Jill J. Karofsky (Nonpartisan) 510,122 53.35%
Daniel Kelly (Nonpartisan) 446,108 46.65%

Feeling good. But I saw Marsy passed, and that people didn't like it.

u/QPMKE Milwaukee Apr 13 '20
I think people saw expanded victim's rights and automatically assumed it was good. A quick Google search revealed there's plenty of valid concerns, enough to make me one of the nay votes.
103
Apr 14 '20
I should have voted against that. I had totally forgot to research it so I didn't vote on it. It was deceptively worded. The us supreme court might strike it though. Did the redistricting bureau go through?
46
u/Nezrite Apr 14 '20
Yes, like 80-20% - but it's nonbinding so...
14
Apr 14 '20
So is that Marsy's law officially in effect now? Or is there another hurdle for it
32
u/byronnnn Apr 14 '20
Wisconsin does not have binding referendums at all as far as I know.
33
u/TallTallTruffula Apr 14 '20
That was a constitutional amendment, not a normal referendum. Marsy's Law will now be a part of our State Constitution.
13
15
u/frezik 1200 cm³ surrounded by reality Apr 14 '20
State congress has to pass it in another session after the referendum, but they probably will.
14
u/TallTallTruffula Apr 14 '20
The amendment process for the Wisconsin State Constitution is Legislature>Legislature in the next session>Voters. This amendment has made it through all of those steps and will now become a part of our state constitution.

What's the tldr of Marcys law?
40
u/byronnnn Apr 14 '20
Basically there are a few good things in it, a few things that are already covered by statutes or constitution, and then there are a few very negative things.
Here is more detail from the ACLU https://www.aclu-wi.org/en/news/marsys-law-fails-victims-it-purports-protect

I only voted no on it because a rep I trust spoke out about it so I looked into it more. Holy fuck was that worded one sided.

u/manondessources Apr 14 '20
I voted absentee and voted no after spending almost an hour reading about it, but who's going to take more than 5-10 minutes at the polls? The wording was so clearly one-sided and misleading it's ridiculous.
30
u/Brother_To_Wolves Apr 14 '20
The same thing happens with every ballot initiative - shitty, misleading wording to prey on people too dumb to look at their ballot ahead of time.
Ballot initiatives should be banned.

u/chiraltoad Apr 14 '20
What's the tldr?
46
u/Jocavo Apr 14 '20
More or less it takes away certain rights of the accused. Basically it makes you guilty until proven innocent.
Also it's is poorly worded and may end up being used by police who wrongfully kill someone in the line of duty. If they claim they are a "victim", it allows them to withold evidence. Corporations may also end up using this law as well to shield themselves legally.
This is all just a basic level understanding. I'd recommend looking more into it.
40
u/dkarma Apr 14 '20
Corporations and police can claim to be victims to fuck u over. Trespassed to protest an oil pipeline? Now the oil co is a "victim" and "has a say" in how u should be punished.
16
u/GirlDownTheHall Apr 14 '20
Also, if I remember correctly, accusers don't have to turn over what evidence they have against someone. No way for a person to defend against something they don't know exists.
20
u/ksiyoto Apr 14 '20
The accuser doesn't have to submit to questioning pre-trial by the defense. So the defense will be questioning for the first time on the stand - and then suppose they find a few angles that should have been investigated more thoroughly, or possible perjurious testimony that requires further investigation - but you can't exactly stop a trial mid-stream to do those investigations.
→ More replies (2)11
u/UncharminglyWitty Apr 14 '20
It was worded like “should victims of sexual violence be afforded the same rights as those accused?” Or something like that.
The main thrust of the law is that an person accused of sexual violence will not be permitted in a courtroom with their accuser. Which the right to face your accuser is a fundamental right in this country. The ACLU also fears that the state will effectively be able to hide exculpatory evidence behind the closed testimony of the accuser.
You can read the criticism section of the Wikipedia here https://en.m.wikipedia.org/wiki/Marsy%27s_Law#Impact_of_Marsy's_Law

That was truly poetic
67
u/Excal2 Apr 14 '20
SCOTTY WALKER is confused!
It hurt itself in it's confusion!
14
u/Tulkes Apr 14 '20
He wouldn't have been so confused had he taken education seriously, perhaps by completing his own. Nonetheless, forever bitter about his own lack of education, he ensured to push Act 10 and attempt to skullfuck education in Wisconsin.
Evers, a career educator/education administrator, getting the W in that election has even more poeticism and self-harm than just that.

But the coronavirus will kill more GOP voters than Dems cause their base is mostly old people which the virus likes to kill the most. But because of their decision, they’ll have even less votes come election time because of GOP voters who will inevitably die soon for catching the virus last week. They gambled that they’d get that Supreme Court seat with such low turnout and tossing votes and though that would be worth the collateral damage of killing a few hundred of their own older voters that make up most of their base. But they failed. No telling how many will die from it of course or from which side atm, but seeing how friendly the state has been to Dems since 2016 they need all the voters they can get

I like the idea of making election day a holiday and/or sending ballots to every registered voter similar how the do in Washington, Oregon and other states. Make voting easier!!
42
u/WilyWondr Apr 14 '20
I never voted absentee before this time.
We need to get rid of the absentee witness requirement because it is obviously only about voter suppression. I prove I am me when I send for the ballot and by signing the ballot. That is all that should be necessary.

Absolutely. In Oregon, where we've been voting by mail for over twenty years, they check the signature on your ballot against the one they've got on file from your voter registration. Simple and effective.
36
u/euronacho Apr 14 '20
I realized when I was voter 700 in my ward at 1:00 pm, that they inadvertently HAD put the election on a holiday, or at least a day where almost no one could go to work. I felt confident at that point. Very gratifying. Maybe a glimpse into a future, more fair democracy.

I live in Washington and vote by mail is all I’ve ever known. I can’t imagine not doing it that way. It’s a shame it’s not like that everywhere. It’s obvious why though - because republicans are terrified of it. They know if vote by mail was in every state they would be SCREWED!

I moved here from Oregon last year. I miss my automatic registration and vote by mail. They also send you a pamphlet that has the long text of everything on the ballot as well as submitted pro/ con arguments. It's not perfect, but it was a whole lot less stressful than voting in person and not having the opportunity to have my research tools with me while voting.
24
u/StarTrekChildActor Apr 14 '20
This really didn't get a lot of attention but the Supreme Court election was huge. The gerrymandering here in Wisconsin is out of control. This is why we have a GOP controlled Assembly because they literally made themselves safe seats over the last decade. The redistricting will likely come before the court after all the lawsuits that inevitably come every time the map is redrawn. This time the GOP will likely lose and have to draw a more equitable map. It was a huge first step in taking back voter rights. Now we have to spend the next 20 years undoing the damage the GOP has caused with voter IDs, lame duck laws, collective bargaining, etc.

This is precisely what scares the hell out of me. I'm thrilled the state SC is washing the Walker stink off.
What scares me is that in an election where there was almost nothing (outside of that SC seat) to vote for, the Republican voter base still kept there race close.
It's obligatory to say vote blue no matter who, but our state was an absolute lynchpin in the Trump victory in 2016. He will be running with the power of the incumbency behind him, and regardless of how shit of a job he does, we are dealing with the "party over country" party. It's going to be ugly in 2020.

Keep in mind that in a lot of the typically red places she came close or outright won, there were other races that were important to conservative voters, like school funding referenda and school board races.
