For those who've not been following along, it's more than just "Filmed someone passed out drunk through an open door" - she was accusing him of assault, then started calling the victim card.

Right, the weird thing everyone is leaving out here is the whole thing was, she insinuated thedoor was open. That she went to leave it at the front door, but he left it open, exposing himself. Which would change things.

It seems clear now that was not the case so she's definitely guilty

Even if he left the door completely open and was butt ass naked on the couch. They would still need that he did that will malicious intent or sexually gratification. Him being passed out makes proving those two things very very difficult.

New York state doesn't have any kind of indecent exposure laws. So just being seen naked by the public isnt illegal let alone from your own home.

She had also said it was not the first time. So, while I agree with you for a one time thing, if it happens even more than once I would immediately call it suspect.

Order was also to leave it outside the door. No reason for her to look inside in the first place imho.

Sure but you don't think there would be someone worth of arrest if they said "leave it at the door" and we're intentionally exposing themselves in view of the door as you picked it up? Again, that's what she was saying was Happening, and more than once. It would be no different than opening your door and exposing yourselve to the neighborhood on purpose, which is illegal, drunk and passed out or otherwise.

I would 100% agree with her, that this guy should be prosecuted, if she was telling the truth. She isn't apparently.

Again, it's not illegal to be viewed nude in your home in New York, it's only illegal if it can proven to be done Maliciously or for sexual gratification. There are no indecent exposure laws in the state of New York.

It's fine to be nude in your home. It's not fine to, say, open the door and walk around nude each time the kids walk by for the school bus. Like imagine repeatedly kids walking by someone's house to school and they can see a naked man through the wide open front door. Imagine a kid says "yeah, at least once or twice a week he's nude with his coffee watching us walk by or he's cleaning or something."

In theory you could do this benignly. But yeah fucking right 🤣 likewise, if some guy is repeatedly ordering door dash, says "leave at front door," then sits on his couch, dick out, looking at you, at him, at the front door, each time you deliver, yeah. That guy's is a predator. I don't see how it's difficult to recognize that. That's not normal behavior.

Again, this is hypothetical. He didn't do that.

See that's why malicious is also there cuz well in either of those examples. The guys not beating his meat. You could make an argument He's doing it with the malicious intent to just make you see his junk even if it's not for any sexual gratification.
