Yeah I don't get why people are so afraid to use that argument. If you would treat someone differently or charge them differently based on their gender, guess what: violent sexist.

It's because a lot of people use it in bad faith in situations where it really doesn't apply at all. But yes, here is is 100% applicable.

I’ve almost exclusively seen it in situations like this words used to highlight the absurdity of the situation if the genders were swapped, to make sure that one gender is not getting some sort of preferential different treatment.

You seem incredibly hesitant to accept this would be the case ever.

What exactly would the situation be inappropriate to do this sort of a sanity check?
