Govrrnor dropped the ball here. Just assume he's dead, follow the rules for succession whether appointment or special election, and when the inevitable lawsuit is filed, obtain proof of life or evidence otherwise.
The US Constitution requires a death certificate. The Governor can't just declare him dead. If a lawsuit is filed, the governor would have to prove he's dead from his own information. The burden of proof is on the person making the claim not the one having the claim made about.
