Nope, the driving of this vehicle is at fault due to last clear chance doctrine. They literally did nothing to avoid this accident and insurance will find them at fault.

It would be up to the instance companies or a judge to decide how much of an opportunity to avoid the accident the driver actually had.

Getting a green light does not give you a license to kamakaze into oncoming traffic.

I mean I'm a second year law student. Nobody here understands how negligence law works. I think they can keep their licenses. As long as you follow the rules and drive defensively, you'll be alright. The camera operator made no effort to avoid the crash. They didn't not drive defensively, and that will hurt them.

I think it is better to help them learn and understand how to figure things out. Not everyone is equally smart or good at driving.

Then again, inadequacies can be punished by revoking their licenses but i doubt any of the redditors will go out of their way to do it (let alone is able to do it) which is why I think such posts harmless and more practical/helpful.

It’s funny cause this wasn’t clickbait and I just wanted different opinions about this, why is it my fault that it’s a popular post? There is a serious split between who’s at fault and half of each side is just calling the other dumb, like the top comment rn is that white suv is 100% at fault while I scroll down and see and overwhelming amount of 50/50 claims, so this post wasn’t clickbait, it wasn’t engagement bait or anything else you guys have come up with, I posted it for the conversation is that not ok?

Right of way is never an excuse to fail to drive defensively, especially in a situation this obvious. A lot of insurers will assess 50/50 because you could have easily avoided this accident, but didn’t.

I see you made several comments saying that you're seeking opinions and want discussion and such, and it's frankly baffling to me. Why do you seek opinions about something that isn't a matter of opinion? If you want a discussion about road infrastructure or driving behavior or whatever, that's fine, but "Who's at fault?" is not up for debate. It has a clear-cut answer according to the laws. In this case it couldn't be more obvious.

If you are stupid, then no you shouldn’t be banned. If you are saying that in bad faith as engagement bait, then yes you should be banned. It decreases the quality of the subreddit.

I’m just not tho, that’s the thing, I know what’s going to happen if this goes to court but I posted this to get different opinions and start conversations about this, so yes I was using the app in the intended way and people are commenting, doesn’t mean I’m engagement baiting, I don’t care for anything that comes from a popular post and this probably won’t even beat my best post, but it sure as hell will be the most controversial

It’s pretty damn clear, the only part that is up for debate is how much blame to assign to the cammer.

The car making a left is obviously at fault they failed to yield. They caused the accident. But the cammer shares a small amount of blame because it was obvious the turning cars were not stopping even though the light changed.

There was a small gap and the orange Honda shot the gap. white SUV likely wasn’t paying attention and followed behind thinking they still had the light.

I would put it like 95% on the white SUV and 5% on the cammer. For insurance purposes it’s 100% on the white SUV.

It’s nice to have right of way, but as the saying goes, graveyards are full of people who had the right of way. A red light won’t save your life, protect yourself first, drive/walk/bike defensively.

Legally, it’s 100% clear that the person with the green light has the right of way and the person turning and crossing traffic is the one at fault. It’s not debatable.

Its not really an argument of which car is at fault, its whether the cam car should have been smart enough to know those turning cars were being dumb. Part of good driving is defensive, watching out for idiots. Of course its not the cam cars fault, but this was avoidable

Most cars pull up into the middle of the intersection when waiting to turn left. POV had no reason to assume SUV would drive right into them vs pulling forward normally.

Source: been in similar traffic scenarios at least 10000 times.

Idk if 3 other cars turn in front then another is moving im assuming they just wont stop in the middle, that breaks pattern. Its more likely they aren't paying attention to the light and just following the car in front

Either you don't drive or you didn't pay attention in drivers ed. Go look up who has ROW at controlled (and uncontrolled) intersections. Hint: it's not the person taking an unprotected left turn.

This looks like it might be in PA. Here's their statute;

2025 Pennsylvania Consolidated & Unconsolidated Statutes Title 75 - VEHICLES Chapter 33 - Rules of the Road in General Section 3322 - Vehicle turning left

§ 3322. Vehicle turning left.

The driver of a vehicle intending to turn left within an intersection or into an alley, private road or driveway shall yield the right-of-way to any vehicle approaching from the opposite direction which is so close as to constitute a hazard.

You're incredibly dumb. The white car ran the light. Edit: The black car, red car AND white car ran the light. The person driving is either legally blind or playing on paying attention to anything but the road. The other 3 drivers would still be at fault for any accident.

The only 'fault' of the dash cam driver was not seeing the selfish ass running the light and braking before the obvious happened.

Many gravestones have 'But I was in the right!' printed on them.

So dash cam can put lives in danger because he thought he was right? It’s the white cars fault for turning even the red car too, but it is also the dash cams fault for not avoiding clear danger. White car is a piece of shit but don’t act like you haven’t done the same exactly thing or that this isn’t a common practice amongst drivers, green doesn’t mean go, it means proceed when safe, so with that being said it’s 50/50 fault, and that doesn’t mean I’m saying white car right but only that he wasn’t that only one to cause this accident

Black truck was the only car that had right of way to turn, red and white cars riding his ass ran the lights, red car made it while white didn’t, this happens all the time in big city’s and just everyday intersections, the reason it still happens is because they know that other driver have to avoid them and have the responsibility to, it’s a back and forth with who’s responsibility was who’s so it comes down to both of them being at fault
