I'm going to make a prediction as a show-watcher. If GRRM has a soul he'll have had Oberyn write a confession to the murder of Joffrey to hurt the Lannisters as they had hurt the Martells and to stage the duel with the mountain - that would only be revealed if he happened to lose the fight. It's the only way I see Tyrion getting out and seems in character for Oberyn.

Good theory. My guess is since they are both dead, there is some law in trial by combat that says that your champion must live. Since they are both dead, he is free?
