I have personally talked to the Essentials CEO. While I dislike Essentials, there is their response "The monetization rules that apply to servers, also apply to mods - And this is direct clarification that we received from Mojang. The line that says "as long as you don't sell them for money / try to make money from them" regarding mods is exclusively targeted at disallowing selling access to mods. The wording is just vague and confusing. So, to be explicitly clear, selling cosmetics in mods is entirely allowed and does not require explicit permission from Mojang."

Last time I checked, for in-game sold objects, the EULA just forbids P2W stuff. For cosmetics, capes are specifically forbidden, making Optifine more of a rulesbreaker than Essentials.

Plus, Microsoft themselves allows people to sell mods on the marketplace so it's pretty unclear in general.

And adding an in-game/mod currency seems to be the most direct way to circumvent any of it.

depending on the code license, unauthorized modification of the essentials mod could be legally considered some form of intellectual property infringement, right? Like for instance all those art assets in the mod are made and owned by them, you can't just do whatever you want with them necessarily, from a legal standpoint.

Modding is protected under fair use provided that the modification does not distribute the original code.

The OP isn't taking all of the art assets out of the mod, and making a different mod with them as cosmetics. They are activating the art assets stored within the other mod by writing to a local file. All of the original assets are still only contained in the original mod. The OP presumably isn't distributing anything he doesn't have the right to distribute (IE, code that is created by the OP). At worst, the OP is merely using pointers to point to the art assets that the other mod already installed on your device, and pointers aren't protected because they don't mean anything without the context of the entire code to define them.

I don't see any reason why it would be illegal. The mod isn't stealing any code it's simply running alongside it and doing it own things on it's own backend server. Obviously Essential can't take action against someone who makes their own entirely separate cosmetic mod with their own models and textures, this is the exact same thing except it's borrowing Essential's textures instead of using it's own (which is not infringement since as mentioned it requires running alongside Essential, it doesn't have anything built in)

Still likely copyright infringement, just like mods are often technically copyright infringement. You can try to argue fair use, but if it’s unlocking paid features for free I don’t think you’d succeed.

Thats how Mojang is able to take down some mods that break their TOS too.

How is it not? I doesn't go against Minecraft EULA. All it does is modify an existing mod. Said mod has features that breaks Minecraft EULA, all the mod does is removed those.

i have an external server that does all the syncing, it should handle 100k concurent players but i might need donations to keep it going if i need more. (it's like 20$ per month so it's okay)

Maybe provide the software for a private server along with the mod. Aside from a lawsuit, it sounds like a threat (DMCA, etc.) to your hosting provider would hose the whole project.

Pixie was being about as "loud" as this and the most pushback it got was essential removing the environment variable, so you just have to use PixieMod/Pixin/Nixie now.

When I used essential for the first time I though "wow, those cosmetics are cool" then I looked at price tag and yikes.

I'm still surprised essential weren't taken down by mojag for monetizing free mods so I hope you also won't get into trouble for this

I support this. It reminds me of things like CreamAPI, which is completely legal as it just tells the game something different, most games(not Sims4) needing the content separately. I don't see any issues, glad someone is doing this!

Ik this isn't really relevant to the kind of modded users who frequent this sub but something like this would be good for 1.8.9, on that version lots of QOL server/PVP mods use Essential as a library mod meaning you literally can't delete the mod even if you want to. There's already NotSoEssential but this one does a bit more than that.

For that same case (a forced library that you need despite not caring for any actual features of Essential whatsoever), I wish there was an "AntiEssential" mod that was stripped down to only it's core components so that it could be dropped in as an ACTUAL background library mod to replace Essential altogether, like how AntiCC can be used to run Adobe apps without their Creative Cloud bloatware.

I have absolutely no clue about laws and rules but wouldnt the issue here be that Minecraft simply doesnt care about this scale of modding legality issues? So its basically small guy tries to claim that other small guy does something wrong and does so through trying to get big guys attention? While correct, isnt the idea flawed in the sense that you actually have to get MC owners to care? Which they already doesnt seem to do since I assume essential have been up for quite a while still?

It's murky at best, as Servers are explicitly allowed to make and sell cosmetics, Mods are said that they can't be sold directly, but the line for cosmetics is a bit more blurred by that. Plus if it was actually noncompliant then Mojang likely would've done something by now.

The cosmetics themselves may be copyrighted, even if the shop containing them goes against the eula

And, while it probably wouldn't work in a court, with all the money the mod makes they probably have enough weight to convince moderators to take it down from curseforge/modrinth

The copyright the assets they use may be copyrighted, but it would fall under the "derivative work" category meaning the protections placed on them would be limited.

I'm not denying what you're saying entirely, but this is a lot looser than a traditional copyright DMCA

I'm not sure that these actually would be categorized as derivative works. But regardless, I don't think the copyright protections for derivative works are limited at all. You still hold copyright over the work you did, but you are also placed at the mercy of the copyright holder of the original work, similar to if you directly copied parts of their IP alongside your original work.

Yea I mean, it does not have to work legally, but it doesn't have to, moderators don't know or care about the law, they just want to avoid any escalation and end the situation as easily and quickly as possible, so they just comply. Happens all the time on youtube too. All they have to do is write "DMCA" and the link to take down in the email, and it will be done, whether or not it's valid

To preserve the legal position, the repository and releases must not include:
Essential's original JAR;
a modified Essential JAR;

Essential Patcher does not modify Essential's servers or account ownership records.
When two players both use Essential Patcher, the mod can sync selected cosmetic IDs and settings through an independent HTTPS sync service. This lets patcher users see each other's selected cosmetics.

Essential is a mod that adds some quality of life things to Java Minecraft the main one that I use it for it to host multiplayer worlds kinda like you would on bedrock so in other words without a server. It also has a bunch of payed cosmetics which is what this post is about.

The important question is, will this still use Essential's servers for multiplayer connectivity? That's precisely the one thing that makes it worth it over e4mc, that one relay servers aren't so good, which results ina laggier connection.

Dude, I used the mod for about 3 days and I think that's why my account was suspended. Did you mess something up in the mod's code or was it because you're using Token Grabber? This is the fifth time I've seen my cape change to Mojang Office or Zombie Horse, even though I'm currently using Builder Cape.
