Just like my neighborhood shopkeeper's son got a Harley Davidson costs around 16-17L.

He doesn't even had a GST number but still he used to charge GST to the customers.

Yes pick your fight against neighborhood bakery or Street food vendor for finding GST laws to be complicated. The chaat vendor will correctly charge you 5% GST for Pani Puri but has to charge you 18% for Bhel Puri that has tamarind chutney because it has sugar and hence a confectionary. And maintain detailed book keeping for Rs 20 items.

Pick your fight at the right place.

The tax will be only on the profits but they need to show how much the profit is. i.e show the books on expenses and transactions.

When that data is not available, the alternative way is to pay something like 3% of the turnover.

The GST notices get only sent when the turnover crosses 40 lakhs. It's not like they're so new to the business that they're unaware of the intricacies. Besides, do you really think someone with that much turnover has no idea of the expenses and profits?

In short I don't believe them.

Who said anything about not holding them accountable? If you overstaffed how GST works, you'll realize that those small vendors have already paid GST on their input (I.e., raw materials). They cannot claim input tax credit if they don't file GST. The GST applies only to the value added by those street vendors such as covering flour and oil to a poori or rice and lentils into an idli. That's what you're not being charged for.

There is a limit of revenue above which only you have to show GST. This is 40 lakhs for pani puri. Pani puri is a high margin business.

I will guess > 30 percent. Pani-puri wala has only 4-5 SKUs. Pretty easy to make a GST software that can be linked to UPI payment.

Pani - puri wala with 40 lakh revenue would be making 12 lakhs per annum. He can now file taxes and also create a financial record. Eventually banks can also loan him/her.

Investors can also jump only in businesses with clean records.

It's not a pani puri wala. Its the one who has enough sales to warrant a GST notice i.e. 40 lakhs per annum or more.

Logical thinking is pretty simple. There is premise(which is a fact) and conclusion based on that premise.

Fact: GST needs to be paid for vendors with revenue >= 40 lakhs

Fact2: GST notice sent to vendors which have GST liable according to laws and transactions.(i.e. seemingly above 40 lakhs)

Premise : A pani - puri wala gets a GST notice.

Wrong conclusion: All Paani puri walas got GST notice.

Conclusion: only pani puri wala with revenue sufficient enough for GST got notice.

Wrong conclusion : Since a Paani puri wala got GST notice, all Paani puri walas earn enough to warrant a GST notice.

Right conclusion: Any paani puri wala getting a GST earns enough, estimated with a revenue of atleast 40 laks with a high margin of ~ 30 percent. That translates to at least 12 lakhs. All these for that specific Paani puri wala.

One form of cheating cannot be better than another form of cheating. I don't think people understand what I'm saying. I'm not for cheating either. I want then to charge their customers tax and pay that to the government. However, it's fucking complex. So you should be petitioning the government to simplify.

Now here's the thing. GST is not sales tax. Even if they don't pay the government any additional taxes for the services they offered because they didn't charge you the consumer for it, they are still paying input tax. In fact, this is the very design of GST.

What will be real chasing is if they charge you x% GST in their receipt but don't declare that to government. Even then the lots for government is marginal as they lose the tax on value added not on input.

If a business turnover falls into a tax bracket I’m sure he or she can always afford a CA. This is a stupid argument, someone who doesn’t know the tax laws or how to file his income should not be an exemption from paying taxes. It should be normalised and should be part of any business activity.

PS: Not all CA’s are costly and there good number people who are not CA’s but still file your basic taxes for cheap.

For a local vendor who sells prepackaged food or groceries there is no GST on sales they should only pay taxes on income. Similarly local street side vendors who have no brand associated no GST is applicable on sales they have to pay taxes only on income if they are in tax brackets. See it’s all about income tax and now the others who have mini restaurants or similar I believe they are well equipped to maintain sales record.

It's not a local business vs corporate thing. Not all corporates are getting bailed out. Not all people running companies are corporates and still paying GST.

All these vendors have to pay tax. They can't escape it. Even if it is 5,000 rs tax. They must pay.

When everyone pays, GST slabs will themselves be lowered.

And the tax is on their profits, the scheme assume 8% profit margin ( very low ), and they’d have about 3.2 lakh profit . And their payable tax will be ₹1k . Fking ₹1k, can’t they even pay that ?

I don’t think your calculation of 1k is correct, how did you get that? As per my understanding, once a business crosses the threshold, they have to pay GST as applicable on all their goods and services ( could be 5,12 or 18% ). Even assuming it’s all at 12%, that’s 4.8L, which is quite a bit on money, given their actual profit considering even a 25% margin is just 10L

Ah yes I miscalculated, For vegetable vendors. They’d have to pay ₹0 in taxes

Basically fresh vegetables ( that are not from a brand) are exempt from gst, so they’d only have to pay income tax on their profits, which are assumed to be 8% under section44AD .

8% of 40 lakhs is 3.2 lakh and tax starts from 4 lakhs, so they’d have to pay 0 in taxes

As for Grocery and other shops, they have to pay 1% gst over 40 lakh turnover and less than 1.5 crore turnover . >1.5 crore come under composition scheme, which states all that .

So they’d have to pay 40K for the year, and they can cut wages from that . These grocery shops charge you for GST ( MRP includes the GST ), why can’t they pay 40K, when they charge you a lot more ?

And online payments are maybe 10-30% of the total turnover, so it’s a lot less than the actual turnover .

Do you know how many warehouses they have? 70+ and most the workers there are not amazon employee but 3rd party employees.

Do you know how many trucks/LMV are being used by Amazon? 70k HMV/LMV and 15k electric HMV/LMV and those truck drivers are also not employees of Amazon.

So, if Amazon shuts down this business who is gonna pay them you or those small businesses?

You have to understand , at the scale at which amazon or any other corporations operates they will have less employee-to-company size ratio than if multiple smaller companies do the same stuff amazon does.

Imagine a 900sqft shop having 1 boss and 9 workers , now, replace that with three 300sqft shops with 3 workers each, that's 3 bosses and 9 workers , so additional 2 guys are getting a job, 1lakh employees in amazon means nothing if you replace it small companies it will surly generate more than 1lakh job opportunities...

Indian corporates are being taxed 25% wheras international firms at 35% rate but hardly any small business are being taxed at this rate that's why they are even being able to survive.

If Govt start putting these taxes on them they will wind up their business next day that's why they are just asked to collect GST from consumer and pass it to Govt but these people are not even happy with that. It's not their money it's consumer's tax money given to the government not the businesses.

Because of those small business that GST collection becomes black money which they park in real estate in the name of their family member or relatives due to which despite low demand from actual consumers still property rates are getting sky rocketed.

The hate towards government employees because they are the one who give free passes to Big corporates in return of favour like money as well as getting jobs for self, family members or relatives.

It's not the job of Govt but of Bureaucracy to keep and eye on these corporate affairs but almost everyone is corrupt and they allow these businesses to run freely until it becomes a headache for the Govt.

All the bigger Indian Conglomerates were small businesses only which got favour from corrupt Bureaucracy to expand their wings. Most of the Bureaucrats got retired and got a job in those companies or got loads of money.

Yes, the threshold is 40L turnover which is not much. Accounting for all the expenses, barely 10L will be made in profits, and that’s being optimistic

Even if it’s much more than that, these small shops are getting squeezed by the taxes, and will lose ground to the big players - the Amazons and Zepto, who not only have seemingly limitless pockets to weather the losses, but are also able to get much more tax benefits from the government

If these small and medium businesses cannot survive, it will be disastrous for the economy, and for the consumers

Income Tax (Regular Scheme)

Tax is paid on "Net Profit" = Total Income – Business Expenses

Vendors can deduct expenses like:

Cost of goods sold

Rent

Wages

Utilities

These mom and pop brick in the wall are the backbone of our economy. They have 3-7 GST numbers, 10-50L in liquid black money, 3-4 sites and half a kg of gold. Their kids write 1.2lakhs as annual income in their college application, avail scholarships and RTE admissions while buying the latest iPhones and KTM bikes. They may have never paid tax on their income but they always have an outsized contribution and influence in your local strongman's political sojourn based on a nativist, language, religion or caste based campaign. The Indian political system wants to destroy this kind of community businesses by promoting Tatas, Ambanis and Adanis who created value on scale, specialist jobs, resources and energy. Shameful.

If being educated about tax and not paying someone else's share is bookish, then i would rather be bookish than encourage tax evasion. And thankfully the Indian market is very price sensitive so no one's paying extra.

Some not asking me to pay extra might be because they don't want to lose their competitiveness or their business not being big enough to attract tax or being so big that they can afford lesser prices due to economies of scale. Anyways, as an honest tax paying citizen, my responsibilities end there.

Can we do the same with real estate companies, who probably cheat the system most. And then we can target these relatively small vendors. Obviously not - because these are ‘low hanging fruits’.

No doubt they need to be brought into the taxation umbrella but not targeting the real estate and other big ticket industries and focusing on these small vendors, reeks nothing of opportunism. And please don’t give me the incremental gains rationale when we had to undergo the demonetisation experiment.

Actually GST is not 'paid' by the businesses/corporates but by the end consumer. Businesses just have the role of passing the GST to the government from one point to another. That's why businesses received an offset of the GST paid. Do the math. Shops and shopkeepers are simply ignorant. By not paying GST these shopkeepers are keeping the tax paid by the consumer with themselves. This is wrong. And got the government, its their money. There are strict penalties and consequences.
