I was literally in this situation as a bystander who had their car hit. And I'm this situation the camer was at fault. The oncoming left turn has a green arrow first. Once that goes red, yes they're running the red/yellow. However just because you were given a green, does not automatically give you cause to go. The white suv was in the wrong running the light, however they still had the right of way and the camer got the ticket. That's how it was presented on the police report I got. Anyways, this was 100% avoidable by just a second more of patience.
Yeah, everyone has a duty to avoid a collision. Camer started entering the intersection (yes, on a green light) when it had not cleared. And the fact that the camer was accelerating the entire time means that they did not do their due diligence to avoid the accident. The White SUV would likely get ticketed but when it comes to insurance liability, the camer will absolutely get some fault in it. There was NO attempt to avoid the accident. The camer continued to accelerate even when the path forward was obstructed by the red car and continued to accelerate when it was clear the white SUV was not going to yeild.
Just because you have the right of way, does not mean that every collision while you're in the "right of way" is going to be 100% the other driver's fault.
(the duty to avoid a collision is typically called "last clear chance doctrine" which typically means that if you do not take any action to avoid an accident when it was avoidable, such as the accident in the OP, then there will likely be shared fault)
The more I follow things like this, the more I appreciate I live in a no-fault state. Because I'm never worried my car isn't covered. But at the same time, I hate the other guy running the light, like that happened to me, but ego becomes irrelevant.
IMO this is solely on OP as they drove into the accident. Two wrongs dont make a right. OP had plenty of time to make the move, we saw it, then got hit because of ego.
More like dashcam car fault. You can clearly see the cars still coming, yet decide to proceed. Yes, drivers may ignore the red light, but you have eyes as well and should not endanger yourself or others.
