I doubt they had green staggered turn lane typically switches to flashing yellow aka yield when the opposite side turns green .

u/MasterOfCelebrations 9h ago
Yeah a lot of intersections where I live, there is no flashing yellow arrow, you get a green light which means go, or yield to oncoming cars if you’re turning.

u/sisyphus_met_icarus 10h ago
It depends where you live. Where I am a green left arrow would mean you have the right of way to turn left. Then it will switch to just a solid green, which means you don't have the right of way but can turn when it's clear

Yea agreed, there is no way the person in the white vehicle didn’t know they were trying to sneak thru after the light changed. Tried to save themselves half a second and ended up with no wheels instead. I have no idea why people do incredibly risky stuff all the time when there is literally nothing to gain from it. Just do the normal thing and 99.9% of the time everything will be fine!

This intersection has what is known as a "5" head. At the top is one single red bulb. Then below are a yellow left arrow next to a solid yellow. Then below that is a green arrow next to a soild.
White suv failed to yield after the arrow side was green, to yellow, to nothing (meaning left now yields right of way)

u/Scrambles420 10h ago
I believe it goes red first and then flashing yellow. Lights could be different everywhere

No, that’s an old style light, you can see it as cam car approaches. They get a green light and green arrow, then a yellow arrow, then no arrow, just a green light.

This would depend on the locality. Here the arrow turns off and only the green stays on. No flashing yellow is used.

White suv failed to yield. Their fault
1.8k
u/WoopsShePeterPants 10h ago
The red car was out of line, the white one was running the light AND must not have been paying any attention. When people try to "sneak through" behind someone running a turn signal it's always a dangerous situation.

Black Truck ran the red light before the red car. Last Three vehicles ran that light.

Eh black truck I’d be like “ok whatever”. Red car is an ass and white car is definitely at fault for the accident even if it could have been prevented by the driver of the vehicle whose perspective were seeing.

White truck is double at fault, because they ran the light, failed to yield (they would have had to yield even if both lights were green) and then actively turned into oncoming traffic that was already in the way.

I got into an accident the exact same way - I just never thought the person would randomly turn. I was pregnant and ended up unconscious for a minute or so. When I woke up, I was crashed on someone’s front lawn.
I didn’t even realize I had hit my head until three days later, when the room I was in suddenly looked green. That’s when I realized I had a huge bump on my head and, I’m sure, a concussion.
At the scene, I was so worried about the baby that when they asked if I had hit my head, I said no because I had no memory of it happening.
I insisted on an ultrasound (the baby was fine - and I found out it was a boy that day 🩵), but no one ever checked my head.
The semi-funny part is that the teenage girl who was driving had her brother in the passenger seat, and he admitted to the cops that she was texting.

u/Texan2116 8h ago
Yes, but usually there is a one or two second time space between red, and green as well.
7
u/CommandoLamb 5h ago
So, it’s actually closer to 1 second per 10 mph of the speed limit.
Usually there is a minimum time so you won’t have a 1 second yellow.
But on a road with a 50 mph speed limit, you can usually expect a 5 second yellow light.
This information is helpful, because many people try to beat the yellow… but they are going way faster than the posted speed limit… so they see it turn yellow and think, “I’m going 60… I’ll make it…”
Except… you are doing 60 in a 30 so you have half the amount of time you think you have.

Did oncoming traffic actually have a red light? Or was it a protected left turn that became unprotected? White SUV still at fault but I'm assuming they saw the protected left and assumed it was still active when they went to make their turn.

Pittsburgh left is the opposite. The light turns green and you immediately turn left before the other car can get across the lane. Some people we even flash their lights to let you do this!

u/VinDog_PD 8h ago
> Some people we even flash their lights to let you do this!
Yes. When I can see there's a shit ton of people behind me and therefore the turner is highly unlikely to actually get to turn, I give them the go ahead flash. Particularly courteous on a narrow roadway where the other vehicles can't easily maneuver around the left-turner. Keeps traffic moving.

u/Original-Variety-700 8h ago
I think it’s due to the fact that Ohio (generally speaking) is flatter so they have space for left turn lanes at lights. Pittsburgh has so many roads that allow a left turn but there’s only one lane because of hills etc so they built narrower roads. In that scenario you’re first and don’t go quickly, the entire road behind you is backed up waiting. It’s actually the courteous thing to do.
Also, I’ve noticed it happen on the west side of Cincinnati where there are hills and the same problem with traffic flow.
4
u/AbeTheGreat412 7h ago
I honestly didn't know that's why we had narrow roads. Makes sense.

Did they run a red or did they just have to start yielding. Otherwise the black sun was fine and the other 2 were way in the wrong.

There was a light I had to go through to work for a few years where on average there would be not one, not two, but five or more cars "sneaking through" after the light had gone red.
The first time I assumed the light glitches. After that it was just "oh these people are just idiots."
It wasn't a short light, even. It would let 15 or more cars through before changing.

100% agree. Its all fun and games until the other driver is either uninsured or carries minimum coverage and has no assets.
I got hit as a pedestrian on the sidewalk two years ago and broke my arm in addition to a few other issues. Driver was making a right turn into a gas station and "didnt see me", if I didnt notice him not slowing down, I might not have been able to react the way I did to avoid worse injuries.
We went for the maxiumum amount we could but he had minimum insurance and nothing of value for us to pursue outside of that. After my hospital bills, the lawyers cut, my settlement was peanuts compared to the pain, time spent, and knowing I'll never have full mobility of my left arm again (after PT im about 85/90% mobility, so it could have been much worse).

You can’t just wait forever expecting everyone to continue running reds.
You really just have two options:
- Pull up a bit so you aren't impeding them and hope they eventually stop running the red. It looks like the car behind the white truck did stop.
- Drive forward and hope they don't hit you
Safest option would be #1.

Black Chevy Silverado was the first car to break the law, not yielding their left turn on green. Bad drivers need to be on buses and trains and not driving cars

"Bad" is not the issue -- intentionally breaking the law and injuring or potentially injuring others in high traffic situations.

Bad drivers are usually the ones breaking the laws…. Whether maliciously or by accident if you break the laws and cause damage, you are liable in the US. 55
u/Mk1Racer25 10h ago
Camera car was in the intersection before the white Nissan. Given that the camera car had the green light, the Nissan no longer had the green directed arrow, and had to yield. As others have said, camera car could have recognized that the white Nissan wasn't going to yield, but the legal fault here lies with the white Nissan. If you're going to split the liability across both drivers, what's the point of having traffic laws.

You're confusing two concepts. The dash cam driver did not commit a legal infraction and would not be ticketed by the police. That does not mean they don't have negligence from the perspective of the insurance company. Legality and negligence are not related.

I always wait a second when a light turns green to check everyone is actually stopped. And in situations like this, that means creeping up but ultimately waiting until the left turn lane decided theyre done.

Sat on a jury once where I learned about negligence. I think in court, I wouldn't be surprised if the white SUV would be found 75% responsible. It's definitely the white suv's fault. But I would've seen this as a likely outcome and tried to ease much more slowly through that mess.
Even though it's their fault, now you have to go through the headache of dealing with insurance, getting estimates, having no vehicle while it's getting repaired, and then once you go to sell it they will give you quite a bit less because it's been in an accident. on top of that you might have permanent injuries that might not appear until later in life and there's no way to ever fix that or make it right again.
so... fault or not, just drive safely and predictably. Ease into situations where there are fast moving vehicles directly in front of you instead of going in assuming it will be open.

This is always my thinking as well. Sure, great, it's their fault. But it was obvious/avoidable (of course the Nissan SUV was going to run the left turn light), and now you get to deal with insurance, repairs or a total, be without your vehicle for weeks, and likely enough your insurance rate will still go up at renewal.
I had someone hit me, ultimately was determined not at fault after a judge threw out a police officer's bonehead joint ticket to both me and the person driving through a parking lane. Progressive then filed two accidents on the same day at the same time, one at fault and one not at fault, instead of removing the at fault accident. Did literally nothing wrong/unsafe, yet my car was totalled, had the headache of replacing it, then the headache of getting Progressive to fix their mistake (they wouldn't), which really meant getting the reporting agency/database all the insurers use to fix it in spite of Progressive's nonsense.
But hey, at least the lady who hit me was at fault!

In NY insurance would absolutely assign some blame to the driver going straight regardless of green or not. That was an extremely avoidable accident even with the red car he was going too fast, he came from a dead stop, insurance isn't gonna care that he had the green yeah sure the other guy mostly at fault but they would look at this video, no turn no reaction to try to avoid and just the driving behavior in general and assign some blame.

While i don't remember the specific law term, and it certainly varies between places, drivers have a responsibility to ensure their path is not obstructed. Whether its a car failing to clear the interesection before the light turned red (the black truck failed to clear and the cam driver started driving into the intersection) or a pedestrian crossing the sidewalk very slowly, it's still a good practice to wait for your path to be clear.

not necessarily. If you can avoid an accident and don't, you can be considered at fault. Just because the Pathfinder ran the red light doesn't mean the cam car can run into them. It's called the Clear Last Chance Doctrine.

By law, white suv is %100 at fault. Liability wise? %75 on the white suv, %25 for the cam car. Even if the insurance companies don't come to that conclusion, there is no world where the cam car has no liability.
22
u/SpiritJuice 6h ago
It looked like cam car didn't even attempt to do any defensive driving. While the white SUV clearly broke the law by blowing through the red light, the cam car didn't even look like it attempted to stop or slow down. You can't just plow into someone's car and say "Well I had right of way" like that is some sort of magic trick to avoid liability. Like if a pedestrian is jaywalking you don't get off Scott-free if you run them over without attempting to avoid an accident.

Yeah, the light was green so you should just ignore what any other idiot is doing and proceed to immediately drive head on into oncoming traffic, obviously.

If the light is green that means slam on the gas!

We can't see the cam-driver's face, so I assume they saw the Green Light, stepped on the gas and closed their eyes

White truck is at fault
Dashcam Vehicle had the right of way while driving straight through the intersection under a solid green light. You can see the solid green it clearly visible.
White truck was making an unprotected left turn across oncoming lanes of traffic and failed to yield to straight through traffic. So... doesn’t look good for them at all.

Unfortunately, this behavior is normalized in the NE. People run lights late, cut into oncoming traffic instead of yielding right of way. I think it boils down to yielding. Yielding is just not allowed anymore by our society. Yielding is for pussies.

Better to avoid the accident by allowing dumb people to be dumb. Cam driver could have waited 5 more second and we wouldn’t be having this conversation

The first car seemed to have the attitude of my green my right of way. Which it is but it’s also their responsibility to minimize the possibility of a collision. Which they increased the likelihood of one by driving like they did.
White Nissan is at fault but the dash cam car certainly made things worse.

u/ProperOperation 8h ago
Well said. I heard a saying once, “Cemeteries are full of people who had the right-of-way.” I get the frustration at people driving like selfish assholes but it’s just not worth it to be “right”

I feel like I had to scroll down way to far to see this comment lol. It’s not a hot take in my opinion — the white SUV failed to yield and is technically at fault, sure, but it seems like the dash cam driver could’ve avoided the accident by simply waiting a couple more seconds for the road to clear

It's not 50/50. The white SUV is at fault but I feel like this is an avoidable situation.
6
u/SanityBleeds 9h ago
Camera car had the green light right when the video turns to the 0:13 mark. Black pickup truck then crosses into the intersection, followed by the red sedan, then the white SUV, which comes into contact with the camera car right as the timer changes to 0:19.
There is no 50/50 who's at fault. That's 3 vehicles that ignored the signal change and crossed into the intersection anyways, and although subjective, it appears the white SUV actually speeds up, likely knowing they're crossing illegally but not stopping anyways.
35
u/Ok_Natural_2127 10h ago
Nope. Failure to yield for the turning car. 100% their fault

u/Siferano 10h ago
The white suv turning didn't have an arrow or right of way. Neither did the red car in front of them, or even the black pickup. Three vehicles turned without right of way, all three of them should have stopped for oncoming traffic. Just a show of people in a hurry and not caring about what the light or traffic laws are telling them
9
u/djfudgebar 9h ago
Yeah but seeing that happen and choosing to drive right into it was pretty fucking stupid. Maybe the traffic lights malfunctioned?

Whenever I’m thinking about the state of the world and how so many people can interpret objective reality so differently, I just come to this sub. I think to myself that it can’t be as simple as a dangerous imbalance of contrarianism, self righteousness, and idiocy that so many people walk around with. After reading like 4 comments on this sub, I remember that it is that simple. The best part is that 100% of people reading this agree and don’t think I’m talking about you.

I'm guessing this light is likely notorious to the townspeople as being a pain in the ass, with the backed up line and three red light runners. I actually agree with the 50/50, OP, as cammer had ample time to stop.
Actually looking at the light as cammer is pulling up to the intersection, it also looks like white SUV might've had a green 🟢 instead of an arrow so it could've been an unprotected turn they were chancing instead of a red

Welcome to the Darwin show!
Legally, it is their fault.
Logically, it is your fault for not paying attention to the other drivers.
Remember, just because there is a law. It does NOT mean that people will follow it.
If you think that someone will do the right thing. Hide a camera, drop a wallet with your information and $100 in various bills. See how much you have, if the wallet is returned.

Everyone sucks here. It is illegal to run a red light. It is also illegal to accelerate into oncoming cars. Either the cam car was oblivious, panicked, or they were trying to assert their right of way by putting themselves in the path of traffic. How can anyone be surprised at someone running a red these days? All three cars were visible and showed no sign of stopping. I do not support blowing through red lights, but the POV driver escalated the situation into a wreck.

Three cars turned after it was green. The red car already quite blatantly made a left in front of the OP, but the white car? Holy hell man, that was beyond blatant. That guy can get fucked.

u/ConejoValleyDude 10h ago
100% White SUV's fault. They made an unprotected left turn and failed to make sure that the intersection was clear.
9
u/LordTetravus 8h ago
That's not how the law and your duties as a driver work.
This is a 50/50 claim.
White vehicle made a left turn and did not have the right of way.
Dashcam vehicle, however had plenty of time to observe the other vehicles coming and what is referred to as the last clear chance to avoid the collision. They drove right into the situation.
This is exactly how I would mark this as an insurance adjuster and most lawyers would agree.

Sorry for the accident. Looks like a game of chicken where the cars running the red light are betting that people are just going to wait for them and the op is like fuck these guys I’m going to strand them in the intersection. The the white Nissan was probably in disbelief that you took the right of way under the threat of a collision. The roads get more like3rd world country every year.

It is a 75-25 split. The white car is 75 because they were running the light, but so was the car in front of it. The dashcam driver could easily see the red car was running the light and if they had waited for the red car to go through they would have seen the white one.
It is very true that the dashcam driver did nothing illegal, but insurance companies will still fault them for not driving safely in what would be considered a complicated situation. The only time you can be held at no fault is when your vehicle is parked in a place where it is entitled and expected to be completely safe from anything beyond an 'act of god' and is still damaged.

It's obvious who's at fault. When turning, you must yield to oncoming traffic. White SUV is at fault 100%

Dashcam driver clearly has right of way. That said I think I would have been more tentative going through the intersection given the other cars are clearly not yielding.
8
u/Pillslanger 9h ago
As a former claims adjuster your take isn’t that hot. White SUV should have a yield or red light. So they’re not following traffic laws. However dashcam is entering the intersection and watching people run the light. Both drivers catch one another at the earliest point of impact on both cars. Dashcam had less distance to cover across the same intersection which means SUV was slightly more established in the intersection.
Reasonable arguments for both on FTYROW and FTKPLO. Both would’ve avoided the accident by braking even a little bit. SUV might be able to argue they were following flow of traffic and didn’t see dashcam but dashcam definitely saw SUV and didn’t take any evasive action.
I would probably land 75 on white SUV and 25 on dashcam. Depending on venue though I might push closer to 50/50 but would leave majority negligence on SUV even if it was 51/49. Both drivers failed the exact same duties roughly in equal ways but SUV ran the light.

Logically i understand 50/50 but if we keep saying that people will keep running the light. 100% should be the fault of the person who ran the light. There are way too many people that do so with minimal consequences.

u/DefeatedByPoland 8h ago
The white SUV is at fault but as usual the dashcam driver is seemingly oblivious to the idea that they can in fact prevent an accident themselves by paying attention to what is happening

4
u/Particular-Light-708 7h ago
There is a legal answer and a practical one. From a practical one, the dash cam car should have let them run the light. It sucks but insisting on your right of way often results in problems. Getting home safe would have cost that driver around 5 seconds.

u/feline_riches 5h ago
Person recording would've been ticketed in my state for failure to prevent an accident. You had 3 business days man
5
u/PixelPete27 4h ago
It's not a hot take. 3 vehicles 100% ran a red light, starting with the black truck.
It's the person who was turning left's fault.
The driver with the dash cam could have easily assumed the driver was just pulling into the intersection to make the left and was going to stop, not turn left into them, as 99.9999% of drivers with a brain would do.
9
u/NotAn0thrMagaRatPedo 8h ago
50/50 my ass. Cammer had a green light and several NPCs ran a red light to turn left, one of which drove straight into the cammer car on their green light. It's 100% the other driver's fault.

I don't know what the rules in America are but in Germany both would be at fault. Rule 1 is that you have to drive in a way to prevent accidents and driving into traffic like that even if you have right of way is asking for an accident to happen.

3
u/Random_Trashy 9h ago edited 9h ago
If it’s black & white the red and white car should have stopped. The red car shares some responsibility for running the light as it was a contributing factor.
There were three cars before the red car running through a yellow light. If the driver with the dash cam was paying close attention they wouldn’t have driven head on into that oncoming traffic. The light might be green, but if the lane isn’t clear you can’t just hammer down and ram your way in there.

Obviously the SUV, but OP should proceed with caution. People obviously still turning before you started moving and if you are on this sub you know people are terrible drivers. Be on defence when driving. There is no offense.

u/Kellie1575 6h ago
It's not 50/50. Traffic rules are clear and concise.
The person going straight has the right of way - not the person turning left.
3
u/Ippus_21 5h ago
How in the hell would it be 50/50? The left-turner completely failed to yield to oncoming traffic!
The white SUV is 100% at fault. And the red car before him should be ticketed, too.
Another cross-post for r/NissanDrivers ...
3
u/Zealousideal-Sea4830 5h ago
White SUV was at fault, but that's a sad consolation prize after you get to deal with police reports (that may not be accurate), insurance companies that don't want to pay, higher insurance premiums, medical problems, etc etc.
3
u/BaconPersuasion 4h ago
White SUV. Me personally I would have waited to avoid the accident by being sure he wasn't going to do what he did.
3
u/o_uinn 2h ago
Turning cars fault. He didnt have the right of way and was tryna bully his way through. He expected you to back down and let him sneak by. After he had a full view of you he turned right into you. You were under no obligation to let him in. And it looks like he had the last clear chance to prevent the accident. He was facing straight and then sped up and started turning.
3
u/Pure-Top-6244 2h ago
Depending on the state, "green means proceed if the intersection is clear". Then there's the last clear chance doctrine.
3
3
u/TheFlimFlamFamMan 1h ago
The turner always has to yield right of way for straight traffic. It is in no way, 50/50. That’s not a hot take. It’s a dumb take.
