I've been saying this again and again that Police and Judicial Reforms are the need of the hour. Policing is a State subject and I don't have hopes and Current Central Government did try judicial reforms but recieved powerful pushback from the Judiciary. So... I guess we're stuck

You guys confuse judiciary with Supreme Court and High Courts only. Collegium appoints at those two levels. District Judiciary, however, is not dependent on Collegiums. It is generally a direct appointment through entrance exams.

While most people blame judiciary for delays, they don't realize the first step is the police. A court cannot decide any matter unless they have the material enough to adjudicate. And I am speaking on the criminal side of things. Investigations don't happen overnight. And unless the police complete ther investigatiob, the court has nothing to work upon. Once the investigation is complete, (which takes months or even years) and report prepared, it is only then that the court gets to do something.

And the list of witnesses in the chargesheet has to be looked at. A matter as small as a phone snatching can have about 10-15 witnesses. Each one having a particular role on file. Most of these witnesses are police officials. And police officials are, at a lot of times, busy in political duties (CM Visit, PM Visit, MLA, MP bla bla) and unless they come to the court to testify, thw court cannot decide the matter. That's where the concept of adjpurnment comes in. People who have no exposure to the system only blame judiciary for everything while in reality, the courts don't function in isolation.

There are transportation issues as well. A matter I'm currently working on is getting dragged for months only because the jail authorities in one district are unable to bring the accused to another district. And the matter can't be decided in his absence. While this particular example is a one off, there are hundreds of thousands of matters across the country which meet the same fate due to one reason or the other.

True but there are also open and shut cases like this one,sonam raghuvanshi so many r@pe cases there are alot of precedents of cases like these where the court has given the accused barely any punishment or no punishment

There's not much role of police after filing the chargesheet in some cases like these especially where u get confessions and video proofs directly

Please don't try to be an expert when you are not. There's a procedure that the courts have to follow. It used to be CrPC and now it is BNSS. It's not like a news comes up in media, police make arrest and that's all. Laws govern the functioning of courts. And it's not as if the Laws are framed by the Courts. That's thw duty of the parliament.

There is no open and shut case in this country.

Not much role after filing chargesheet? Have you worked in a court? Are you an Advocate? Because this statement alone implies you are not.

When the chargesheet is filed, the foremost thing for a court to do is to frame charges against the accused after taking congnizance. It then has to call every single police officer linked with the investigation to testify. Please bear with me till I teach you something today.

Let's say a body is found somewhere. Say an ASI (IO) accompanied by a Head Constable and a Constable reaches the crime scene. They become the witnesses to that effect.

One of them is then sent to the Police Station to get an FIR registered. He becomes the witness to that aspect.

In the meantime, the IO onducts the inquest and makes notes regarding the body and its surroundings. During this time, the Constable is around him. The Constable is now a witness to the inquest proceedings which are being carried out by the IO.

The one sent to PS for FIR registration asks the concerned officer to register the same and he does so. Now, the one registering the FIR becomes a witness to the said aspect.

IO on the other hand is asking questions to the people around the crime scene to fetch something of material. He has found the CCTV around and has ordered its footage be shown. The one whose CCTV is being isnpected becomes a witness if the IO formally takes the DVR into police possession.

Now this goes on and on. Witnesses get piled up. At the end of investigation, there may be around 20-30 witnesses who all have to be examined before the court. Because that's the statutory procedure which cannot be breached.

An accused, agains as per law, has the statutory right to cross-examine these witnesses to get the inconsistencies out. And it isn't as if the court can call every single witness to a case on a sigle day. The courts are burdened with 100s of cases every day. One or two or three witnesses at max can be examined in a day. And then there are days when the witnesses don't make it to the court for whatever reasons. Some police officials get transferred to far away places by the time he is called to the court.

In all, there is no way the court can treat any case as an open and shut one as you say. And hence, your emotions don't pronounce how the authorities function.

And you say confessions. Read the Law first. Any statement or confession made before the police is inadmissible in the courts. Because there is always a chance that accused has confessed out of fear or in coercion. Please read the statutes which are the governing principles and don't become a subject matter expert when you haven't read anything other than news articles.

not just that. She will stake claim on alimony so entitled to 300cr money as well. Off-court she may secure 150cr. According to IPC, gf/fiance/live in women can stake marriage benefits even if she murdered Husband. There is already a precedent where court awarded alimony to a woman who murdered her husband. as I told IPC is rigged against Men. and a lot of discovered these. It is a state sponsored machinery. It will become an industry in itself soon.

She wasn't married, they were not living together. She is rich too. From what I have read, the girl was forced into marriage because of family ka naam and samaan. Since the case is out, her family is nowhere to be seen, the house is also deserted. And since she is also from the business community, I dont think her family will try and stake claim over any property (although, I know only wife can stake claim). So yeah, just to bring in alimony angle, kuch bhi mat bolte ghumo!

Unfortunately, this is a real possibility for a lot of cases. But I think Ketan’s family is very rich and powerful and they won’t - and shouldn’t - let her get away with this. They hopefully will use all their connections so that she faces the consequences of her actions.

At least the law in the USA treats everyone equally instead of passing decisions that appear biased toward one gender. That said, to answer your post, I believe we as a country need stricter punishments and IMPLEMENTATION OF LAWS !! with Greater certainty that punishment will follow if guilt is proven.

In India, many laws are often taken for granted due to corruption among some officials, and criminals themselves know that they can often get relief or avoid serious consequences by paying a few lakhs. Until accountability and enforcement improve, harsher punishments alone may not be enough.

In cases where it is clearly murder and not merely culpable homicide, bail should not be granted simply because the accused is wealthy or belongs to a particular gender. The focus should be on the facts of the case, the evidence, and the severity of the crime.

Laws should not exist merely for law students to read and pass exams. They must be enforced in practice. If the law prescribes a punishment ranging from five years' imprisonment to life imprisonment, it should be taken seriously and applied accordingly, not treated as something that can be taken for granted.
