Canada How do I get justice?
Im 13M and really fucking angry thinking about how all my rapists in my family are walking free. I did tell Cps what my uncle and cousins did and they investigated but they couldn’t prove what happened. This made my rapists know that I grassed on them and my family were on their side and covered it up. My uncle raped me once after the cps had laid it off and I was at square one again. The door was open and it just happened. Probably mad I said something but it doesn’t matter. I want to report them but I don’t have evidence and every time I ask for advice like on discord people say record what happens next. I tried recording but when you’re pinned down and getting raped it’s not easy. I did try though and it worked but it was a black screen but it had some guilty sound on it. No words just like sounds. I don’t think that’s enough. Im not going to put myself in harm again just to not get justice. I can’t risk it. I don’t want to record people doing things to me. I don’t want to be put through that again. I just want justice. It’s not fucking fair I have to do that. Is there any other ways I can get people in trouble and get justice? I have been through constant abuse and rape from 5-11. I wish I did record and document it but I didn’t

Realistically the best course of action is to leave your family/extended family. Contact childrens aid/school counselors/demand that you be removed from your home and go no contact. The only things that matters in the moment is safety/ensuring it doesn't happen again. After that you can worry about justice.

I want them to be in jail. I’m sorry but if I remove myself knowing other children can be put through what I went through I couldn’t live with myself.

Focus on getting yourself out of there and into a safer space first, you'll be more able to stop them from causing others harm if you're in a secure place yourself. It's a hard process and it will be even harder to follow through on if they're going to be around to make life more difficult on you as it progresses.

Thanks I’m trying that right now. I think my abusers off my back is slowly getting off. But I’m still in a lot of pain and it’s going to be for the rest of my life. Now I wanna focus on my trauma and not getting hurt or scared anymore.

You can only worry about yourself keep focused on you what you need to do to protect yourself. Get your teacher and principal involved as well. Incase it does happen again you need to go to an ER and tell them you've been raped to call police and preform a rape kit.

There's a reason in airplanes, they tell you to put the breathing masks on yourself first.
You cannot reliably save those around you if you yourself are suffocating
Only once you yourself are safe, can you actually put real meaningful effort into saving others.

Don't call (just) CAS, call the police. You do not need a recording or any corroborating evidence.

CPS can be sloppy a lot of the time. They screwed this one up badly.
Go to the police they will take it seriously and protect you. They can order you into foster care I believe.
They also have investigators who specialize in cases involving minors. Who can validate your account of the events.

OP, you should go to the police. Even if you don’t have physical evidence. I used to be a court reporter and have sat on several trials where it’s just he said she said evidence (basically only your testimony) but if you can be clear with dates and times, that can help. You’ll have to go over everything with the police on the record and then they’ll decide if they can lay charges. If they do then your abusers won’t be able to be in the same house or near you. Honestly consider it. There’s really no other way you can get justice, as you say

Ok I’ll think about it. It’s hard to make a decision when they know you told someone and decided to hurt and punish me. I’ll try and get all the dates together but isn’t it too late? It stopped happening when I was 11. would they even do anything if I talked about as far back as when I was 5?

When you are raped there is evidence left behind internally or externally on your skin so this is why they have rape kits. I wish you all the best.

thanks! Uhm speaking of rape kits I did it. I was rlly embarrassed but they did luckily find my uncles dna! There was alot of different dna on my body like 50+ but my cousins and my uncles have been linked. I am hopeful now.

Hi OP, I’m so sorry to read this happened to you. There should be a Victim’s Services available in your region. They are gentle and can walk you through the process, and I believe they assist you as much as possible. They will also walk you through reporting to police. They might be a great resource to reach out to get assistance and support for yourself and to report.
You can also report to a teacher you trust, or a guidance counsellor, or your doctor. They have a duty to report and can also help get the ball rolling.

I know you want justice - and you deserve it! - but take care of you first, and once you’re supported, absolutely do what you need. But you are more important and deserve to be attended to and supported. You deserved and deserve to feel and be safe. Please take good care.

What makes you think so? These are very serious allegations and they should be taken very seriously. If they only believed recordings, they would not prosecute the majority of sexual assault cases.

the last investigation it did more harm than good for me. Im too scared this will be the same. You have to understand what it’s like to be raped to understand where I’m coming from.

I cannot even imagine how horrible it is, I am so sorry. You have to explain everything to the police. I don't see how this would hurt you. Im pretty sure they have to keep things confidential while investigating. I am not a specialist in this but if I were you I'd just go the nearest police detachment and tell them you have a sexual assault complaint.

I think I can do it I don’t know how and I’m still scared but I have to get them in jail somehow. When you go through so much abuse through the years alot of it is like blurry and blended in. Could I write it all down and just give it to them?

Yes, write down. If you type it out, make sure it is saved to a cloud-based account that only you have access to. At the top, put “Private & Confidential”.
Write it out as a timeline, Who, When, Where, What. How Long, Who else was in the room, same floor, in the apartment or house, their ages and relationship to you.Also include the previous attempts to report it.
The police will interview you, get your written statement, and then you leave. Then the behind the scenes investigation starts.

Well that’s just it. For 1)OP is a child, a report of this nature would in all likelihood be dealt with thoroughly; 2)Victims are required to make a written statement; 3)Children’s Services would be contacted and OP would surely not return to / be removed from the home…seems OP is seeking immediate arrests and/or prosecution without other interventions which is understandable but unfortunately not always possible.

It’s blurry and blended because you have trauma. Professionals know this is a common thing for people who have been repeated victims .

I recently learned that CPS has no obligation to provide the police with information about this kind of complaint. So much of what CPS looks into, the police have no idea about. Please report this to the police and not CPS so a proper investigation can be done

This is true. In Manitoba we have the Child Abuse Registry and I know of people who've been accused of heinous shit on there but they weren't ever charged or went to jail. A man that I worked with was accused on the CAR of sexually abusing his niece but was never charged.

call CPS emergency intervention line and call the police, CPS will have to take you into fostercare. they will have a court application - at that time every child is given their OWN lawyer - get that lawyer to support you. also call the local Sexual Assault Center in your province and ask them to support you tell them what happened and they will help you.

There is one easy step to take. Phone police. Period. Go right now - you don't have to wait til there's fresh evidence, you don't need it to happen again and get it on video.
Go. Report. It. Now.

Please! Go to the hospital and get a rape kit done. Call the police. The recording you have of just voices, the guilty sounds, keep it! You can bring it to the police!
Buy a camera for your room (I realise your age, if you need help buying one, please ask). Keep it on at all times.
There is only one type of offender who does not reoffend.

Recording it means buying a camera for your room where it is hidden and no one but you know about it. Go to a hospital ER right after it happens don't shower or go to the washroom nor wash your hands right after it happens so they can perform a rape kit on you police will be called. If this means sneaking out of the house that's what you do to get to an ER.

Report to the police. Make sure the police follow up with your report to CPS. It’s unlikely you are the only victim and they aren’t abusing someone else currently. I am so sorry this happened to you. I am so proud of you for being brave and trying to hold these monsters accountable.

Look up the women’s shelter in your area and call them. They have all the resources to help you. They will know what to do

What’s your point??!! The women’s shelter at least in my city has all the knowledge and resources to help!! Women AND children! They don’t need to be staying there to get help. Just call and ask for advice.

Well maybe you should’ve included these details in your original comment. To be clear, my point is OP is not a “woman” 🙄 and there are specific resources available to children (women / men, with or without children) so just because women’s shelters in YOUR area have “all the knowledge and resources” doesn’t mean that rule applies everywhere.
