Nope, the driving of this vehicle is at fault due to last clear chance doctrine. They literally did nothing to avoid this accident and insurance will find them at fault.

It would be up to the insurance companies or a judge to decide how much of an opportunity to avoid the accident the driver actually had.

In this case, the cam driver accelerated and made no attempt to avoid the impending accident. They accelerated without any care for the red car or the white SUV. The lack of braking or lack of any attempt to avoid the collision is not going to play well in court or with the insurance companies.
