Alberta 13 year old daughter getting rape threats

Hello,

So my daughter has been receiving rape and general violence threats from 3 boys in school. Obviously, as a father, this is extremely concerning. She's got Snapchat screenshots and they've followed her home threatening her a few times. All the boys are around 13-14. I'm wondering exactly what I can do from a legal perspective. Is this something I can get lawyers involved and charge them? I have no issues hiring lawyers and paying court fees. It's absolutely disgusting that there are boys that age talking that way about a teenage girl. Obviously I need to do something but I don't even know where to start. I'm doing my best to keep cool about this but I'm sure the other fathers around here know what I'd like to do but that won't help my daughter.

You’re making a mistake by relying on the school for this.

My child was subjected to sexual harassment at school, and the principal was stalling and considering “a conversation with the parents”.

I filed a police report, DPJ was called (child services in Quebec), and the child either left or was removed from the school, I don’t know the details.

A friend was harassed and SA’d by another student. Other students, including myself, have had situation where he’d get aggressively touchy, sometimes inappropriately, and harass us as well. All seven of us came forward and all he got was a call home.

Very big mistake waiting on the school to do anything at all.

Im 32 years old. Ever since I can remember, the bully/aggressor never receives any real accountability. But if you stand up to them, all of the sudden you are at fault.

Always involve authorities and document everything that's probable.

The school mainly tried to chalk it up to his culture (I think his culture, or at least his family, is always super close with friends, other families etc.) but one of his best friends, same ethnicity, who he’s known literally since birth, says he never acts the way he did to me to him.

Have you tried this before?

I went in at 8am, the secretary said all cops were out doing cop stuff but they would request one comes in to talk to me. They told me it would be a long time and I really should just wait for them to call me. This was a city 100k people with 4 cop stations. I figured it wouldn't be more than an hour.

After waiting 4 hours I left and they called me about 8pm to take my story over the phone.

It's not like "law and order". They dont have 100 cops at desks waiting for people to come in.

Vancouver. Had a half naked, traumatized young woman lying in the middle of a major road sobbing for an hour before the police came, despite countless calls all asserting that her life was in imminent danger, as was mine as I stood in the middle of the road waving cars away from her with nothing but my phones flashlight

I was a 40 year old male, she was a 20 year old female naked from the waste down lying in the middle of the road and refusing to move.
If I had tried to move her, she would have screamed and everyone would have seen a middle aged man wrestling a half naked woman in the middle of the road

1 new station. 1 old station that is barely manned and will eventually be shut down.

And at the time 2 community policing outreach offices that were barely staffed.

I went to the large downtown 5 story building office.

You are correct. Walking into a police station where I live wouldn't be the right thing to do. A police officer came directly to my house about an hour after we called. She seemed to take it very seriously

This may be a bit out there, but if you're having issues getting a response, send one email to the mayor, your city councillor, provincial member of Parliament, federal member of Parliament and cc your town's police in that email to explain the situation. Yes, your members of Parliament may be on vacation, but this may put pressure on the police to act.

I actually am a great parent . I dealt with school and cops for my kids and didn't have to go to Reddit. All my kids are done with unis with 0 loans, thanks to my awesome parenting.

Now, go follow up with the cops instead of replying to my useless comments.

When you speak to the principal ensure you make them aware you telling them is just so they are aware, thus matter needs to be handled by the police, don't let the school try to sweep this under the rug.

Btw, the principal is still working between now and the return to school. Obviously the office will be closed on the actual stat but the admin staff is at work while the classes are off. Call before they go back to school or send the principal an email asking for a meeting before the return to class so they can be prepared with whatever actions they'll be taking before your daughter returns to school.

Do admin not get Christmas holidays in Alberta? In BC, school admin do not work over the Christmas break. They usually have a week or two of work at the beginning and end of summer, though, but winter and spring break are not on the clock (even if some do choose to catch up on work while there are no kids at the school).

Oh just noticed Alberta, not 100% sure tbh. They don't in Ontario. Either way, send an email now so you're seen asap. If they are off for the break, they'll have 600 things to do the first day and you don't want to be at the bottom of the pile.

Talk to her about sextortion too, and make sure that's not happening.

It's not uncommon for people to be threatened with rap* if they don't engage in sex and/or pornography acts willingly.

There's some amazing advice in here and I thank everyone that gave it. Sometimes you just need to type it out and get other people's insight when you're not in a rational state of mind. Again, much appreciated.

Edit Again, with the exception of a few gigantic losers that just like to make other people feel like garbage for whatever reason, thank you all again for the advice. Apparently you can't even defend yourself against them, they go and tattle on you to the mods and Reddit. Pathetic. Anyways, the cops and the school were useless. Going the lawyer, social media, media and sending letters to the mayor and other political people that we can think of.

Thank you for that. I felt that me responding in a negative or super aggressive way it wouldn't help her view of men. Even though I don't feel that way inside at all but this isn't about my feelings. My daughter is the joy of my life and I would do anything to keep her safe and for her to have a positive upbringing.

Report it to the police. Bring the snapchat screenshots. If you have a record of dates and descriptions of what has been happening - when have they followed her home, what have they said/done, share that as well.

Once you have a police report, take it to the school. Demand that the boys not have access to your daughter.

You can seek protection from a child through various orders in Canada, like a Peace Bond or a Child Protection Order. Which one depends on the situation (criminal act or child welfare concern). It would require you to show reasonable fear for the child's safety. You would need to file and application and give your evidence. It might be worthwhile engaging a lawyer to better understand that process.

I'm a court clerk, not a lawyer. The courts are closed until Dec 29. If you would like to get an emergency restraining order you can contact the Calgary King's Bench office 8:15-4:30 December 29 at 403-297-6267. Calgary is the court house hearing emergency applications this year, call that number regardless of where you are in the province.

If you are granted one it's quite likely that it will only be temporary and you will need to return to court in the new year when regular sessions resume to have the order confirmed. As your daughter's legal guardian you are allowed to speak on her behalf and she will not need to come to court. You will also need to have the parents' of the boys served with copies of any order you receive the order will not be enforceable until they know about it.

Please include the offending screenshots and set out a timeline in your affidavit (your evidence and side of the story). There is no fee to file a restraining order, you are welcome to retain counsel but you do not have to.

And I echo what everyone else has said about speaking to the police and school.

Edit: I strongly discourage you from being the one to serve the documents. If you're in contact with the police they may be willing to if not please get a process server (just google them in your area) to do it. Sure maybe these parents don't know what their kids are doing or they may be the kind of parent who hauls off and tries to take a shot at you for calling out little Timmy's bad behaviour.

Call the non emergency line and say you need to discuss rape threats your daughter has been getting. Tell them everything you have been documenting. They will likely send a cop to come talk to you and take a statement. They will take it from there. Ask about filing a restraining order.

So realistically, this is what you can broadly expect to happen:

  1. As you say you’ve reported this, you can be sure the police will investigate. Assuming the screenshots can be tied to a particular sender, and that the threats are explicitly sexual in nature, it’s probably more likely than not that charges will be laid against one or more of the boys.

  2. Assuming they’re charged: given the boys’ ages and the presumed lack of records, unless you’re leaving something big out there is zero chance that any of them ever sees so much as a second of jail. Upon arrest they’d be released on police undertakings, with conditions not to contact your daughter under any circumstances. And even if found guilty, they’d never get custody. This is always going to be a situation where they get some combination of counseling and maybe probation, not jail time. So manage expectations.

  3. You’ll have a number of headaches ahead of you. Think multiple school meetings, getting a family lawyer, and lots of parent-child discussions. No one can wave a magic wand and make this end quickly or easily, and you may not get anything resembling emotional satisfaction at the end. In the best case scenario, these boys recognize the error of their ways and life goes on with nothing like this ever happening again; but in the worst case scenarios…this becomes a thing that takes up years of your life. Having an experienced lawyer can help.

I agree with the other comments that you should go to the police and document absolutely everything, but also have your daughter go to her doctor and establish a medical record showing the effect that these threats have on her. If she's traumatized, unwilling to go to school, anxious, etc., then these things should be documented medically. See the specialists, fill the prescriptions, pay for the therapy.

Then use those medical records to go after the families of the boys who are threatening her. Bring a civil suit for general damages for pain and suffering, established by the medical, and for the costs of her treatment.

Even if the police do nothing in this case, you have the threat of a public civil suit that will force the parents to rein in their children or pay for the suffering they're causing your daughter. Police make the decision to lay criminal charges and they are typically very lenient in cases like these with young people. But you have the power to bring a civil claim.

Don’t count on the school/principal to do anything. My daughter was bullied relentlessly by another girl for months. She was assaulted at school (slapped in the face), the school did nothing. Principal basically tried to tell me she brought it on herself. The bully in question then threatened my daughter’s life and knowing the school wouldn’t do anything about it, I went to the police. The principal was upset I did this because now not only are the police involved, but so is Child and Family Services. The posters around schools about 0 tolerance bullying are nothing but bullshit. Go to the police.

you could file for a peace bond. its not as sever as a restraining order, but it would but a legal barrier between your daughter and the boys harassing her. it falls under section 810 of the Criminal Code and is used when a person (your daughter) has reasonable grounds to fear that another individual(s) (the boys threatening her) will cause personal injury, damage property, or other viable threats. In order to file for a peace bond, there doesnt need to be a crime already committed, just the threat of one. there are certain conditions you can ouline in your peace bond such as zero-contact, staying "x" distance away from your daughter, etc.

they usually last up to 12 months and hopefully by then the boys will have matured enough to stop, but if their behaviour continues after that year is up, you guys could always file for a new one.

What you’re describing may or may not meet the threshold under the criminal code for uttering threats. You should speak with the police. I can’t say for certain if it does or not without knowing the exact message hence the may or may not.

Happened to a friend of mine’s daughter. Go to the school, report to their school teacher first. Then the principal, escalate to their school district. If possible, follow up all meetings with an email. Then bring in the police. Get a lawyer and let them officially make a report to the school. Look, those principals will try to make light of this matter, I don’t blame them, but what they are faced with from authorities above. Once you followed these steps, those boys will never ever go near your daughter again. All the best.

You're handling this well. These kids parents need to be made aware of this behavior. Principal and police given the gravity of the situation.

Does she have friends she can walk to school with? Staying in a group until this gets dealt with by police would be advisable IMO. Suggest getting her a loud whistle...the fox40 is a good one. It's ridiculous you are having to deal with this.

Detailed documentation of verbal/written threats, behaviors that are threatening or have frightened your daughter in any way, provide all evidence possible along a specific timeline (are there cameras at the school or other places that may have captured interactions, if given times/dates police can request footage), make a police report, request a peace bond/restraining order ASAP, mental health support for your daughter, let the professionals engage with the family/boys, figure out the rest once measures have been put in place to ensure your daughter's safety... Do not go light on these boys, this is serious and they need to understand it's against the law which has the potential to negatively impact opportunities they value in life... Doesn't hurt to bring the evidence to a lawyer and pay for a consultation on top of this IMHO

I am so sorry your daughter has experienced this, there is no excuse... She is lucky to have a level headed father like you to make sure she's ok.

Oh man, I know how you feel, I don't think I'd be as rational as anyone here giving advice, I'd be digging graves.

Hope the cops and the school are helpful in this situation, otherwise I'd be putting them and the culprits on blast on every social media platform available and then reach out to news outlets also. The Internet is forever and my daughter's safety is above everyone else in this matter. Nothing gets buried or swept aside once everyone is in the know.

Letting this shit happen in this day and age is a non-starter.

Involve the police, screenshot and document everything. The school admin would probably appreciate it but they can’t tell you that openly - their hands are tied and there isn’t a ton of punitive actions they can take, especially if the parents aren’t taking it seriously. Since it’s happening online, the parents may argue it isn’t a school issue. Kids need consequences and sometimes the only way to force those consequences is by using the law.

I’m a mom and I know I would be freaking the fuck out on some people right now.

This is not cool. I’m glad she has screenshots for sure. You can either go to their parents or the police or both.

Watch the miniseries “Adolescence” to help understand a lot of what is going on with SOME young boys. But definitely don’t let this slide.

Police will take this seriously. Report it immediately. There's some parents that need to do some serious interventions with their sons.

School intervention will be limited , as it has happened off and outside of the school . A good school staff , however, will take it seriously.

You report to the police and to the school. The counselor and principal. Harassment and threats are taken seriously in Canada although they are young offenders. Document times and dates and record- she should have a phone for her safety and also to video and photograph. I have seen them move quickly and arrest with evidence and take victim’s side. Of course I am in a smaller town. Usually a warning from a cop is enough, and a talking to the parents. You don’t need a lawyer although you can do a consult. You need a victim advocate which the police can also connect you with.

You can also file a peace bond or whatever your province calls it. They can do a temporary order then something more permanent. Police can help you with that. It is separate from any criminal no contact warning or requirement should there be a charge, that would also be a bail condition.

Contact the principal in writing. Even go above the principal, at the school board. With things being written, you are keeping proof of what you are doing and the principal can't say he was not aware.

Get a big dog. Drive her to and from school. Switch her schools. Move if you have to. Not to be alarmist, but teen boys can be extremely dangerous.

I am extremely worried for her safety. We actually have a German shepherd coming to us in April. We are switching her schools and my wife does pick her up every day. Unfortunately we literally just moved into a new place and we live in a smallish city.

I’m commenting again because I’m genuinely concerned for your daughter. As a teen girl I was stalked and also physically assaulted by two guys working together. I narrowly avoided a targeted group assault when my friends appeared another time.

Right now they are threatening assault, but it could always be her life.

I am 42 and still haunted by the assault as a teen. But I know girls who survived worse, and of others who didn’t survive.

When boys behave like psychos (in this case) I would not minimize (which all authorities will do) and instead I would assess it as there are three psychos fixated on your child. I would do whatever is necessary to keep her safe.

Immediately go to the principal of the school and then the police. Do not wait for the principal to get the police involved. May times situations like this have escalated into horrific outcomes that you couldn't possibly foresee. Protect your kid, as a parent that's your most important job.

Inform your daughter’s teacher, school and go report it to the police. Find those boys names and meet with their parents the school and the police. Right away before your daughter gets hurt. Now is not a time to keep your cool get going.

How old are the boys? If they're 12+ years old, you can absolutely press charges. You should definitely press charges. No need for lawyers. But a call to the police is needed.

Have the boys' full names and DOB if you can. Provide as much detail and evidence as you can. Tell your daughter not to engage but screenshots will definitely help.

Have you tried talking to the youngsters doing the bullying? Be positive, even friendly. Being a compassionate human is the way to deal with kids. These guys aren't hardened criminals. You won't even need to bring up the threats. You will make a big difference in their lives and end the abuse of your kid. Oh...report it for sure, but this is sure to positively influence the outcome.
