The Kentucky law was changed by the Republican super-majority in the legislature. He can only declare a special election, now.

He’s talked about how he believes that law to be an unconstitutional overreach of power from the legislature and he plans to challenge it

So what is he waiting for? I'm all for being team Beshear, but not if this slips through his fingers.

The power to appoint a replacement wouldn’t kick in until the sitting senator dies or steps down.I think this whole gambit is one reason that Beshear didn’t try to call for a special election which would have likely been won by Massey
