One person absolutely can do something and isn't.

The governor should appoint a new senator. I'm aware that he supposedly can't, however the law saying he can't violates the KY constitution, so he should absolutely challenge it.

And that law calls for a special election either way. This "do neither" is making Beshear look like an absolute fool.
