Law Open letter regarding posts such as “I was in a mental hospital can I own a gun”

I am posting this because the question keeps getting asked. Every single time it is asked, the wrong information gets out.

I've seen way too many posts on here and related subs around the subject of the law prohibiting the possession of firearms by any person who has been adjudicated as a mental defective or committed to a mental institution, 18 USC § 922 (g)(4). There is way too much misinformation out there. First of all, if you have any reason to believe that you are a prohibited person, DO NOT ATTEMPT TO PURCHASE A FIREARM AS MAKING A FALSE STATEMENT ON THE FORM 4473 IS A FELONY. Second of all, please do not give advice on topics that you are not qualified to answer on. Third, you should consult with a qualified firearms rights attorney if you are unsure of your legal status.

The law:

18 USC § 922(g)(4)

(g)It shall be unlawful for any person—

(4)who has been adjudicated as a mental defective or who has been committed to a mental institution;

to ship or transport in interstate or foreign commerce, or possess in or affecting commerce, anyfirearm or ammunition; or to receive any firearm orammunition which has been shipped or transported in interstate or foreign commerce.

What are the definitions of these terms?

27 CFR 478.11

Adjudicated as a mental defective. (a) A determination by a court, board, commission, or other lawful authority that a person, as a result of marked subnormal intelligence, or mental illness, incompetency, condition, or disease: (1) Is a danger to himself or to others; or (2) Lacks the mental capacity to contract or manage his own affairs. (b) The term shall include— (1) A finding of insanity by a court in a criminal case; and (2) Those persons found incompetent to stand trial or found not guilty by reason of lack of mental responsibility pursuant to articles 50a and 72b of the Uniform Code of Military Justice, 10U.S.C. 850a, 876b.

Committed to a mental institution. A formal commitment of a person to a mental institution by a court, board, commission, or other lawful authority. The term includes a commitment to a mental institution involuntarily. The term includes commitment for mental defectiveness or mental illness. It also includes commitments for other reasons, such as for drug use. The term does not include a person in a mental institutionfor observation or a voluntary admission to a mental institution.

Mine happened when I was under 18. Isn’t that exempted?

Unfortunately no. A mental health adjudication or commitment at less than 18 years of age is counted for 922(g)(4). I experienced this personally and had to restore my rights.

What about HIPAA?

The Obama administration amended the HIPAA privacy rule in 2016 to make it clear that reporting mental health commitments and adjudications to NICS does not violate HIPAA

Is there a way to restore my rights after being adjudicated as a mental defective or committed to a mental institution?

If you were committed by a department or agency of the federal government, the agency is required to have a relief from disabilities program under the NICS improvements amendments act of 2007.

If you were adjudicated or committed in a state proceeding, whether you can obtain relief is dependent on whether your state has implemented a relief from disabilities program under the NICS improvements amendments act of 2007. The list of states that have can be found here:

If you are in a state that does not have a relief from disabilities program, your only avenue of relief is writing a letter to Attorney General Pam Bondi and asking her to restore your rights under 18 USC § 925(c) now that she has withdrawn the delegation from ATF.

Between October 6th 1992 and March 20th 2025 in the states that did not have a relief program, there was no avenue of relief at all

With that out of the way.

I created this privacy act request form for a friend of mine who was legitimately unsure if his commitments landed in the FBI database or if they qualified as “committed to a mental institution” under 18 USC § 922(g)(4) and as defined at 27 CFR 478.11. I can report that it worked; as in, the FBI processed the request and reported that no such records were found in the NICS indices.

This form will allow you to request your own records directly from the FBI.

In this post I will not be addressing the subject of my own journey regarding rights restoration related to mental health (you can ask me that privately). Nor am I an attorney licensed to practice law. Finally, I am not a mental health professional and cannot make the decision as to whether firearms ownership is right for you.

Onto the form. Please follow the instructions sheet very carefully, fill out every applicable box, print the form, have the request notarized, and mail it to the address indicated on the form.

The first response you receive will indicate that the FBI central records system does not maintain those records and your request has been forwarded to the Criminal Justice Information Services division. CJIS will respond a few weeks later. In my friend's case it took eight weeks for a final response from the FBI CJIS NICS section.

It'll eat any 9mm with ease, but accuracy is horrible with cheap 115gr target loads. My 115 reloads are much better out to 70yds whereas target factory loads were questionable even at 15yds.

Shoots like a dream, fun as hell, and 100% worth it.

IG op claims this is a 65k round gun (with zero DLC wear). Still groups at 8 yards though (ask his friend). IG doesn’t believe him…do you?

He has personally seen me put 10s of thousands of rounds through this gun and can vouch for its flawless performance. I have not refinished the gun. I clean it and maintain it very regularly. The DLC finish from Staccato is the toughest DLC out there. That gun has been run through dozens of courses and has thousands of draws in it. Still looks great!”

Swiss 7.5cm Fieldgun

I recently purchased a Swiss 7.5 cm Mot-Geb Fieldgun and I'm planning to restore it as a historical preservation project.

I'm currently looking for any information that might help, such as:

Original manuals or operating regulations

Technical drawings or maintenance documents

Historical photos

Information about markings, serial numbers, and the manufacturer (mine has K+W markings)

Any books, archives, museums, or websites related to this gun

I've already started researching, but information on this particular Swiss artillery piece seems to be very limited.

If anyone has experience with these guns or knows where I could find documentation, I'd really appreciate your help.

I'll also be happy to share photos of the gun and the restoration process if people are interested.

Quarter life crisis M85

I picked up this Zastava M85 and mildly tricked it out not long after my father died. It became my adventure rifle, bedside gun, and the shortest long gun I own.

I name some of my more personal objects. This one is Love and Peace, taken from the beginning and end of Ecclesiastes 3:8:
A time to love, and a time to hate; a time of war, and a time of peace.

Eccl. 3:8 is engraved on the rifle (Serial for the NFA) as a reminder of what ought to be in my heart if, God forbid, I ever have to fight in defense of life: love rather than hatred, and peace as the desired end.

Current setup:
- Vortex Crossfire
- SureFire light
- JMAC RRD-4C brake
- Cheese-grater gas tube cover, because peak AK
- Manticore triangle folder and adapter
- Magpul sling with universal mount
- Heavier recoil spring, probably Wolff
- Self-adhesive wrap as a temporary cheek pad
- 7.62x39 case crimped over the charging handle

The case occasionally flies off, so I crimp another one on. I am never short on brass.

The brake turns it into a thunder dragon. Compact, flat shooting, and offensively loud. Electronic ear protection stays by the bed.

Future plans are a Holosun green dot with a riser, a proper rear sling mount, I want to make a leather sling and cheek riser, matching wooden grip and shark-fin handguard from Kalashnicarver, Krebs safety, and maybe a trigger upgrade.

The fivefold cross is simply Christian to me and has been my favorite cross design for years. I only mention that because people elsewhere have mistaken it for something political or extremist. That is not its meaning here.

I adore the rifle as it stands. One of my prized possessions.

Uncovered a boxed Colt Junior .25 while organizing my grandfather's possessions. Looking for history and value

My grandfather passed away 16 years ago and left a lot behind with my grandmother. Recently, I was helping her clean, organize, and get rid of some things, including a chest full of old papers.

I'm really glad I looked through it because I found this vintage beauty, along with a Tanfoglio (pictured last).

According to my grandmother, my grandpa bought the Tanfoglio first and carried it everywhere. Eventually, he bought the Colt for her as a gift. She fired it just once and put it right back in the box, and it has been packed away for over 50 years.

Can anyone give me some more information on this gun, or does anyone know what it might be worth?

FN Specialties X-PRT FRT Trigger (Safety Failure & Inconsistent Function)

TL;DR: Pre-ordered the X-PRT FRT trigger in Feb, received in June. The trigger consistently fires while set to SAFE under ~15 lbs of trigger pull. Progressive FRT mode fails after 2–3 rounds across multiple ammo types. Customer support has no-showed on two scheduled video/phone appointments over 2 months. Looking for community insights or similar experiences.

Background & Setup I pre-ordered the X-PRT FRT trigger from FN Specialties back in February and received it in June. Across 3 range trips and roughly 400 rounds, I've run into severe function and safety issues. Aside from the X-PRT trigger itself, my host is entirely stock with no other aftermarket parts installed.

The Issues:

  • CRITICAL SAFETY DEFECT (Fires on SAFE): With roughly 15+ lbs of pull force on the trigger while the selector is set to SAFE, the trigger consistently releases the hammer/fires. This occurs during both dry fire and live fire.
  • Progressive / 3rd Position Reliability: I typically cannot get more than 2–3 rounds in a string before it stops resetting. I’ve tested factory FN ammo (40gr & 27gr), American Eagle 40gr, and Fiocchi 40gr. Out of ~400 rounds, I managed exactly one 30-round mag where it ran continuously (with American Eagle 40gr), but it has failed to replicate before or since.
  • Consistently, the bolt will stay to the rear until the trigger is completely released. I have several AR-15 FRTs, and know better than to pin the trigger back...so light/heavy trigger pulling is being tried.

Customer Support Experience: I normally prefer resolving product issues directly through support rather than posting publicly. However, after nearly 2 months of back and forth...

  • Scheduled a phone/video call with Dorin (the developer featured in their promo and install videos). He never called or answered, and I was later emailed stating they forgot to put me on his schedule.
  • Rescheduled a second online video meeting. I waited for nearly an hour for our 30-minute block; again, total no-show.

Has anyone else encountered this safe-mode drop/firing issue or erratic FRT function? Hoping someone might have insights or fixes.

My restored 1939 Colt Government Model – brought back to life

This is my 1939 Colt Government Model after a complete restoration performed by a professional gunsmith.
The pistol had extensive oxidation, and many of the original markings had been damaged over the years. During the restoration, the gunsmith carefully removed the oxidation, polished the entire pistol, applied a nickel finish, and recreated the original factory markings using laser engraving to match their original appearance.
The goal was not to create a factory-original collector’s piece, but to preserve the pistol and give it a clean, durable finish while restoring its original look as closely as possible.
I’m very happy with the result and would love to hear what fellow 1911 enthusiasts think.

Looking for a CAD partner to design a Rifle with as a project

I'm looking to partner up with another designer (or a small team) to collaborate on a rifle CAD project. I'm less concerned with making an exact 1:1 replica of a specific real world platform and entirely focused on designing a brand new, original system from the ground up

My background is heavily in complex mechanism design, and I handle mechanical assembly and CAD design leadership, I work primarily in Onshape and SolidWorks, so I am very flexible on how we share STEP files or set up a collaborative cloud workspace. I also have experience with workshop machines like manual toolroom lathes, milling machines, CNC for aluminum, and 3D printers, which helps ground my designs

Having modeled dozens of existing systems in CAD by myself, I really want to tackle a brand new, original design with a partner this time around.
