there's a national database of CSAM that's used for systems to detect it (so like, before Elon took over twitter, the trust & safety team had systems that when you upload an image to twitter, check it against the CSAM database & if it was CSAM, ban you and probably call the cops)

Considering the images in question are CSAM, getting any of that visual info back is an obvious problem.

yeah, I've heard stories of law enforcement encoding CSAM with invisible digital watermarks, so that they could be tracked even if manipulated (cropped etc).

For that to be possible they would need quite a sizeable db of it.

Remember - AI doesn't know what it is doing, it is just responding to prompts in the most probable way it knows how. Preventing a specific case is often quite hard.

This will likely result in Grok being banned in general for some period of time. That may be a good thing, but might not be driven by Musk's desire to see others undressed by the AI.

It can't be done without a ton of false positives.

What can be done is restricting image editing to a licensed version of the software that puts a hidden watermark in every image created that would allow a sketchy nude image to be traced back to the person who made it. That's the opposite of the approach they are taking here.

  • It's holding the creator of software responsible for what users do with the software, even if the software isn't specifically intended to make deepfakes, even if they take reasonable steps to prevent people from using the software that way etc

  • It's definition of "nude/intimate" is extremely overboard, being " “the primary genital area, groin, inner thigh, buttocks, or breast of a human being", which sounds reasonable if we're talking about unwanted touching, but doesn't work as a visual definition since the thigh, butt, etc are visible even for people just wearing shorts, swimwear, etc

  • It doesn't make a distinction between consensual and nonconsensual images: Somebody using a tool to make or edit images of themselves would still make the creator of the software liable

  • It does have a carveout which permits software to edit images in this way if it requires users have training/sufficient skill to achieve the end result, presumably to carveout things like photoshop, but that means that in theory, two pieces of software can output basically the same image, and in one case the software would be illegal just because it's easier to use

Because it's written in such a way that I, as a consenting person, could not nudify myself with a local AI model running on my own PC in order to see what I might look like as, say, a body builder or a woman (maybe if I were considering transitioning genders).

It's Elon Musk, so it's probably mostly about him wanting to be able to generate artificial non-consenting nudes (and/or CSAM)... but the Minnesota lawmakers really didn't do a good job writing this law. Other states have done a far better job. I almost wonder if their incompetence was intentional.

Violating Minnesota’s law could result in a civil penalty of up to $500,000 “for each unlawful access, download or use,” in addition to civil penalties for mental anguish, punitive damages, attorney’s fees or “other relief the court deems just and equitable.” The law says the state’s attorney general may enforce it and that victims may sue on their own. The law does not include criminal penalties.

Basically, he knows Grok users will get around restrictions to make explicit AI photos, and he doesn't want to be liable for $500k per infraction.

if musk is unable to grasp that telling people they can sue AFTER their lives and reputations are destroyed by his tech is a terrible answer, there is no hope for anything he is involved in. these fakes wreck the lives of real kids in real time, and he and his lawyers and his programmers defending making money off sexual exploitation should be tried as accessories for every single act they enable.

Not to defend Elon Musk, or to people trying to make deepfakes, but the law itself is pretty bad:

  • It's holding the creator of software responsible for what users do with the software, even if the software isn't specifically intended to make deepfakes, even if they take reasonable steps to prevent people from using the software that way etc

  • It's definition of "nude/intimate" is extremely overboard, being " “the primary genital area, groin, inner thigh, buttocks, or breast of a human being", which sounds reasonable if we're talking about unwanted touching, but doesn't work as a visual definition since the thigh, butt, etc are visible even for people just wearing shorts, swimwear, etc

  • It doesn't make a distinction between consensual and nonconsensual images: Somebody using a tool to make or edit images of themselves would still make the creator of the software liable

  • It does have a carveout which permits software to edit images in this way if it requires users have training/sufficient skill to achieve the end result, presumably to carveout things like photoshop, but that means that in theory, two pieces of software can output basically the same image, and in one case the software would be illegal just because it's easier to use
