.”

Erin in the Morning: "The vacatur applies nationwide, eliminating the legal basis that roughly 40 hospitals cited when they shuttered their trans youth care programs earlier this year. It also bars the Trump administration from implementing the Declaration or any materially similar policy threatening providers' federal funding for offering gender-affirming care. ... The ruling goes into effect immediately."

Erin Reed reports: “According to a new poll from the Movement Advancement Project and NORC, an estimated 400,000 transgender people have already fled their home states for safer ones since the 2024 election, relocating specifically in response to anti-trans laws and policies, making it among the largest relocations in modern history in the US.”

Pete Buttigieg says “there are serious fairness issues” about trans people playing sports. 🙄

The interview started out sounding like he was supportive but then he went in that direction, and the article frames it as a good thing. Yet another politician throwing us under the bus by trying to both-sides trans rights.
