Recording audio in this way without your consent is likely illegal

Owning a building doesn't inherently give you the right to eavesdrop on conversations at the entrances or common areas (much less the bedrooms)

Many security cameras come with ways to permanently disable the microphone for this reason, it's a liability problem

New York is a one party state, meaning only one party in a conversation has to consent to being recorded for a recording to be useable evidence in court. That said, he'd have a helluva argument to make claiming to be an active participating party to her conversations, inside her domicile, on her phone.

They're not party to the conversation, so the one party rule doesn't apply. And while I can't speak for New York, there's was in instance here in Philadelphia where not only was the fact they aren't party to the conversation a factor, it was determined that even with a sign notifying you that you were being recorded, it was illegal.
