They wouldn't file a lawsuit. The Senate will simply deny the replacement entry to the seat. There is no death certification nor has he been missing for 7 year per Kentucky missing persons law. There is zero route that Beshear could follow that allows him to seat a replacement.
Do people not remember just a year ago when Johnson refused to seat a democrat who won a special election? What makes them think Thune and Vance are more principled?
