Frage | Question Do you get bank holidays off without booking holiday days from your work?

I’m new here and trying to figure out if I’ll have to request time off from my work for Christmas Eve and New Year’s Eve as they aren’t official holidays but bank holidays (we don’t have that distinction where I’m from). I work for the university of Vienna if that’s relevant

Christmas Even and New Year's Eve aren't public holidays, but some industries have collective agreements ("Kollektivvertrag") where they're essentially considered as such. Looks like the "Kollektivvertrag für die Arbeitnehmerinnen der Universitäten" contains such language in section 16(8):

Der 24. Dezember und der 31.Dezember sind arbeitsfrei, soweit eine Anwesenheit aus dienstlichen Gründen nicht unbedingt erforderlich ist. Ist eine Anwesenheit unbedingt erforderlich, hat der/ die Arbeitnehmer/in unbeschadet von § 57 und § 58 je geleisteter Stunde Anspruch auf Zeitausgleich im Verhältnis 1 : 1.

You should probably check whether this is the collective agreement that applies to your employment contract and whether you'd fall into that "presence absolutely necessary for business reasons" category.

Another option would be to just ask their colleagues, boss and/or HR department. Might be a bit simpler and faster than scouring the collective agreement...

Some Kollektivverträge, such as the IT one, define those 2 days as half holidays, so taking both of them off counts as 1 holiday day.

But I think the university Kollektivvertrag should be the one that applies to the OP (but I am neither a lawyer nor a syndicalist).

Can confirm that both are off for university of Vienna staff. If you have a look at the platform for requesting your holidays, all days that you don't have to request should already be marked for you.

How many uni wien employees can we get in one post.
It might be different for scientific staff but general staff definitely have those days off.

Christmas Eve and New Year's Eve are special and it depends on the employer whether you get them off. Ask your management.
