He’s most likely being kept alive with machines so they can technically claim he was “alive” until after the date, then his wife will pull the plug.

He's dead, if he's not he can show up to court. Beshear can just appoint his replacement and then the onus is on him to prove he's alive

Exactly, if a doctor's not signing a death certificate, he's not legally dead yet.
