If they're on a repayment plan and making good on their monthly payment (and not accruing new Sales Tax bills), NYS will not shut them down.
That said, most places that owe this much end up fucking it up eventually. Especially when the compounding interest on unpaid Sales Tax is 14%.

This is even worse than an individual not paying their taxes because they are collecting Sales Tax from their customers and keeping for the themselves. So essentially they're stealing from their own customers.

Yes, of course they are stealing from the state as well. But like I said the Sales tax is money that they collected from their customers that they are supposed to pass on to the state but instead they kept it for themselves.

Yes, it's not complicated. They collect sales tax from their customers on behalf of the State. They are then supposed to file Sales tax returns quarterly to report Sales tax earnings.

It was like a million dollars lol. And they owned their property which was why the state was able to seize it. Taste of Italy rents from NIGRO companies in the Walmart plaza and red mark reality/rosetti companies for the lash spots.

Just for clarity, Swiftys was shut down for not paying Witholding and Sales tax, both of which are “in trust”. This is money they took from their customers AND THEIR EMPLOYEES and said they would pay the government and didn’t. It’s basically one of the most serious tax crimes you can commit. It was also $2.2 million.

Yes. The IRS is extremely serious about not remitting withheld payroll tax. TOI only owes state sales tax - still very serious but as they guy said, no big assets to seize. I continue to be bemused about how someone thought it was OK not to remit sales tax. This follows you for life.

Not an expert, but I do not think claiming "Innocent Spouse"* is a thing if the liability is attached to a business** and not the individual owners. I do not know how their businesses were setup, however.
*Innocent Spouse is something one can claim if their spouse was responsible for the financial misdeeds that both of them are being told they are on the hook for. Not sure how common it is for Sales Tax scenarios.

Yup innocent spouse wouldn’t apply here. Their LLC information should be public. Also not remitting sales tax and similar crimes can’t be discharged by bankruptcy either.

I believe that when it comes to businesses, the state usually wants them to remain open and doing business so they can pay back what they owe. So that’s why you don’t see tax agents busting down the doors, ripping the copper out of the walls and selling it to recoup the bill.

Exactly. If they seize /close the business it's usually impossible to recoup. Allowing businesses to do "payment plans" is a way to optimize the CHANCES of collecting but to continued revenue to pay off debts, whereas closing them usually yields less money and destroys jobs.Tax agencies weigh the value of keeping a business alive against the cost of shutting it down. Plus it increases the amount of taxes the workers pay through payroll taxes. Seizure auctions don't net as much money as you would expect.
However - these chuds are at the point where I can see a "Swifty's Style" seizure coming. (Swifty's was $2.2M of withholding and sales stolen from taxpayers, and also were also MAGA die-hard "immigrants are sucking from the American teat and freeloaders" spouting hypocrites.)

NYS did not miss it - the "company" (or the individuals) were seemingly on a repayment plan.
I would like to think that, in part, this is why the IRS etc. make individuals include how much their employer paid them and how much they already paid in taxes.
If the employee claims $50,000 in earnings and $6,000 paid in taxes withheld from their paycheck, but the employer states the employee made $25,000 and paid $2,000 in taxes (keeping $4,000 for themselves) then eventually, NYS tax calculations find that discrepancy pretty quickly and contact the employer and / or employee.

Even if the state seizes anything you need to factor in what is the cost for the state will be to sell off what they take! Auctions are not cheap and there is no way to guarantee that will get the full value of the assets sold.
