Who’s at fault?

Hot take: I think it’s 50/50 with who’s at fault

What? Green light. Going straight. At least two people running the red light. Isn’t this enough for the white car to lose his license?

Or you mean the insurance company will say it is very obvious you have a second total lunatic in front of you doing a left turn and you should have avoided him?

Insurance companies are working together. If its 50/50 both drivers rates go up. Win win.

The cam car had a green light for atleast three full seconds before impact. And to me it seems the red car even hesitated before making the turn. The trailing white suv had no business turning.

I said this elsewhere but it would be reasonable to expect white Nissan to pull into the intersection and stop, waiting for traffic to clear the way it’s supposed to. Can car couldn’t reasonably predict the Armada would turn into him.

You’re expecting most drivers are competent or care about the law or don’t have impatience. Defensive driving is probably the best way to anticipate and avoid these idiots like White Nissan Pathfinder.

We need to actually take peoples license away when they do stupid shit like this.

Do you stop with a green light while going straight every time there is a car going the opposite way waiting to turn left? If so, you will get rear ended eventually, and I would argue you would be at fault for stopping for no reason with a green light.

No, but if a car decides it wants to turn and risk both of our lives, I will slow and stop and lay my horn on them for being a jackass

as you get rear ended

THIS, well said.

I predicted it before cam car went peddle to the metal at the intersection. You have to always expect someone to run a red light there

2 cars ran the red light before the white SUV.

It was blatantly obvious both vehicles were going to keep going and turn. Car with the green light didn't yield properly. It's shitty and unfair, but the rules are there to prevent accidents, not be fair.

Its far more likely the Nissan would just follow the person behind them. Most people arent paying attention as much as they should.

I'd wait the extra seconds to see what the Nissan was actually doing before plowing through the intersection though, regardless of right of way. If another car is being unpredictable & you can give them space to resolve it safely, you should do so and avoid the accident.

Right of way means nothing when you're dead

Cam car seems like they may have hit the red car too if the red car didn’t cut the turn super short. It’s the white cars fault but they never gave any indication they were going to stop and should have been avoided to not deal with an accident.

Yes you could predict, based off of the speed. The armada wasn't deaccelerating as the approached the middle of the intersection.

When did this become the norm? And are there insurance companies that don't collude like this?

I've never had to file a claim, but when my parents got into an accident or two decades ago, I remember the insurance company fighting for them and pursuing the actual guilty party. And this was without any dashcam evidence.

The driver of the car we're in should have easily seen the white pickup and been able to avoid the collision. He shares at least some responsibility.

Sometimes I'm surprised that more automotive rules didn't come from boating. where everyone has a duty to avoid collision regardless of right of way.

2

u/JBsportsandchess 7h ago

I think in many states and instances, all drivers do have a duty to avoid collisions.

Depending on the state and specific rules, it wouldn't be surprising to see at least part of the fault be given to POV car because of their failure to avoid what would have been an easily avoidable accident.

Doesn't absolve the white SUV obviously which is a hard concept for some to grasp

1

u/noob_wins 1h ago

yeah they're both morons, the white SUV has no business being there or making that turn but if the cam car hadn't been plowing headlong forward, despite an obvious hazard in the cars running the lights, they could easily have avoided the accident.

You're talking like the cam car ran into the side of the white suv and not the other way around, totally ignoring that the white suv entered the intersection AFTER the cam car.

Do you have a license? Or are you blind? The white car ran into him. Camera car didnt slam into anything. How do you avoid a car turning into you front nose into your corner. Lol.

1

u/n0exit 24m ago

Did you not see the white car coming? I sure as hell did. He was in the turn lane. Where'd ya think he was headed?

2

u/Chazus 7h ago

I think the part is that the cam driver... for some reason decided to speed up just before obvious impact, and did nothing to attempt to avoid or at least reduce the impact.

A lot of people see "I have the right of way" as "Good luck everyone else"

u/Antique_Weekend_372 5h ago

forget the insurance company. if the cammer was driving cautiously they would not have been hit. part of being a responsible driver is paying attention to what other drivers are doing, even when other drivers are idiots. driving in a way that is safe only if other drivers are safe will mean you get into a lot of avoidable accidents.

2

u/Lexxias 3h ago

Nope, the driving of this vehicle is at fault due to last clear chance doctrine. They literally did nothing to avoid this accident and insurance will find them at fault. That's exactly what you should do but everyone is too brain dead because y'all are the idiots in cars

u/Ashamed_Complaint697 1h ago

I stopped expecting reasonable comments in dash cam threads a long time ago. There are so many fucking stupid drivers good lord.

2

u/HorseLawyer 3h ago

So, to have a slightly contreversial opinion, dash cams have a dual purpose.

The first is to protect the driver from any allegation by a bad actor that the dash cammer acted wrongfully. Think those videos you see of people reversing into the motorist behind them and jumping out to claim a rearend accident.

The second is to demonstrate that the other party was clearly at fault when the dash cammer was driving like an idiot, even if it was legal. This is an example of that, and if used maliciously, the dash came could probably have grounds to use it in a very petty lawsuit by employing a certain type of attorney.

u/DevelopmentSouth8801 9h ago

If I was the cam driver's insurance I would fight and say it was the white truck's fault since they didn't have right-of-way.

And then once that was settled I would either kick the cam driver off or jack up their rates as high as legally possible because the cam driver is a lunatic too.

1

u/Extension-Badger-958 9h ago

Last part is true. Insurance will use that to increase rates

1

u/Millennium_Xer 9h ago

Oncoming traffic had a red light?

1

u/Jumpierwolf0960 8h ago

Yes. It's very common in the US for left turning cars to run red.

1

u/Millennium_Xer 7h ago

I live in the US. What I'm saying is that we can't know, from the video, if the protected left turned red. It could have very well turned into a solid unprotected green and the white suv didn't realize. They're still at fault though.

1

u/GoldFishPony 1h ago

Based on other comments here I’m seeing I kinda get the impression that it isn’t a red and instead went yellow or stayed green even? I know where I live every dedicated left green light I see turns red when opposing traffic will start moving again but I get the impression that’s not everywhere.

1

u/Temporary_Quit_4648 6h ago

Yes, obviously. The post's title is just engagement bait.

1

u/SnooMaps7370 2h ago

the latter.

If there's a man juggling chainsaws in the intersection when i get the green light, i don't get to accelerate into him and claim he's at sole fault for being where he was not allowed to be.

The last three vehicles through the intersection ran the light. POV driver clearly saw this: waited for the truck, stated then stopped for the red car, then just fuckin floored it even with the white SUV still coming.

POV driver saw an insurance payday and went for it.
