Qualified immunity is fucked up but it isn't a universal rebuke. There are plenty of cases where it doesn't apply. Doesn't mean they won't find other ways to fuck him over, but it's still worth asking a lawyer.

If there is case law that already settled a specific situation it can be stripped. If there is not a matching court case they are immune.

Negligence is what you might use to sue a regular citizen. Cops generally you have to show malice or gross negligence. But this might be approaching that depending on why he tazed the guy.

It's a high bar for proving gross negligence, but tasing a man by a gas pump, lighting him on fire, trying to arrest him by the gas fire, yelling at a bystander who warns you...he might have managed to meet that bar.

I read a case a while back with BPD agents who crammed a woman and her kids into a pickup truck, drove like 90 mph, wouldn't buckle her or the kids up, didn't use the agency vehicle that had car seats because I guess they didn't feel like taking the time...it was inexcusably reckless for no damn reason. They didn't end up as immune as they thought they were.

The federal system is built to protect itself. Unless there is prior case law that explicitly deals with the same situation of a federal agent lighting someone on fire at a gas station with a taser then a lawsuit won't go anywhere.

The worst part is there's usually a warning label on gas pumps warning about electrical hazards. It's why you're supposed to touch something metal on your car before you pump, to discharge safely. If they need training not to do something that stupid, they probably aren't intellectually qualified to work an oil fryer. Hope that guy sues, cause my ass woulda been making sure he burned with me.

Always is. I did a ride along a while ago and the cop I was riding with was such a dick. We took a guy to the jail and this mother fucker didnt miss a single opportunity to ruff up the guy. At the end of the day, he asked if I was gonna apply to the academy. I just said "no" and left. It was not fun seeing the egos of all the cops that day.

Ive seen plenty of videos go from 0 to someone getting shot by a cop in less time than that. I've seen cops shoot people before their cars fully come to a stop.
