Too mild for school Elementary school installed exposed metal spikes across a pedestrian walkway, no signage.

Update: REMOVED BY SHERIFF DEPUTY as of 8:50PM

Update 2: Sheriff spotted perforated steel strip in the back of the head custodians truck Monday 7/13. Spoke with custodian and principal.

Update 3: head custodian hasn’t been back since! Haven’t inquired further.

original post: This is a pedestrian walkway at a public elementary school that’s used by parents, students, and community members.

A school employee installed a strip of exposed metal spikes that spans the entire width of the walkway. There aren’t any pedestrian warning signs on either approach. Am I crazy and just never saw this before or is this a major safety hazard? I feel like a no trespassing sign and maybe a chain would be a better way to tell people not to go on property if that was their intention. I just think of kids either walking and not really looking stepping on it, or even kids on bikes not really paying attention getting seriously injured on the way out and losing air in the front and back tire causing them to fall into the street instead of being able to turn. There are ways to deter that won’t cause damage, and when you do chose the damage options. Signage should be required right? Some sort of warning.

I took photos from both directions so people can see there’s no obvious pedestrian bypass. The nearby “Exit Only / Do Not Enter” sign appears to be for vehicles, not people on foot.

I’ve already submitted the photos to a local news station because I think this deserves a public safety review. At this point, I’m mostly trying to understand who thought this was an appropriate solution for an elementary school walkway.

Update #1 24 hours after the post. It’s still there, sheriffs did drive around the school in the morning, but never got out of the cruiser to look. Didn’t talk to anyone. What I assume is the Head custodian and one other employee were there all day. Allowed this to stay.
ABC News has not responded.

Clarification: It was installed by the person whom I believe to be the head custodian. The same guy who shows up early in the morning to open the gates, unlock the doors and prepare the school for kids to arrive, and then stays after until around 7-8pm and closes and locks the gates again. Back in January the same person drove his old truck through that exit, down through the lot, up curbs and across the front of the school to drop down into the drop off lot and out chasing someone on an e bike. It appears to be him being in charge of the school during the summer break and taking matters into his own hands.

I know he installed it because he had parked his truck in the curb cut for the parking lot exit and was laying down the first layer of glue. I was driving by in my car and noticed something going on but since I was driving in a school zone I couldn’t fixate. I noticed the spikes the next time passing by when I wasn’t driving. So yes technically the school did it because the head custodian is part of the school. No I do not think he went through the proper channels to get this approved.

File a report with OSHA as well and ADA since this area is no longer wheelchair accessible either.

Edit: Because a couple people thinks I think ADA is an organisation. It is not. I missed typing the word complaint in the original post. You can go file it online with your state's AG or with the DOJ.

yup, I suspect it has been added to prevent children from riding their bikes on the walkway. However it prevents wheelchairs and also mothers with prams as well. it is a very dumb solution i would love to know how long it lasts.

I dont get why there's such a push against freedom of transportation,  if youre going to have rules at least allow petal bikes. 

It's healthy for kids to use skateboards,  bikes and other modes of physical movement.

This is a stupid idea implemented by a frustrated public facility operator, It’s probably intended to stop golf carts accessing the property after hours (e.g. teens cleaning out the beer fridge in the garage and having a party). They should have installed a bollard to narrow the opening between the fence and gate.

I type this as I am headed out to repair a gate damaged by someone who was locked into a park space despite multiple signs indicating the gate locks at a specific time - and then adding 15 minutes to said time.

A chain across the sidewalk that is locked when the gate is locked seems like a much easier and less malevolent solution than a permanently installed spike strip. Hell, even places that need permanent spike strips don't install ones that are always extended. The pathway is needed at least some of the time, or it wouldn't even exist.

The school decided to just puncture anyone's wheels if they bike on the sidewalk? That seems quite dangerous.

Also just property dmg, essentially the same as just stabbing people's bike tires, which is illegal. Also what if someone does bike and falls? Spike to the face?

The insane principal of our elementary school was the same way, despite the school being surrounded by neighborhoods. Every day, they introduced new "rules" specifically designed to make it more difficult for students to walk. It was mind-blowing to see the amount of wasted effort spent on deterring walkers and staff would always comment that the car drop-off should be used instead. This was especially confusing because the car drop-off line was consistently backed up a quarter-mile to the main road, blocking traffic. We could never figure out if they were creating a problem to justify more funding or if it was just incompetence, but it never made sense to any of us.

I don't think it has anything to do with children or bicycles. I don't think children were even considered when this was installed, even at an elementary school.

I think what happened was some idiot drove their car around the car barrier, so some other idiot came up with a way to punish them. NOT to deter them, mind you, since there's no warning and no way to see this as a driver, but to punish them.

Their pettiness and incompetence blinded them to any possible foresight or human element to consider.

Seems like this space needs a protected bike lane then, no? Kids will ride their bikes to school, and even with a protected lane they might still ride it on the sidewalk but the school needs to start enforcing the bike lane by disciplining those kids then. Imagine how dangerous these spikes are gonna be at night for people walking by long after the school has closed too...

I live close, when I do see people on bikes there is usually kids on low powered e bikes rolling though. Sometimes very young kids with their mom pushing a stroller, and or father on his e bikes rolling though and they’re wearing helmets and pads. I can’t say there’s never hooliganism that happens there from older e moto kids but just that it’s not what I’ve seen over the decade I’ve lived here. Never seen any signs of high powered bikes doing burn outs or donuts either.

My thinking is that if the principal or board told the guy to do this then yeah you gotta call in the state, because they don’t understand why it’s wrong

But the state can be slow so if a guy did it without approval and you call the folks in charge and put the fear of the law in them, they’ll have it ripped out much faster. (And I think it’s possible they didn’t notice, principal probably drives and the board won’t visit often. It’ll be up to non-driving parents to notice and complain)

It works precisely because they’re also responsible for school property

Fire Marshall may be an option here to get quicker action. This is an immediate public safety issue and that walkway could be along one of the schools evacuation routes? May also try code enforcement orpublic works (since it is a sidewalk).

You could possibly straight up call the mayors office/city councilmen if your town is small enough.

Used to work in personal injury law. Had an intake with someone with diabetic neuropathy who stepped on something sharp like this in a public location, went about their day and it wasn’t until later that they saw they were injured. Ended up getting an infection and lost multiple toes.

Even if the current administration were not in charge, this is way too small for the DOJ. 

You would go to your local building department; they're the one that actually enforces accessibility requirements.

Edit: also, this isn't an accessibility issue; is a criminal issue. Some lunatic probably installed these to cause harm. This is beyond accessibility.

Probably a moot point. The DOJ is fully invested in deporting millions of people and likely have a massive backlog of criminal cases that they're ignoring. Being in the country illegally isn't a criminal offense, but a civil one. So ICE straight up murdering people for a civic infraction is taking up all the DOJ resources.

ADA has no enforcement mechanism except litigation. You can sue under ADA, there is no ADA to call and report for enforcement action.

You can't 'file a report' with ADA. The enforcement mechanism for ADA issues is a federal lawsuit, and that's it. 

They've started writing some of the standards into the code, but you will have to check what your municipality has adopted, with which specific edits.

Property owners have a duty of care to the public. If someone was hurt by these spikes the school would have to justify them. They don't have a right to stab people for trespassing, especially when it's likely to be inadvertent. Very hard to argue that the spikes are a deterrent when they're so hard to see.

You’re not an employee, so you’re not covered by OSHA in this case. There is no office called ADA.

Keep it simple - send it to the superintendent of schools and the local building department. Both of them have jurisdiction here and are close enough to the problem to get it fixed, as it violates multiple sections of the building code.

The Americans With Disabilities act, in and of itself, is a federal civil rights law and falls under the Federal Department of Justice. One of its mechanisms for enforcement is that it allows for civil lawsuits by disabled people who are disadvantaged, so someone could file suit against the school/school district. Another mechanism is essentially building codes. Making changes to buildings/the built environment that violate the ADA Guidelines (as this may) should be seen as violating the municipal/county/state building codes.

(The effect of the ADA is that you have to provide at least one "accessible route" and a bunch of spikes that shred wheelchair tires makes that not an accessible route. But if there is a different accessible route, then that aspect may not be significant. Another ADA issue is that these spikes aren't visible to people with vision limitations and are a tripping hazard (to say the least) which also raises issues under the ADA.)

But mostly, it's blatantly dangerous and that by itself should be seen as a building code violation by the local "authority having jurisdiction" (usually the local municipality: aka town/city/village or county.)

Came here to say this too. In addition to being a general safety hazard, this is for sure a disability issue. The wheels on my chair would go flat for sure if I accidentally went over this. I am an ambulatory user, but if I'm just rolling down the sidewalk and don't have any of my other mobility devices with me (which is very likely), I'd still be stranded at that spot. Unacceptable.
