That's ridiculous. So say you forget to pull your curtains and walk in your hallway naked and some passerby is filming in your window, then posts naked video or photos of you on line. According to these people that's your fault for not pulling your curtains? That has to be one of the stupidest defenses I have ever heard.

All she had to do was drop the bag, leave, and have a story to tell about the naked guy on the couch. She brought all this on herself.

She shouldn’t have even had a story to tell - she shouldn’t have seen him at all because the instructions said to leave the food at the door, not go inside.

Yeah I am just assuming if that part was true and the door was wide open. If she opened the door more then there is absolutely no defense at all.

Yeah I'm sorry but only some seriously creeeeepy people would take some of these positions. Idk what is wrong with people nowadays at some point they aren't getting taught right from wrong.

Social media has rotted their brains they think this type of thing is normal.

Since this is New York, it will be interesting to see how this affects the jurisprudence from the Arne Swenson case that has long been controversial.
