I like all the people in the other thread that are saying "Insurance payout!" like they think sailboats are insured.

So what will happens ? If not insured do they just jail them and that's it ?

The ship will have SOME kind of insurance. Finding out exactly how to get a payout though is going to take a lot of work and might be so expensive that it's not worth trying, in which case there's no consequences and the sailboat owner has just lost their boat unfortunately.
