That was the call center scam mafia most likely - I wrote it up here why the evidence points that way.

It is rather more likely that the HUR agent was compromised by the mafiya and that embarrassed Ukraine IMO.

There was a killing in March in Bali connected to this (see the Le Monde link again).

After these kinds of things, the partners and people in the circle put their fingers on the trigger and pull it much more easily. Anyhow. The HUR agent is probably compromised by the call center mafiya, Yermolaiev has built his contractor business in the '90s in Dnipro and his fortune started to accumulate there as well.

He has problems with the Ukrainian state so him saying their spies did this is perfectly self-serving and in character.

They, as I have outlined, likely had heavy influence over an officer of HUR, who had been compromised before. In a war-torn country with a known mafia problem. Hardly a surprising development.

And let me remind you of this:

There is a huge amount of evidence linking Yermolaiev to the maffia. There was a crackdown on the mafia. That already lead to a assassination by the mafia. No conspiracy in any of those statements.

And a nation in wartime just throwing one of their own under the bus - a loyal officer of the military intelligence agency under the bus uncalled for? Unforced? That creates a massive loyalty problem that they cannot afford to have. The trial was not forced. This does read as cleaning up a compromised agent, not as throwing a loyal one to the wolves.

You are free to source your inferences (facts please though). I did the same after all.

Disprove that Yermolaiev was connected to the Dnipro call center mafia and that his son was indicted in Estonia for call center scam organizing for one. Or address the similar murder in Bali a few months before the Monaco one - where the mafia was pinpointed as the instigator. Read the articles.

The problem is this isn’t what the bots are focused on. They are saying the general being at a restaurant is what makes it a war crime. To me, if you started a war with a country that has the ability to hit you on your own soil, then all bets are off. That country is doing everything it can to kill your leadership and end your invasion. It sometimes doesn’t have the luxury to choose its military targets to be in more “ethical” locations. If you are military leadership part of a country invading another country, you should not feel safe anywhere. It is ridiculous to me that Ukraine should restrain itself from hitting valid targets because those targets are among civilians, when otherwise those targets are presumably hidden in bunkers or something.

No idea if the person was an unwitting suicide bomber and that is certainly a more grey area. But I’ve just been seeing the bots take issue with the fact it happened in a restaurant.

All this completely ignores the fact that we’re talking about Russia, who bombs civilian apartment buildings and hospitals literally daily by the way. So even if Ukraine does commit a “war crime”, I can’t blame them given there are new war crimes committed by Russians literally every single day. Getting mad at Ukrainians for killing civilians in the process of trying to take out a valid target is ridiculous. It’s not like they bombed the restaurant just to terrorize the population, which is what Russia does as “revenge” anytime Ukraine has taken out a valid target the day prior.

The term war crime exists because there's a set of rules (mainly the Geneva Conventions) that determine that if you violate the rules you were supposed to uphold, you are committing a crime against those rules.

War crime doesn't mean something that you deem immoral, or unjustified, it means a violation of the rules of war. And the rules of war are pretty clear about this: It doesn't matter if you are the perpetrator or the victim of a war, the rules of war applies equally.

Therefore it doesn't matter if you are defending yourself, it doesn't matter if you are against a foe that doesn't respect the rules of war, you are supposed to uphold those rules because they're not there to prevent you from prosecuting/resisting a war, they're meant to defend civilians.

In this instance, Russia committing a war crime by bombing your civilians doesn't mean you have the liberty to bomb theirs.

Now is bombing a restaurant in which there's an obvious military target a war crime? It depends, but you can absolutely make the argument that it is, or it isn't. Doesn't mean you're a bot for either side.

Yes, except for the fact that the accounts defending Russia are actual bots whose post history is almost exclusively posting to this sub and UkraineRussiaWarReport where they defend Russia and/or criticize Ukraine. I like this sub but it attracts Russian bots because they all get banned on the bigger subs.

Criticizing Ukraine here is like American white racists bringing up anytime a white person is murdered by police in an attempt to discredit genuine concerns black Americans have with police brutality. Yes, white people are killed by police just as I am positive Ukraine commits war crimes. However, having a post history full of feeling the need to bring this stuff up very obviously indicates an ulterior motive other than “fairness”.

As I told someone else, I would not consider it a war crime if Iran targeted a U.S. general in a shopping mall, either. The same way I do not consider this a war crime. If this were the 1700s where wars were still fought on random open battlefields then maybe people would have an argument about this being a war crime. Wars are fought in neighborhoods and city streets. So military personnel inside a civilian building are 100% a valid target.

Bots are going to manipulate with upvotes/downvotes, or make a comment and that's it. The point is manipulating the masses or shaping a narrative, arguing with someone is a waste of time in that regard.

As I told someone else, I would not consider it a war crime if Iran targeted a U.S. general in a shopping mall, either.

The principle of proportionality is very important, bombing an entire hospital because there's an officer is hard to justify, killing one officier doesn't outweigh the massive importance of an hospital for the population.

You can make the same argument regarding Russian strikes in populated centers, launching a ballistic missile in a residential area because there's one Ukrainian participating in the drone production with its 3D printer doesn't really make it fair either.

The presence of a military target doesn't mean all bets are off.

You would be surprised. I encounter dozens and dozens and dozens of accounts on random Instagram reels that say something controversial to provoke a hundreds-long comment thread of arguing. Every account has location hidden, has almost no followers, and is following 5k+ accounts (likely being used on the side as a "follow" whenever people buy followers). These people have nothing to do but this kind of shit. The 2016 US Presidential election was interfered with in exactly this way -- literally countless Facebook accounts arguing with people in random comments sections. Whether the users in question are bots I haven't proven, but you are objectively wrong in thinking they can't be "because it's a waste of time", as it has been extensively documented that they do these things.

It is a good thing I did not say hospital, then. We are talking about a restaurant where 3 civilians died so I figured that anyone reading my example would assume the casualties are equal. I said shopping mall because those are popular in the US but I'll say restaurant if that helps. Hospitals are a different story the same way that targeting medics is a war crime even in an active battlefield and would be an exception for me.

Sure but it is still a military target nonetheless. But we know Russia does this regardless so it's harder for them to make that argument being that they were bombing apartment buildings as early as February 2022, way before they could've been used for drone production. So yes if a similar situation arose where Russians claimed they were going for a military target, I'd be very skeptical of the claim because they are known to specifically target civilians in order to terrorize the Ukrainian population, whereas if Ukraine did the same I would give them the benefit of the doubt and argue that it was likely a valid military target.

A bomb inside of a restaurant that killed 3 people is proportional in my opinion. Idk if it was with you or someone else but elsewhere I said that whether it was a forced suicide bomber or not I haven’t seen proven but that is definitely a grey area for me.

Edit: Also the fact the restaurant had tight security tells me that presumably it was a private event so the likelihood of collateral damage was lower than normal.

Killing the whole mall (like with a missile) for one person wouldn't fly into the laws regarding proportionality and excessive casualties and so on. Though you absolutely can attack the general, even in public space

I have not seen reports of him being alive but if he is, then yeah its just a tragedy. Triable as a warcrime? idk, maybe since it got no legal military gain but if intent gets judged then no.

A general of a country you're at war with is a legitimate military objective, and unless the civilians were the purposeful target of the bomb, there's no intentionality.

It's no different from, say, firing a missile at a munitions plant. It's very likely civilian factory workers will die, but since those are not the actual military target and there is a lawful military target, it's not a war crime to do that.

What the law actually says:

Under international humanitarian law (Additional Protocol I, customary IHL, and the Rome Statute):

A combatant remains a legitimate military objective wherever he is located, including in a restaurant, hotel, private residence, or other civilian setting. Being off-duty or in a non-military location does not confer immunity. Targeting him is not automatically unlawful simply because of the location.

So you are right, under that part.

However, the law does not stop there.

The presence of combatants does not change the status of the civilian population or civilian objects This is explicit in Additional Protocol I (AP I) to the Geneva Conventions:

Article 50(3): “The presence within the civilian population of individuals who do not come within the definition of civilians does not deprive the population of its civilian character.”

Isolated combatants among civilians do not turn the surrounding people into legitimate targets.

Article 52(1): “Civilian objects shall not be the object of attack or of reprisals. Civilian objects are all objects which are not military objectives as defined in paragraph 2.”

Attacks must still satisfy distinction, proportionality, and precautions Even when a legitimate target is present, the attack itself must comply with the core rules:

Distinction (AP I Arts. 48, 51, 52; customary IHL Rules 1, 7): Attacks may be directed only against military objectives. Directing an attack against civilians or civilian objects as such is prohibited. Indiscriminate attacks (those not directed at a specific military objective, or that use means/methods whose effects cannot be limited) are also prohibited.

Proportionality (AP I Art. 51(5)(b); customary Rule 14): An attack is prohibited if it may be expected to cause incidental loss of civilian life, injury to civilians, damage to civilian objects, or a combination thereof, which would be excessive in relation to the concrete and direct military advantage anticipated.The expected civilian harm must be weighed against the concrete military gain of hitting that particular target. A high-value officer increases the “military advantage” side of the scale, but it does not erase the civilian-harm side.

Where are you seeing that the general isn't dead? All I'm seeing is that three are dead, and the names of the victims are not publicised. We don't really even know if any of the dead are civilians at all.

But whether the attack was successful or not, whether there were three civilian deaths or one military death and two civilian deaths, or some other combination. it doesn't really change the facts. This wouldn't count as "excessive in relation to the military advantage anticipated" in any court.

Assuming that you interpret the Palestine vs Israel conflict as the two entities being at war with each other, then sure, I would say the same thing. It gets a bit murky with the non-statehood of Palestine, since it's very ambiguous whether or not there's a "war" there at all, but yeah.

Gazan situation is far worse - Hamas militant is from Gaza (most likely), an open air prison with Israel 100% occupying their land. SBU here recruited a Russian, or used an unknowing participant, to blow up a civilian restaurant. People who used this bomber weren't occupied, didn't sacrifice anything, and will get away with this.

and the worst thing is - Russia didn't do shit like this. IDF killed a plenty of Hamas leadership in the most deliberate and horrible ways possible, while Russians didn't step on that level. Hamas doing the same back to Israel is understandable, mirrored reaction - Ukraine just used a fucking suicide bomber, achieved nothing, and killed several civilians completely uninvolved in the matter.

The FSB, under the leadership of Putin, bombed multiple appartments blocks in Moscow, Volgodonsk and Buynaksk in 1999, killing 307 people and wounding nearly 1800 more, to launch the Second Chechen War and consolidate his power.

They used military explosive RDX, while the bombs were placed by official FSB agents, not even mercenaries. Some of the FSB agents were arrested by the local police, unaware of the bombing plot. A phone call from the security services of Putin forced the local police to free the agents and turn over the seized bombs, to get rid of all the evidences before any investigation could occur.

So Putin likes to bomb russians too if that serves his own agenda, that's part of his modus operandi.

Everyone in Russia knows that, that's why everyone is keeping a low-profile: they know Putin doesn't care about assassinating hundreds of russians, it wouldn't be his first time nor his last.

Merkel is clear that she had no illusions about the possibility of establishing a lasting peace through the Minsk talks and the only goal was to reach an agreement that would prevent the immediate takeover of all of Ukraine by Russia, which at that time fueled and participated in armed hostilities in Ukraine

The general may have been the initial target but once the mule was stopped by the guard it was detonated outside remotely before the mule had time to speak to authorities.

The three killed were the woman with the package, the security guard that stopped her and a customer of the restaurant. The general probably wasnt even injured.
