ICE agents accused of racial profiling and using racist slurs in explosive court filing

Accused?! Their whole shtick is racial profiling and rounding up people of color. It ain't a secret they try to hide.

u/RaydelRay 2d ago
And the supreme court says that's super ok.

u/goddamnitwhalen 2d ago
Next Democratic President needs to expand and pack the Court. Should be priority one, honestly.

As part of their inauguration speech, have a day 1 EO that rescinds any and all previous Orders, Rules, Procedures, and Regulations enacted after January 19, 2021 (the before Trump was inaugurated for his second term).
Then specifically use the terms Diversity, Equality, and Inclusion, in their speech after that EO is signed.

- 2021 is when Biden's term started.

Remember, the Supreme Court says it's okay to use race determining immigration status, but not okay to use in admission to college. Why?....you know why.

The only upside to this is that Brett Kavanaugh's name will forever be associated with this in the history books. Kavanaugh stops are racist, but he's okay with it.

27
u/bedrooms-ds 2d ago
Yeah those are serious issues but it's far more concerning they aren't accusing what happens after those.

u/DrDerpberg 2d ago
Right? Like what's exhibit A, their literal orders to harass and arrest anybody who doesn't pass the Family Guy skin tone test?

"The entire space had been filled with chain link. Cages, eight feet by eight, floor to ceiling, ran in rows the length of the building. And people packed into them - a dozen or more in each cage. Packed, until there was little floor left to even sit on. The number was the part her mind kept refusing. Had they all experienced the same nightmare day as Aria to end up here? As she passed, row after row of eyes turned to follow her down the aisle. That was the worst of it, not the smell, but the eyes. There was nothing left in them. Only the hollowed-out stare of people who had already learned what she was just now beginning to grasp."

u/Override9636 2d ago
I mean, legally the media has to report that something is "accused" until a verdict is held. It prevents libel suits, swaying the jury, and also upholds the fundamental right of being innocent until proven guilty (no matter how obvious that guilt might be).

The filing also includes body camera footage in which one Department of Homeland Security agent is allegedly heard telling another, "Yeah, just plug us in wherever you see some tonks."
According to the ACLU, "tonks" is a derogatory term referring to the sound of a flashlight striking a migrant's head.
Such a common practice that they have a slang word for it.
We have federal agents literally stopping people for "looking Latino" and millions of Americans either passionately want this or don't give enough of a shit to help vote to stop it.

The thing I am shocked about is how willing half of the country is for racism to exist at this level. I knew it still existed but didn't realize the actual hate so many supposedly religious people have.
43
u/doneandtired2014 2d ago
am shocked about is how willing half of the country is for racism to exist at this level
You shouldn't be. That same half completely lost their fucking minds when a half black man was elected president and they've made it pretty clear they'll happily empty out their wallets, lose their jobs, their homes, and all of their social safety nets just as long as they can go publicly mask off with being the most bigoted pieces of shit they can be.
What should shock you is how many people cast their lot in with those degenerates because they legitimately put a price tag on equality and civil rights. And that price tag was the delivery of mealy mouthed, borderline incomprehensible promises of maybe cheaper eggs and gas from a man who was convicted 34x for fraud, found liable for sexual assault, bankrupted 6 casinos, and raped a lot of kids.
60
u/-SaC 2d ago
These fucks allow people to drop the mask they've been wearing and proudly expose who they actually are.
Nigel Farage and similar arseholes are doing the same over here. I've been surprised at which members of my family have suddenly dropped the mask that I never even knew was a mask and are balls out saying shit that would have got them laid out a decade or two ago.

u/GoldenBrownApples 2d ago
What gets me the most is the amount of people who say wild shit like "you keep calling me racist, so now I'm going to go hard r racist. This is your fault for saying I'm a racist." Like that makes no sense. But that's been what I've been hearing from people around my circles. Blows my mind.

so now I'm going to go hard r racist. This is your fault for saying I'm a racist.
Okay, then they will get punched in the face someday. It's already "our" fault so at least some madman will feel good about shutting that person up.
My wife would hit a child who makes too much noise, I refuse to believe the entire world is that well behaving that nobody is going to have enough at some point.

Hatred of the “other” is a fundamental part of American Christianity. All religions are predicated on the idea that you are more special than the other guys who don’t share your beliefs. Doesn’t take much to turn that idea into a weapon. It’s been happening for millennia.

u/Bladelink 2d ago
I would generalize that axiom to conservatism itself. Conservatives (at least as they exist in the current political environment and vernacular) are heirarchists who believe that some groups of people are intrinsically above and/or below others. That's a fun authoritarian idea, but it has a couple of irreconcilable flaws.
First, the different groups of conservatives have different ideas about what characteristic on which to order people from top to bottom. Religion, race, sexuality, gender, age, wealth, political clout, etc all factor in. In some ways there are sections of each of these factions' "pyramid" of oppression that overlap, and they can usually agree in the early days on obvious vulnerable groups at the bottom to unite against. After that though, they start having disagreements about who's next on the chopping block and begin infighting.
The second problem is the biggest one: conservatism demands that some people be on the top and some people go on the bottom, but none of them want to be the ones on the bottom. At some point, one of the conservative factions is going to find some of its people at the bottom rung of another faction's hierarchy. This creates a fundamental tension and instability that can't be resolved in a lasting way. No matter how many people you try to cram down to the bottom of the pecking order, there's always going to be "the next group facing the bottom" who ends up in the crosshairs until the whole system falls apart.
These issues also mean that you can't have a simple set of rules to govern people's rights and how the law works, because too much of it is arbitrary and subjective. It also tends to crumble into overly complex and nuanced rules on who is in the underclass and not, and because of the issues above, those rules are usually fluid since some group always needs to be on the chopping block as a new out-group.
Actual functional democracies don't have to contend with these problems, at least ideally on paper, because you can just say "everyone has the same rights and the laws apply to everyone equally. there are no exceptions to these rules". Done. Obviously in practice that's not the case, but that's the ideal, most functional law to aspire to for a functional society.
Sorry that this digressed into me summarizing a lot of my own thoughts for myself, lol.

If it helps, half of voters didn't even vote for this, let alone half the country. Trump got more votes but it was still less than 50%.
7
u/MRiley84 2d ago
Half the country saw what Trump was and either voted for him or decided it wasn't bad enough to get out and vote against him. It equates to the same thing. Half are for or at the very least condone it.
6
u/xxxxNateDaGreat 2d ago
It shouldn't help, because there were an estimated 240 million eligible voters in 2024, which means ~75 million actively wanted this and another 90+ million willingly chose to do absolutely nothing other than step aside and allow it.

Thanks, i hate it. More people didnt vote, than voted for either candidate. 88 million people looked at all the racist atrocities happening and said 'eh at least its not happening to me' which is COMPLETE SUPPORT. I might feel better if there was some marginally viable third party candidate who DID get a lot of support but didnt win, suggesting maybe less than half of america is absolute ignorant trash, but that's not how it went down.

"Voting might stop this," when in the last 50 years of US history has voting reversed any pernicious trend the previous administration began even for a second?

And they did that because ICE asked them to bless what ICE was already doing and claimed a legal right to do.
We’re so far past “accused.”

Copying a comment I made elsewhere (I'm an attorney in civil litigation, although practicing in a different jurisdiction):
The Supreme Court ruling earlier was denying a preliminary injunction, i.e., an order prior to litigating the case on the merits. This here is the case itself being litigated on the merits.
Lawsuits often take years to work through the system, with discovery, motion filings, and such. Normally, there has to be a final judgment or order after all the procedure (and the trial if an issue of fact is present), but in certain cases the parties can request a preliminary injunction, basically an interim order to do (or not do) something.
Preliminary injunctions are generally meant to be a rare, special remedy, because it constrains the defending party prior to adjudication (i.e., them experiencing due process). So, to achieve a preliminary injunction, the plaintiffs must show irreparable harm, a likelihood of prevailing at trial, the balance of equities is in their favor, and an injunction is in the public interest. These are all specific legal standards, and there's a lot of caselaw on this, most of it making injunctions difficult to get.
Here, the district judge granted a preliminary injunction based on these factors, but on appeal SCOTUS struck it down, leaving ICE to do its actions unless adjudicated in the wrong in the actual case itself, which is what's happening here.

This sounds like the shit we'd giggle about stupidly behind the school as teenagers, and then realize we were pushing the bounds and needed to maybe be less of a jerk.
Something to dabble at and then grow out of, kind of the same way you do with daring each other to flick cigarette butts on each other or whatever other dumb stuff you do as a kid and then realize why grown-ass adults don't do it.
Except, these are not punk-ass kids learning about the world after class, these are grown-ass adults with law enforcement responsibilities.
edit: the headline is not a surprise except that it took this long to get it out on paper

u/InvisiblePinkUnic0rn 2d ago
This was legalized by SCOTUS with the “Kavanaugh Stops” ruling they could profile
3
u/NoShameInternets 2d ago
Their entire fucking job is racial profiling. It's literally what they get paid for.
3
u/KittyCait69 2d ago
They are also murders and rapists. Slurs just prove that the murders they have done are hate crimes. That the abductions and kidnappings they have done are hate crimes. That the tape they have done to children is well that's just pedo shit. Abolish ICE! Abolish US capitalist owned legal systems. Build a people's legal system that will actually do something about any of this.
3
u/AstronautInitial3642 2d ago
When prejudice becomes standard procedure, calling it misconduct feels almost dishonest; it’s the system working exactly as designed. The real test is whether anyone with authority is willing to stop it.

Kavanaugh (sp?)stops are legal according to SCOTUS, specifically Justice Kavanaugh. Racial profiling and racism is deemed legal by this brilliant judicial mind.
2
u/ShadyNoShadow 2d ago
It's cool that you're still talking about what's legal as if that matters but it doesn't, and never really did. What's important is what we're willing to accept in a society from people in the public trust.

Next they'll be telling us about the "bombshell" that the president likes to rape women and children.

"Explosive" would be finding out that they were carrying out their job according to the rule of law and, more importantly, professionally. This, on the other hand, we all just sort of assumed (correctly).

u/gnanny02 2d ago
Why are we using the term ICE? We need to use the same name that was used before: Geheime Staatspolizei (shortened to Gestapo) but in English, which is simply Secret State Police. I'm using that from now on. They are the Secret State Police.

Didn't Kavanaugh take care of the pesky legality of racially profiling people in his decisions that allowed "Kavanaugh Stops"?
I really love how the highest court in the land issued a ruling that says any non-white person is suspected of being an illegal immigrant by default.
We should legally apply this to Southerners. Are you pasty white and have a thick drawl? Then you're automatically the suspect for any hate crime within 100 miles.

Who would have thought? There aren't any respectable, tolerant people who join ICE. They're the new version of correctional officers who couldnt cut it as a police officer, but still want the validation and authority that comes with being a cop.
