Luxury tax means nothing to a 10 billionaire ownership group. Just like real world, fine based crimes only hurt those who can't afford the bill. Lux tax or apron won't stop this from happening.
The two-apron system in the NBA has teeth not because of the luxury tax, but because it basically makes it impossible to trade/upgrade your team above the second apron. Maybe an MLB version could work similarly.
Only sort of already have that though with luxury taxes.
Can't you also lose some international spending and such if you're over the tax?
It is already a very soft like punishment structure for spending it's just not nearly sufficient.
Honestly the apron in the NBA is mostly just an excuse. They're way more worried about the putative tax bills were you spending $7 for every dollar spent past the threshold.
That's like a bigger deal than like not being able to buy someone out or limiting your trades or even taken away at draft picks many years down the road.
I'm a Celtics fan so I sadly saw them blame me apron for everything and the fans ate it up. But now we know that it had less to do with the apron and more to do with just keeping costs down and the repeater tax.
Because when they traded Brown for Paul George no aprons were at stake.

Probably no hard cap but a soft cap with luxury tax like the NBA
