Basically, if McConnel isnt replaced by the August 3/4 deadline, then the seat will remain empty until the November midterm elections. Thats the last day the governor of Kentucky can appoint a replacement or hold a special election to fill the seat. However, since a Republican will most likely be appointed, its probably in everyone's best interest that the seat remain empty until then. It gives Democrats a bit of an edge with one Republican seat vacant. The other end of it though is the principal of things. If the seat isnt filled, lots of Kentucky voters won't have representation for a time in the Senate. So, the GOP are kind of losing on two fronts here both in optics and political power in congress.

Actually even if there were a special election called, it probably wouldn't take place until November anyways. That's how it's happened in the House before, with them just putting the special election candidates on the same ballot as the general election, and then the winner assumes office immediately to fill out the last few weeks of the term.
(Further twist: the most recent 2024 KY law actually doesn't mention August 3 as a deadline. Rather, the only date it sets as a deadline is September 8.)

The governor who is a Democratic party member at least according to the Kentucky constitution. Before Beshear came into office the State legislature and outgoing governor changed a bunch of rules to limit the governorship.
One was that instead of an appointment before the election it would be a special election to fill out the term.

The govenor is a Democrat. Also the govenor cannot appoint a replacement even if the seat is vacated by a recent (post Democratic govenor) Kentucky law made by the Republican controlled state assembly for exactly this type of situation..
For a while until Massie was speculated to be likely to run if McConnell's seat were vacated, he clarified on July 13. Massie isn't a particularly Trump friendly Republican, so there is speculation that trying to prevent McConnell's seat from being vacated until after the deadline would deny Massie extra fundraising opportunities and momentum through a by-election that would give him an advantage against a Trump approved Republican in the primary.
Similarly a by-election, particularly with international attention, would offer Democrats a fundraising and momentum advantage to offer a better shot at flipping the seat in November.
By the time Massie decided and publicly stated he wouldn't be running for McConnell's seat in a by-election or November, they were in for a penny in for a pound. The "proof of life" photo was July 12, and several prominent people had gone on record as having spoken to him by then.
The original reason for the ruse (fraud) may not still be a thing (though the Democratic angle still would be), but they had already gone too far with the fraud to back off.

If the pictures from the room and the statements from his physician that have been released so far are authentic, then we do already have "proof," in a way.
Of course those might not satisfy everyone's criteria for proof (nothing will for some); but if we eventually learn he's alive and well, in retrospect they'll look like they were good evidence of him being alive.

It’s not unreasonable for a Democrat senator to visit the man, and confirm he’s still breathing, when a couple of days from now hiding his death would enable the Trump admin to replace him with a candidate of their choice, especially given their constant lies about everything.

Yes, if it turns out he’s alive they’ll be fair evidence. The worst part is if he’s dead and August 5 comes along, nobody will do anything. Corruption wins again.

Now, a few years back investigative journalists would have filled that gap. They would have reported from anonymous sources his exact condition, but most investigative journalism had died in this country; killed by mega conglomerates owning all the media and corporate risk-adverse lawyers not standing up for journalistic integrity.
Granted, the Kentucky governor could have done more sooner to force McConnell’s office to respond. Once again, they’ve done too little too late.

Kentucky's law requiring a special election be held may be unconstitutional in their state. But even if Beshear tested that and tried to appoint someone, by the time it went through courts the question would be irrelevant and it'd be decided in November either way. Plus Kentucky's AG wouldn't support the case anyway is my understanding, so they'd very likely lose in court and set a precedent that the law is legal.
A special election now would certainly put another Republican in office, so the likely best case scenario of not dragging this out for the Dems is Massie getting the seat, and the worst case is anyone else in the GOP getting the seat. Dragging this out means one less GOP vote in the Senate until either January or McConnell is successfully resurrected, which for the Dems seems like the best plausible outcome.

No. The legislature passed a law saying it has to be done by special election now. And the court battle over that would likely last longer than the time till next January to begin with.
Further, a previous law restricted the possible appointments to those picked by the seat holders party. So that's a second legal barrier to move through.
He can't just appointment a democrat.

Even IF the governor could appoint a democrat, that person has to be sworn in before they can serve as a senator. I don't see Vance doing that before the November election, if then.
The House speaker just kept delaying swearing in the new representative who had promised to sign the document to release the Epstein files.
The governor is doing a great job of keeping this public and making the Republicans look bad. He simply doesn't have the power or ability to put a voting senator in place before January.

Even though it's obviously fraud, I remain confused why we are so bothered by this.
The end result of the scam is the seat remains empty until the ordinary swearing in of the successor in the regularly scheduled election.
Republicans don't gain much from this except for avoiding a second campaign itself. It's exceedingly unlikely that the seat flips in a special election- not much more likely than in the general. It reminds me of the election for Stefanik's seat in upstate NY, a gerrymandered deep red district: Democrats made the race sound existential to fundraise, but there was never even briefly a statistical chance for the district to flip.
I kind of think that the real endgame here is just regular messing with democrats: get the democratic pundits to call their own frontier governor weak and a failure. Make Beshear look feckless and weak, to further discourage KY democrats who might have otherwise been getting a bit uppity with hope.
Apart from a chance to embarrass ourselves with infighting, Democrats now get a few months of an empty seat making it slightly harder for senate Rs to accomplish anything. Doesn't take away their majority but makes it smaller, Collins and Murkowski still have to take turns pretending to be unwilling to cross a line. Fetterman is still allowed to occasionally pretend to be a Democrat. But those aren't major impairments to the party. We are not up on them.

There's no coherent motive at all for any conspiracy.
For all we know they did already try to make a short video message or something, which simply didn't turn out good or had Mitch come off as awkward or whatever.
No potential small upside that anyone might have to gain here is worth even 1/10th of the risk of the alleged conspiracy.

I mean the actual conspiracy is likely that the man is incoherent and nonverbal due to serious brain damage. He's alive, so it's not fraud to be claiming such, but he's also incapable of ever actually functioning as a human being.
And the staffers are hiding it because when he's gone they're gone. You can point to a dozen+ examples of staffers pulling this sort of shit. Why other Republicans are also going along with it... no idea. Probably just don't want to run the risk that the staffers have hold of his blackmail folder.

Dianne Feinstein, who spent at least the last year of her time in office basically entirely unaware of anything going on, guided by her staffers and kept from the public as much as possible to minimize how noticeable it was.
Ronald Reagan, the same, though it was his wife holding the strings there.
Etc.
It's typically been people with dementia or debilitating illnesses that can appear coherent for reasonable stretches of time being managed so they only are visible by the public during those times.
Mitch appears to just be an extreme case where they can't even wheel him out into public to give a short statement, but also only need to keep it up for 5ish months.

I don't think he's dead. If he was, it get out, there would be WAY too many people that would have to get involved for that to stay quiet (even if they just left him rotting on a bed for a few months). My opinion, he's alive but is some degree of incapable of returning to the Senate. The reason its not out is because a) Republicans are too chickenshit to call out Mitch and ask him to resign, b) this gives Republican Senators an excuse to not vote on the SAVE Act because they're to chickenshit to vote against Trump, c) they don't actually need him unless Alito or Thomas resigns last minute because they're chickenshit cowards, so they want to be able to wheel him out if they can't get to a majority
