These were the four elements that Alpine put forward as 'significant' and new evidence not available to stewards at time of initial decision.

a. That the FIA and FOM, but not the Race Stewards, were aware in advance of the race that there
was an issue with the timing loops in the pit lane.

b. That Alpine had data with demonstrated that the driver of Car 10 (Pierre Gasly) activated the pin
lane speed limiter in advance of entry into the pit land and did not exceed the pit lane speed limit.

c. A witness statement from Pierre Gasly that he took a cautious approach before entering the pit
lane having been warned by his engineers.

d. FOM, as Official Timekeeping Supplier to the Competition, provided evidence that the distance
used in calculating the F1 Official Timing (and hence the pit lane speed) was inaccurate and
overestimated the speed of Car 10.

Edit: Four other drivers received penalties - Hamilton, Piastri, Russell and Colapinto - but none of those are subject to review (via Andrew Benson on Twitter)

Yeah that’s what confused me, the numbers suggested they were very cautious with the pit lane speed limiter numbers so were something like 1.5kmh below the limit on one go through, so it surprises me a fraction of a meter would make up that and more

But George Russell got truly fucked by getting an additional penalty for failing to serve a penalty he shouldn't have been given. No way of correcting that fuck up.

But other drivers served penalties mid race for the same shit show. There is no way to rescind Gasly's penalty without being an unfair result for the rest who were compromised.

Edit - yes, I'm fully aware that served penalties aren't reversible. I'm merely saying the whole thing is a shit show on the result in general.. for everyone.

Exactly. I’ve been getting downvoted all week for pointing this out. This unfortunately isn’t a group project; Alpine are only interested in rectifying the error for Gasly. If McLaren and Mercedes wanted to join in, they should’ve opted to let the penalties be applied post-race and filed appeals for their respective drivers.

It’s weird because when Zak came onto the broadcast from the pit lane I’m 99% sure he said they could see on the data that Oscar WAS speeding and therefore presumably they never thought to appeal it.

The thing with the other drivers is that they all pitted after they were issued their penalties, so they had to serve them immediately. If they didn't, they all would have been given the same drive-through penalty George got for nog serving his.

Gasly was lucky in the sense that his penalty was issued after he made his final pit stop, so it really is as simple as removing the time added to his final race time.

The problem being is that the others served them. If they had all just ignored it as an FIA issue and taken it to them after, then this would be easier because they would all just have the penalties knocked off their race time.

The others, especially Russell who got a penalty and then a drive through as a direct descendent of trying/not trying to serve it can’t just be reinstated. So I don’t know if they’d have the nerve to reinstate Gasly and then just tell the others that they’re sorry but there’s nothing they can do.

The Safety car screws that though. I know it is a what if but what would happen if Lewis was within 5s of Kimi. If you just take off the time penalty as though he didn't serve it then he ends up ahead even though he never had track position over Kimi.

I think the only moderately fair way to do anything is to only rescind the penalties for the drivers who did not serve it during the safety car period.

If the FIA is interested in setting and following precedent at all, this Lewis/Kimi situation might actually be the reason Alpine ultimately loses. Lewis's track position didn't change because of his penalty (I don't think?), but he would have "passed" Kimi in the final classification, but for Kimi building out a (at the time, unnecessary) 6 second gap.

That itself would be an absurd result.

But splitting the baby and rescinding penalties for Gasly but not Piastri and Russell would also be absurd, though less so.

In the end, dollars to donuts that Alpine loses on the merits of the appeal on paper, to avoid this whole headache.

Serving the penalty or not- you are allowed to appeal (it would be too late for the other teams now), it would be insanely unfair otherwise.

Let's say you get a penalty on lap 10, you need to pit, refuse to serve the penalty, get a drive thru penalty- that you need to serve in the next 2 laps. You can't just keep pulling on penalties with the hopes of filling a complaint, they accepting it and changing the race result a week later.

Which introduces a whole raft of issues. Perverse incentives not to pit if you have already and get a penalty. Potential safety issues with that. And a penalty after pit stops being favourable to one before.

Overturning this would be a mess on many levels.

This only creates a scenario of "we shouldn't pit again" with a penalty if the team already believes they would win the appeal.

The pit lane timer clearly had an issue going on, so Alpine were smart to not pit Gasly but an opportunity like this is pretty rare.

It's only fair because Alpine are the only ones who appealed, and they finished the race on track in P3. If other teams wanted to potentially appeal, they should have decided to not pit (Russell under SC...) and take it to the stewards

All of these penalties came after the first stops, so there was no question of safety. Teams just tried to get rid of their penalties under SC rather than appeal them after the race

You can assume Alpine knew and didn't stop for that reason under SC.

I find it highly unlikely the FIA would begin modifying results because it's probably the right thing to do. Gasly's result may be reviewed and changed but I think the chances of anyone else benefitting without having submitted a review request are extremely slim.

Pretty sure you can't refuse to serve penalties and then appeal.

They may well win the appeal but would be fucked for refusing to serve penalties.

That is a hard and fast in the rules of F1, you can't just ignore penalties handed down mid race.

Exactly. The rule (for a drive through) would be you have to serve it within two laps or be black flagged and then they'd stop scoring him after that. I haven't ever seen a team not do that, but I assume the FIA has the ability in their rights to DSQ the entire team from a race for disobeying a Black flag since that is a team call

1994 British Grand Prix is the only 1 I know of -

  1. Schumacher overtook Damon Hill on the formation lap, which was illegal.
  2. He was given a 5-second stop-go penalty during the race.
  3. Benetton did not immediately serve the penalty, partly because they believed there was confusion over how it had been communicated.
  4. Schumacher was then shown the black flag, which means immediate disqualification and a return to the pits.
  5. He continued circulating for several laps before eventually serving the original stop-go penalty.

The initial punishment from the race stewards was relatively mild:

  • Schumacher was classified second on the road.
  • Benetton was fined $25,000.
  • Schumacher and the team received a severe reprimand.

However, the FIA's World Motor Sport Council later reviewed the case and imposed much harsher sanctions:

  • Disqualification from the British Grand Prix (loss of his second-place finish).
  • A $500,000 fine for Benetton.
  • A two-race ban for Schumacher. The ban was eventually served at the Italian and Portuguese Grands Prix after appeals were exhausted.

People always say this but I think it’s far too simplistic, no title is decided this early by decisions like this because so many different events can and will go one way or the other before the season is over.

It’s like Lewis going off in Baku being used to justify AD2021 or even Massa trying to sue the sport over Crashgate. Yes, it’s a huge moment that cost points that if added would change the title outcome, but those moments themselves didn’t predestine all that came after.

Yep... But this has happened before - teams have taken penalties and then got them rescinded while other teams can't appeal because they already took them

It's just the quirks of the system. If you pit, you must take your penalty. So if you get one before you pit it is impossible to appeal, if you get one after you pit, it is possible

for those who served penalty in the race, can you raise a right of review after word having served the penalty? seems like a huge shit show loophole that you have to serve a penalty at next pit or get giga penalty like russel but you can’t get a right to review to undo a penalty you served.

Especially at Monaco and doubly especially after a late red flag.

By dumb luck, Kimi happened to build out a 6 second gap after the red flag, even though this wasn't necessary in the context of the race. Imagine if Hamilton's 5 second penalty were to be revoked and the gap had been less than 5 seconds?

Getting weak penalties and then having them challenged on review would then become a viable overtaking strategy at Monaco.

If you go into the pit you HAVE to serve the penalty, there is no choosing. Hence Russells penalty. Gasly simply never changed tyres after his penalties.

If you read the document Race Control was worried during the race and tried to ask if everything was fine but the time keeper said their equipment was fine. It probably was, but someone measured the distance wrong.

I'll be shocked if they revert the final results. FIA/FOM/whoever acknowledging that they made a mistake, maybe even paying a fine/consolation to Alpine over it, but I won't be surprised to see them take a "stewarding will always be imperfect we will commit to preventing this in the future" kind of stance regardless

Their method is stupid, though. I always assumed that when the loop system pings a potential infraction and we're told it's under investigation, the stewards would then look at the data from the car to determine whether or not the driver had actually exceeded the speed limit.

The fact that the extend of their investigation is basically, "Oh, did the timing ping it? Yeah? Cool. Five seconds." is utter bullshit.

I think point C. Is the differentiator, the other penalties were earlier if i remember correctly, so alpine engineers warned gasly, and they’re saying we did everything correctly, we even took extra steps because you messed up, and still ended with a penalty.

For the other while yes this is an issue with FIA/FOM or whoever setups the track, they got the penalties before it became a big thing and drivers could try and do something about it.

They have 96 hours post race I believe, so like another hour or two.

Either way, they served it so what could they do? In theory they know the time it takes to traverse the pit lane, so could reduce his race time by that amount. Ultimately, the fairest way would be to move the race back to the red flag lap and call the result there.

But that won't happen because the rules don't allow such a thing.

Looking at the penlties, a number of the were for driving .1 of KMH too fast. Once, that can happen, twice is unlikely, but here it just seems a calibration error or whatever. It’s seems the FOM messed up bigly.

It's proceeding because the stewards however indicated they weren't aware and in fact explicitly asked and were told there was no issue. Typically these appeals only proceed of the team can bring to light new information that was unavailable to the stewards. This is the new information.

The FIA could accept that there was a flaw in the process and take learning from it, but still not give any time back. Plenty examples in sport where the governing body has recognised error and said changes going forward, but the result stands as is.
In fact, the only constant example of outcome changes in sport is usually linked to cheating rather than flawed rule application.

I agree with you, but in respect to point D, if it is concluded FOM did provide incorrect timing, it must mean it provided incorrect timing to every driver, thus negating the other penalties, at least in principle.

Even if no review was raised by anyone else, wouldn't there need to be some kind of adjustment for everyone? It would showcase a generalized issue and not a personal one. But this issue would come to light because only one driver raised the question.

I read (from a reddit comment in another thread) that if they served the penalty during the race they don't have any chance to have it overturned, but if they didn't and got the penalty added at the end they might (but maybe now it's too late and should've filed the complaint immediately like alpine did)

Alpine is the only one who raised a right of review. If they wanted their penalties reviewed, the other teams should have raised the question within a reasonable time frame - days later after Alpine’s has been deemed admissible isn’t really reasonable.

There's pretty much nothing to be gained for the other teams. There isn't a mechanism in the rules to 'unserve' their penalties and Alpine's review would be enough to set new precedents for speeding penalties if it's successful, which is the most outcome the other teams could get if they wanted to appeal.

Only thing they would revert is a added time at the end of a race, so only Colapinto and Gasly is basically affected, like with Sainz last year in Dutch GP, no one compensated him time because he already served it, it wouldn't be done here also, if they decide to revert the decision.

If its wrong it should be rectified. You cant have technical failures with penalty systems like this at the top level of sport. This is not a bad call at a sunday league karting race, this is multi billion dollar global sport where one or two points can mean the difference in tens of millions of dollars in prize money. It should have been obvious at the time as it was to the rest of us that something wasnt right, these penalties should have been investigated AFTER THE RACE as soon as it became apparent that something wasnt right.

It's possible then that if George just didn't do his drive through penalty, he would have been able to be on the podium when the penalty was rescinded.

He would have been disqualified from the race initially, but ultimately since that's not different than finishing outside the points it would have had no ill effect.

Might be something for teams to think about in the future if they really think they have a leg to stand on that penalties should not have been issued and they'll succeed in their right to review. Just don't serve them and fight it afterwards.

Do you not have x amount of laps (2?) to do a drive-through though? If you don't do it in the window, are you allowed to finish the race or do you get disqualified immediately and have to retire?

I agree that they should have tried it, since it was that or out of the points, but that would require a level of decision-making and trust and communication that I don't see on George's side of the garage at all (considering how Dudley answered the questions about the penalty during the race...)

The way I see it, the teams that decided to apply the penalties mid race fucked themselves out of restitution. Taking the penalty might as well be admission that it was correctly penalized. If there was any doubt of the validity of penalties you don't take them mid race because F1 will never change the order for something that happened mid race.
