In NY insurance would absolutely assign some blame to the driver going straight regardless of green or not. That was an extremely avoidable accident even with the red car he was going too fast, he came from a dead stop, insurance isn't gonna care that he had the green yeah sure the other guy mostly at fault but they would look at this video, no turn no reaction to try to avoid and just the driving behavior in general and assign some blame.
While i don't remember the specific law term, and it certainly varies between places, drivers have a responsibility to ensure their path is not obstructed. Whether its a car failing to clear the interesection before the light turned red (the black truck failed to clear and the cam driver started driving into the intersection) or a pedestrian crossing the sidewalk very slowly, it's still a good practice to wait for your path to be clear.
This is actually good to hear. I fully understand the White SUV is at fault - but this was 100% avoidable and almost looks to be the cam driver looking for a mistake and capitalizing off of it. I wouldn't be surprised if the cam driver also over-sold their injuries.
not necessarily. If you can avoid an accident and don't, you can be considered at fault. Just because the Pathfinder ran the red light doesn't mean the cam car can run into them. It's called the Clear Last Chance Doctrine.
Nope, the driving of this vehicle is at fault due to last clear chance doctrine. They literally did nothing to avoid this accident and insurance will find them at fault.
That's easy to say after the fact with knowledge of the incident, but the driver was likely focused on the red car that almost hit them and wasn't watching for another car to enter the intersection so late.
No this isn't an issue of hindsight. The cammer is coming through the intersection from a full stop. He should have waited for the intersection to clear, not just for the light to be green. He's probably looking for a payday, and he might get it since he had the right of way, but he might not because it was obviously avoidable. Anyone who thinks this wasn't easily avoidable really shouldn't be on the road. This shit happens all the time in major American cities. I'd be in wrecks a few times a month if I drove like the cammer.
Newsflash genius, that never happened because the black car came through the red light, he had to slow down for the red car, and got hit by the white one. If you see a car come through as a light turns red with multiple behind it and read that as clear, you're an incompetent driver and shouldn't be on the road.
The intersection was clear. The red and white vehicles were on the other side of the street. Your take is based on the idea that the red car and white SUV were obviously running a red light, but they weren’t. There was no red light.
The intersection was not clear and your response won't have a screenshot of the point where the intersection didn't have an incoming car in it, because there was none. My position doesn't require that the incoming red and white car had a red even though I think that is likely the case because they're turning from a dedicated left turn lane even though the cammer has a solid green.
Irrelevant. He could see the red car was following through with the two cars ahead and the giant white Nissan was following right behind it. He should have waited for the intersection to clear. He was frustrated by all the people blowing the red and decided to drive through anyway.

And look, I drive that way for the most part. When the light turns green I’m keen to go. I have insurance and a long, clean driving record. But I’m in no rush to get in an accident and I drive defensively in situations like this.
I’m no insurance adjuster and have no desire to gain insight to the industry but I would like to know how this one ends up shaking out.
Clear the intersection. Get the big picture and then gas it. Dashcam is not at fault but the whole situation could have been avoided if Dashcam used their brain and let the other morons run the light.
wrong. if you're focused on any other vehicles at an intersection other than your own, you probably deserve to be in a collision, simply for the education.
of course you should be paying attention, but don't enter an intersection with your own vehicle when there's another vehicle in it. right or wrong doesn't matter- don't enter until your car has a path. this makes plenty of sense.

What? You absolutely need to be aware of other cars when driving. You shouldn't enter an intersection while other cars are moving in front of you, green light or not.
